No. 32417-H THE FIRST VICE PRESIDENT EXERCISING THE PRESIDENCY OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred by articles 140, subsections 3) and 18) and 146 of the Political Constitution; articles 25 subsection 1), 27 subsection 1) and 28 subsection 2) paragraph b) of Law No. 6227, General Public Administration Law of 2 May 1978; Law No. 8131, Law on Financial Administration of the Republic and Public Budgets of 18 September 2001 and its Regulations, Executive Decree No. 30058-H-MP-PLAN of 19 December 2001; Law No. 6084, Law of the National Parks Service of 24 August 1977; Law No. 7554, Organic Environmental Law of 4 October 1995; Law No. 7788, Biodiversity Law of 30 April 1998; and Executive Decree No. 31708-H of 16 March 2004.

1st—That Organic Environmental Law No. 7554, published in La Gaceta No. 215 of 13 November 1995, establishes that the Ministry of Environment and Energy (MINAE) is the governing body in environmental matters and must therefore ensure the protection, conservation, and use of natural resources as an indispensable condition for sustainable economic development.

2nd—That the National Parks Fund, created by Law No. 6084, Law of the National Parks Service, published in La Gaceta No. 169 of 7 September 1977, is part of the National System of Conservation Areas, as established in Law No. 7788, Biodiversity Law, published in La Gaceta No. 101 of 27 May 1998, a system through which the protection, conservation, control, and promotion of these protected areas is carried out due to their richness in wildlife species and forest cover (bosque forestal).

3rd—That the National Parks Fund requires the incorporation of additional resources to cover operating Supplies; Machinery and Equipment; Constructions, Additions and Improvements; and Current Transfers.

4th—That through Executive Decree No. 31708-H and its amendments, published in La Gaceta No. 62 of 29 March 2004, the Budgetary Authority issued the General Budgetary Policy Guidelines for 2005, which were made known to the Government Council and approved by the Executive Branch, establishing in article 1 of the cited decree the maximum budgetary 5th—That through official communication STAP-0420-04 of 12 April 2004, the National Parks Fund was notified of the maximum budgetary expenditure set for the year 2005.

6th—That in light of the foregoing, it is therefore necessary to modify the maximum budgetary expenditure set for the National Parks Fund for the year 2005. Therefore:

1. 1Que la Ley Orgánica del Ambiente Nº 7554, publicada en La Gaceta Nº 215 del 13 de noviembre de 1995, establece que el Ministerio del Ambiente y Energía (MINAE) es el ente rector en materia ambiental, por lo que debe velar por la protección, conservación y aprovechamiento de los recursos naturales como condición indispensable para el desarrollo económico sostenible.
2. 2Que el Fondo de Parques Nacionales, creado mediante Ley Nº 6084, Ley del Servicio de Parques Nacionales, publicada en La Gaceta Nº 169 del 7 de setiembre de 1977, forma parte del Sistema Nacional de Áreas de Conservación, según lo establecido en la Ley Nº 7788, Ley de Biodiversidad, publicada en La Gaceta Nº 101 del 27 de mayo de 1998, sistema mediante el cual se lleva a cabo la protección, conservación, control y fomento de estas áreas protegidas debido a su riqueza en especies de vida silvestre y bosque forestal.
3. 3Que el Fondo de Parques Nacionales requiere incorporar recursos adicionales para cubrir gastos de operación en las siguientes partidas: Servicios Personales; Servicios no Personales; Materiales y Suministros; Maquinaria y Equipo; Construcciones, Adiciones y Mejoras; y Transferencias Corrientes.
4. 4Que mediante el Decreto Ejecutivo Nº 31708-H y sus reformas, publicado en La Gaceta Nº 62 del 29 marzo del 2004, la Autoridad Presupuestaria formuló las Directrices Generales de Política Presupuestaria para el 2005, las cuales fueron conocidas por el Consejo de Gobierno y aprobadas por el Poder Ejecutivo, estableciendo en el artículo 1º del citado decreto, el gasto presupuestario máximo para el año 2005, de las entidades cubiertas por el ámbito del mencionado Órgano Colegiado.
5. 5Que mediante oficio STAP-0420-04 del 12 de abril del 2004, se comunicó al Fondo de Parques Nacionales el gasto presupuestario máximo fijado para el año 2005.
6. 6Que por lo anterior, resulta necesario modificar el gasto presupuestario máximo fijado para el Fondo de Parques Nacionales para el año 2005. Por tanto:
