"a) Academic Director. Is the person responsible for the administration of the resources and the teaching and administrative staff of the Service Academy, in addition to planning, coordinating, and directing the Curricular Program of the Service Academy in coordination with the Coast Guard Directorate; will oversee the correct functioning of the units in charge of instruction in nautical technical-police training, striving at all times for excellence in the professional preparation of the personnel to be trained. To fulfill the foregoing, the Director must reside in the same zone where the Service Academy is located.
For the purposes of the recognition for zonaje established in Article 24, subsection e) of Law Nº 8000, the following rules must be observed:
- i)The payment of zonaje shall be a percentage, taking into consideration means and risks of transportation, climate, salubrity of the canton or place, access to basic services, local cost of living according to the indices of the National Institute of Statistics and Censuses, possibilities for education and medical care for the servant and their family, such that one hundred percent shall correspond to the maximum sum that the Comptroller General of the Republic sets for the payment of zonaje to public servants.
The payment of zonaje shall not proceed when the legal domicile of the Academic Director is in the same place or cantonal jurisdiction as the Service Academy. In determining the sum to be paid for zonaje, account must be taken of the lodging and food benefits received by the servant from the Ministry, which signify a decrease in their subsistence expenses.
- ii)The Human Resources Directorate shall conduct the respective study to determine whether or not the payment of zonaje is applicable in accordance with the considerations indicated in the preceding article. If it is applicable, it shall issue a resolution that will serve to process the respective personnel action, in which the amount recognized to the servant for zonaje must be indicated, as well as their legal domicile and the place where the Academy is located. Each personnel action of the servant shall record the amount for the aforementioned concept.
If the payment is not applicable, it shall proceed to communicate this by a reasoned resolution to the Director of the Academy, with a copy to the Director of the Service.
- iii)The percentage calculation that will be recognized for zonaje shall be set according to the territorial division established for the Public Force, in accordance with the table contained in section vi) of this subsection. The Human Resources Directorate shall adjust these percentages ex officio, in accordance with the maximums and minimums established by the Comptroller General of the Republic, as stipulated in Article 3º of the Regulation for the Payment of Zonaje to Public Administration Servants, and it shall enter into force once the respective budgetary allocation exists.
- iv)The payment of zonaje shall be maintained when the Director of the Academy is, for a term of up to one month, in any of the following conditions:
- a)Disability.
- b)Vacation.
- c)While undergoing training or enjoying a scholarship.
- d)On leave with pay.
- e)By transfer to perform duties inherent to their position in a zone where zonaje is not paid.
- v)When the servant is obliged to remain for a period exceeding one month outside their habitual place of work for reasons of training or another motive, the payment of the incentive shall be suspended until they rejoin their duties in said place, upon prior formal notification to the Human Resources Directorate.
The suspension shall enter into force once one month has passed after their move to another zone.
- vi)The percentages that shall be recognized for zonaje purposes in accordance with the provisions of subsection iii) of this Regulation are the following:

- vii)When the servant is transferred from a zone with entitlement to zonaje to another with the same entitlement, for a period exceeding one month, the corresponding payment shall be made, adjusting it in accordance with the zone table in the preceding article.
- viii)The Human Resources Directorate shall be responsible for conducting the corresponding study for the payment of the incentive regulated herein, and for executing and ensuring the faithful compliance with these provisions, with the Academic Director being obliged to observe and abide by the procedures dictated for such purposes.
- ix)For the payment of the incentive, the Academic Director must request its recognition or modification from the Human Resources Department, attaching a certification of their legal domicile, signed and sealed by the competent authority of their territorial circumscription, as well as a sworn declaration signed by them and by the Director of the National Coast Guard Service, attesting to the place where they provide or will provide their services. The benefit shall enter into force on the first day of the month following their request, provided that the same is applicable. The Director of the National Coast Guard Service shall be responsible for processing before the Human Resources Directorate the duly substantiated request for the suppression of the benefit, accompanied by a certification of the servant's legal domicile.
- x)The zonaje shall cease to be paid when the servant ceases to work in the position for which they were appointed with the enjoyment of said benefit or when the circumstances that motivated that additional payment change.
The suppression of said benefit shall be carried out, after a hearing is granted to the servant, by a reasoned resolution from the Human Resources Directorate, which shall be communicated to the servant thirty days in advance of the date it will take effect. Against such resolution, the remedies of revocation and appeal are admissible under the terms and conditions stipulated in the General Law of Public Administration.
In no case may an acquired right to zonaje be alleged, as it does not constitute an invariable benefit.
- xi)In matters not regulated in this subsection, the provisions of Executive Decree Nº 90-SC of December 13, 1965, published in La Gaceta Nº 286 of December 17, 1965) shall apply.
