Considering:

R-153-AGUAS-MINAE-2000, at twelve o'clock on April sixth, two thousand, the Department of Waters of the Ministry of Environment and Energy granted, as of that date, to Mr. Carlos Manuel Pérez Ramírez, identity card No. 4-114-744, a concession for water use (aprovechamiento de aguas) for a term of ten years, for domestic use, watering trough (abrevadero), and pigsty (porqueriza), throughout the year, twenty-four hours a day, in the amount of 0.40 liters per second, carrying out the intake (captación) of a spring (naciente) located on the farm of the Guanacaste district, registration number 016126-000, with the boundaries and area indicated in the registry, which is the property of Mr. Iok Io Chan Wong, known as: Andrés Sánchez Wong, identity card No. 8-044-515, and conducting it by underground pipeline to the site of use.

Carlos Manuel Pérez Ramírez, identity card No. 4-114-744, in his capacity as owner of the dominant tenement (fundo servido), which belongs to the Guanacaste district, Folio Real No. 095866-001 and 002, filed a request for imposition of an aqueduct easement (servidumbre de acueducto) before this Office, following the recommendation made by MINAE and in adherence to the provisions of the Water Law No. 276 of August 27, 1942, and its amendments.

0142-2004-ALG, at fourteen thirty-five on January twenty-six, two thousand three, the Directorate of Legal Counsel of this Ministry notified the parties of the report rendered by the expert appraisers from the Valuation Department of the Ministry of Finance, Engineer Lorena López Alfaro, regarding the amount of compensation corresponding to the owner of the servient tenement (fundo sirviente), which amounts to the sum of ¢409,177.10 (four hundred nine thousand one hundred seventy-seven colones and ten céntimos).

R-153-AGUAS-MINAE-2000, at twelve o'clock on April sixth, two thousand, Articles 99 and following of the Water Law No. 276 of August 27, 1942, and its amendments, and Article No. 383 of the Civil Code, it is appropriate to decree the constitution of the corresponding aqueduct easement (servidumbre de acueducto).

THEY DECREE:

016126-00, which is land for agriculture, pasture, and mountain, located in the province of Guanacaste, canton eight Tilarán, district seven Arenal. Boundaries: north, Freddy Pérez Elizondo; south, public road and Turística SU S. A.; east, Fernando Murillo Esquivel and Turística SU S. A.; and west, Freddy Pérez Elizondo, Agropecuaria Río Blanco, and Turística SU S. A. It measures one million three hundred fifty-five thousand three hundred sixty-five meters and thirty square decimeters, which belongs to Mr. Iok Io Chan Wong, known as: Andrés Sánchez Wong, identity card No. 8-044-515, in favor of the property of the Guanacaste district, registration Folio Real No. 095866-001 and 002, whose nature is pasture land situated in district 07 Arenal, canton 08 Tilarán, of the province of Guanacaste, with boundaries and area as indicated in the registry and whose owner is Mr. Carlos Manuel Pérez Ramírez, identity card No. 4-114-744.

Mide un millón trescientos cincuenta y cinco mil trescientos sesenta y cinco metros con treinta decímetros cuadrados, la cual pertenece al señor Iok Io Chan Wong conocido como: Andrés Sánchez Wong, cédula de identidad Nº 8-044-515, en favor del inmueble del partido de Guanacaste, matrícula Folio Real Nº 095866-001 y 002, cuya naturaleza es terreno de pasto situado en el distrito 07 Arenal, cantón 08 Tilarán, de la provincia de Guanacaste con linderos y cabida que indica el registro y cuyo propietario es el señor Carlos Manuel Pérez Ramírez, cédula de identidad Nº 4-114-744.

Artículo 1 — To impose an aqueduct easement (servidumbre de acueducto) for the term of ten years, according to the terms of the concession, over the property registered in the Property Registry, Guanacaste district, Folio Real No.

Artículo 2 — Description of the easement (servidumbre): It will be located in a north-to-south direction, with a length of seven hundred twenty-eight meters, and a width of two meters, for an extension of 1,437.24 square meters.

Artículo 3 — The compensation is set at the sum of ¢409,177.10 (four hundred nine thousand one hundred seventy-seven colones and ten céntimos), which must be paid immediately by Mr. Carlos Manuel Pérez Ramírez or by his attorney-in-fact, Licenciado Oscar Alberto Pérez Murillo.

Artículo 4 — This Executive Decree becomes effective upon its publication.
