1. 1That through Resolution No. R-153-AGUAS-MINAE-2000, at twelve o'clock on April sixth, two thousand, the Department of Waters of the Ministry of Environment and Energy granted, as of that date, to Mr. Carlos Manuel Pérez Ramírez, identity card No. 4-114-744, a concession for water use (aprovechamiento de aguas) for a term of ten years, for domestic use, watering trough (abrevadero), and pigsty (porqueriza), throughout the year, twenty-four hours a day, in the amount of 0.40 liters per second, carrying out the intake (captación) of a spring (naciente) located on the farm of the Guanacaste district, registration number 016126-000, with the boundaries and area indicated in the registry, which is the property of Mr. Iok Io Chan Wong, known as: Andrés Sánchez Wong, identity card No. 8-044-515, and conducting it by underground pipeline to the site of use.
2. 2That on April 22, 2003, Mr. Carlos Manuel Pérez Ramírez, identity card No. 4-114-744, in his capacity as owner of the dominant tenement (fundo servido), which belongs to the Guanacaste district, Folio Real No. 095866-001 and 002, filed a request for imposition of an aqueduct easement (servidumbre de acueducto) before this Office, following the recommendation made by MINAE and in adherence to the provisions of the Water Law No. 276 of August 27, 1942, and its amendments.
3. 3That following an administrative procedure and through Resolution No. 0142-2004-ALG, at fourteen thirty-five on January twenty-six, two thousand three, the Directorate of Legal Counsel of this Ministry notified the parties of the report rendered by the expert appraisers from the Valuation Department of the Ministry of Finance, Engineer Lorena López Alfaro, regarding the amount of compensation corresponding to the owner of the servient tenement (fundo sirviente), which amounts to the sum of ¢409,177.10 (four hundred nine thousand one hundred seventy-seven colones and ten céntimos).
4. 4That in accordance with the studies conducted by this Ministry and the concession for water use (aprovechamiento de aguas) granted through Resolution No. R-153-AGUAS-MINAE-2000, at twelve o'clock on April sixth, two thousand, Articles 99 and following of the Water Law No. 276 of August 27, 1942, and its amendments, and Article No. 383 of the Civil Code, it is appropriate to decree the constitution of the corresponding aqueduct easement (servidumbre de acueducto).

THEY DECREE:

Considering:

1. 1Que mediante la Resolución Nº R-153-AGUAS-MINAE-2000, de las doce horas del seis de abril del año dos mil, el Departamento de Aguas del Ministerio del Ambiente y Energía, otorgó a partir de esa fecha al Señor Carlos Manuel Pérez Ramírez, cédula de identidad Nº 4-114-744, concesión de aprovechamiento de aguas por un plazo de diez años, para uso doméstico, abrevadero y porqueriza, durante todo el año, las veinticuatro horas del día, en cantidad de 0,40 litros por segundo, efectuando la captación de una naciente ubicada en la finca del partido de Guanacaste, matrícula número 016126-000, con los linderos y cabida que indica el registro la cual es propiedad del señor Iok Io Chan Wong conocido como: Andrés Sánchez Wong, cédula de identidad Nº 8-044-515, y conduciéndola por tubería subterránea hasta el sitio de aprovechamiento.
2. 2Que el día 22 de abril del 2003, el señor Carlos Manuel Pérez Ramírez, cédula de identidad Nº 4-114-744, en su calidad de propietario del fundo servido, la cual le pertenece al partido de Guanacaste, Folio Real Nº 095866-001 y 002, presentó solicitud de imposición de servidumbre de acueducto ante este Despacho, siguiendo recomendación hecha por MINAE y en apego a lo establecido en la Ley de Aguas Nº 276 del 27 de agosto de 1942 y sus reformas.
3. 3Que previo procedimiento administrativo y mediante Resolución Nº 0142-2004-ALG, de las catorce horas, treinta y cinco minutos del veintiséis de enero del dos mil tres, la Dirección de Asesoría Jurídica de este Ministerio, pone en conocimiento de las partes el informe rendido por los peritos valuadores del Departamento de Valoraciones del Ministerio de Hacienda, la Ingeniera Lorena López Alfaro, sobre el monto de indemnización correspondiente al propietario del fundo sirviente, el cual asciende a la suma de ¢409.177,10 (cuatrocientos nueve mil ciento setenta y siete colones con diez céntimos).
4. 4Que de conformidad con los estudios realizados por este Ministerio y la concesión de aprovechamiento de aguas otorgada mediante Resolución Nº R-153-AGUAS-MINAE-2000, de las doce horas del seis de abril del año dos mil, los Artículos 99 y siguientes de la Ley de Aguas Nº 276 del 27 de agosto de 1942 y sus reformas y el Artículo N° 383 del Código Civil, procede decretar la constitución de la correspondiente servidumbre de acueducto.
