Full Text of Record: 7BE65 INSTITUTO COSTARRICENSE DE ACUEDUCTOS INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS No. 2005-019 ATTENTION: Executive Presidency, General Management, Deputy General Management, Internal Audit, Rectoría, Legal Directorate, Supply Directorate, Regional Directorates and Cantonal Heads.
SUBJECT: Modification of subsection 23) of Article No. 4 of the Regulation of the Board of Directors, Executive Presidency, General Management and Deputy General Management of AyA, Agreement No. 2004-315.
This Board of Directors hears the motion presented by Director, Licenciado Juan José Delgado Zúñiga, to modify subsection 23), of Article No. 4, of the Regulation of the Board of Directors, Executive Presidency, General Management and Deputy General Management of AyA.
Sole.-That by Agreement No. 2004-315, this Board of Directors approved the "Regulation of the Board of Directors, Executive Presidency, General Management and Deputy General Management of AyA", published in La Gaceta No. 111 of June 8, 2004, in which numeral 4, subsection 23), establishes:
"Article 4-The powers and attributions of the Board of Directors are:

Sole.-That the Constitutive Law of the Instituto Costarricense de Acueductos y Alcantarillados, No. 2726, and its amendments, in its Article No. 11, subsection i), confers upon this Board of Directors the power to "issue, reform and interpret the internal regulations necessary for the better development of the purposes of the Institute." Therefore:
In accordance with the considerations of fact and law above, and in the exercise of the powers conferred by the Constitutive Law of the Instituto Costarricense de Acueductos y Alcantarillados, No. 2726, and its amendments, in its Article No. 11, subsection i), this Board of Directors agrees:
I.-Modify subsection 23), of Article No. 4, of the Regulation of the Board of Directors, Executive Presidency, General Management and Deputy General Management of AyA, Agreement No. 2004-315, published in La Gaceta No. 111 of June 8, 2004, so that it shall read as follows in the future:

ASUNTO: Modificación del inciso 23) del Artículo N° 4 del Reglamento de la Junta Directiva, Presidencia Ejecutiva, Gerencia y Subgerencia de AyA, acuerdo Nº 2004-315.
Conoce esta Junta Directiva la moción presentada por el señor Director, Licenciado Juan José Delgado Zúñiga, para que se modifique el inciso 23), del Artículo N° 4, del Reglamento de la Junta Directiva, Presidencia Ejecutiva, Gerencia y Subgerencia de AyA.
Único.-Que con Acuerdo N° 2004-315, esta Junta Directiva aprobó el "Reglamento de la Junta Directiva, Presidencia Ejecutiva, Gerencia y Subgerencia de AyA", publicado en La Gaceta Nº 111 del 8 de junio del 2004, en cuyo numeral 4, inciso 23), se establece:
"Artículo 4-Son facultades y atribuciones de la Junta Directiva:

Único.-Que la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, Nº 2726, y sus reformas, en su Artículo N° 11, inciso i), confiere a esta Junta Directiva la potestad de "dictar, reformar e interpretar los reglamentos internos necesarios para el mejor desarrollo de los fines del Instituto". Por tanto:
De conformidad con las consideraciones de hecho y de derecho que anteceden, y en el ejercicio de las atribuciones conferidas por la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, Nº 2726, y sus reformas, en su Artículo N° 11, inciso i), esta Junta Directiva acuerda:
I.-Modifíquese el inciso 23), del Artículo N° 4, del Reglamento de la Junta Directiva, Presidencia Ejecutiva, Gerencia y Subgerencia de AyA, Acuerdo Nº 2004-315, publicado en La Gaceta Nº 111 del 8 de junio del 2004, para que en lo futuro rece lo siguiente:
"Artículo 4-Son facultades y atribuciones de la Junta Directiva:

En todo lo demás se mantiene firme y valedero el citado artículo.
II.-Rige a partir de su publicación. Publíquese en el Diario Oficial La Gaceta. Comuníquese. Acuerdo firme.
