COMPLEMENTARY AGREEMENT ON COOPERATION AND TECHNICAL ASSISTANCE BETWEEN THE GOVERNMENT OF THE REPUBLIC OF COSTA RICA AND THE GOVERNMENT OF THE REPUBLIC OF ECUADOR IN THE AREA OF THE ENVIRONMENT The Governments of the Republic of Costa Rica and the Republic of Ecuador, hereinafter the Parties, animated by the desire to strengthen horizontal cooperation relations in accordance with the provisions of the Basic Agreement on Technical Cooperation, signed on March 8, 1979, in force between the Parties.

Considering that the Ministries of Environment and Energy of Costa Rica and Environment of Ecuador are the national authorities responsible for defining and regulating environmental policies and for coordinating plans, projects, and programs aimed at achieving a healthy environment, through participatory, equitable, and supportive management. Among their functions are the design of sustainable strategies for conservation, the promotion of development, community participation, with a gender perspective, and the incorporation of the environmental dimension into public management and citizen values.

Bearing in mind that both Ministries have promoted a set of plans, programs, and projects that have developed content, methodologies, and assistance, and cooperation actions.

Taking into account that both Ministries have identified topics of priority interest for mutual cooperation and technical assistance: a) Conservation and sustainable use of Biodiversity; b) Management and administration of National Parks and other protected areas; c) Environmental Services; d) Ecotourism; e) Community participation.

THEY AGREE AS FOLLOWS:

Object and scope of the Agreement The purpose of this Agreement is to formalize the commitment expressed by the Parties to promote cooperation and assistance activities that will be made concrete through the definition of specific Memoranda of Understanding (Cartas de Entendimiento) on each of the priority topics identified in the considering clauses.

Joint obligations of the parties The Parties, through this Agreement, commit to:

• a)Allocating the required economic resources or managing them jointly so that the concrete cooperation and assistance mechanisms can be implemented.
• b)Allocating the necessary human resources for the development of the activities that are specifically defined in the Memoranda of Understanding (Cartas de Entendimiento).
• c)Providing the necessary information required by the Parties and that serves as a technical basis for the planned activities.
• d)Promoting and disseminating the results of the cooperation and technical assistance processes.

Execution of the Agreement The topics defined as priorities in the Considering section will be implemented for their execution through the signing of Memoranda of Understanding (Cartas de Entendimiento). The Parties will assign the necessary personnel for the implementation and follow-up of the cooperation and technical assistance mechanisms. The main criterion that should guide their execution is the determination of agile procedures and concrete actions.

Use of information and institutional credits All documents and publications that may collect and disseminate the may be used by the Parties.

Validity of the Agreement This Agreement shall enter into force once the Parties have communicated to each other the fulfillment of the necessary legal requirements in accordance with the legal system of each Party, and shall have a duration of three (3) years, automatically renewable for the same period, unless one of the Parties notifies, through diplomatic channels, of its intention to terminate it at least three (3) months prior to its expiration date.

ACUERDO COMPLEMENTARIO DE COOPERACIÓN Y ASISTENCIA TÉCNICA ENTRE EL GOBIERNO DE LA REPÚBLICA DE COSTA RICA Y EL GOBIERNO DE LA REPÚBLICA DEL ECUADOR EN MATERIA DE MEDIO AMBIENTE Los Gobiernos de la República de Costa Rica y de la República del Ecuador, en adelante las Partes, animados por el deseo de fortalecer las relaciones de cooperación horizontal de conformidad con lo dispuesto en el Convenio Básico de Cooperación Técnica, suscrito el 8 de marzo de 1979, vigente entre las Partes.

Considerando que los Ministerios de Ambiente y Energía de Costa Rica y Ambiente del Ecuador son las autoridades nacionales encargadas de definir y regular las políticas ambientales y de coordinar planes, proyectos y programas orientados a lograr un ambiente sano, mediante una gestión participativa, equitativa y solidaria. Entre sus funciones se encuentran el diseño de las estrategias sustentables para la conservación, la promoción del desarrollo, la participación de la comunidad, con perspectiva de género, y la incorporación de la dimensión ambiental en la gestión pública y los valores ciudadanos.

Teniendo presente que los dos Ministerios han impulsado un conjunto de planes, programas y proyectos que han desarrollado contenidos, metodologías y técnica y acciones de cooperación.

Tomando en cuenta que los dos Ministerios han identificado temas de interés prioritario para la cooperación y asistencia técnica mutua: a) Conservación y uso sustentable de Biodiversidad; b) Gestión y manejo de Parques Nacionales y otras áreas protegidas; c) Servicios Ambientales; d) Ecoturismo; e) Participación comunitaria.

ACUERDAN LO SIGUIENTE:

Objeto y alcance del Acuerdo El presente Acuerdo tiene por objeto formalizar el compromiso expresado por las Partes para impulsar actividades de cooperación y asistencia que serán concretadas con la definición de Cartas de Entendimiento específicas sobre cada uno de los temas prioritarios identificados en los considerandos.

Obligaciones conjuntas de las partes Las Partes por el presente Acuerdo se comprometen a:

• a)Destinar los recursos económicos requeridos o a gestionarlos conjuntamente para que puedan implementarse los mecanismos concretos de cooperación y asistencia.
• b)Destinar los recursos humanos necesarios para el desarrollo de las actividades que específicamente se defina en las Cartas de Entendimiento.
• c)Proveer la información necesaria requerida por las Partes y que sirva de fundamento técnico para las actividades previstas.
• d)Promover y difundir los resultados de los proceso de cooperación y asistencia técnica.

Ejecución del Acuerdo Los temas definidos como prioritarios en el aparte de Considerandos serán implementadas para su ejecución mediante la suscripción de Cartas de Entendimiento. Las Partes asignarán el personal necesario para la instrumentación y seguimiento de los mecanismos de cooperación y asistencia técnica. El criterio principal que debe orientar su ejecución es la determinación de procedimientos ágiles y acciones concretas.

Uso de información y créditos institucionales Todos los documentos y publicaciones que puedan recoger y difundir las podrán ser usados por las Partes.

Vigencia del Acuerdo El presente Acuerdo entrará en vigor una vez que las Partes se hayan comunicado entre sí el cumplimiento de los requisitos jurídicos necesarios conforme al ordenamiento jurídico de cada Parte, y tendrá una duración de tres (3) años, prorrogables automáticamente por el mismo período, a menos que alguna de las Partes notifique, por la vía diplomática, de su intención de ponerle término al menos con tres (3) meses de antelación a su fecha de vencimiento.

HECHO en la Ciudad de San José, Costa Rica, a los seis días del mes de diciembre del año dos mil uno, en dos ejemplares originales, en idioma español, siendo los dos textos auténticos.
