in the entirety of the text - Full Text of Norm 31930 Creation of the National Directive Council of the Program for the Promotion of Sustainable Agricultural Production Full Text of act: 7814A No. 31930 No. 31930 THE PRESIDENT OF THE REPUBLIC THE MINISTER OF AGRICULTURE AND LIVESTOCK} In accordance with the powers granted to them by articles 140, subsections 3), 8), 18), and 20), and 146 of the Political Constitution, articles 25, 27.1, 28.2.b of Law No. 6227 of May 2, 1978, General Law of Public Administration, Law No. 7064 of April 29, 1987, Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, Law No. 8149 of November 5, 2001, Law of the National Institute of Innovation and Transfer in Agricultural Technology, and Law No. 8408 of March 31, 2004, Law Approving the Loan Contract No. 1436/OC-CR between the Republic of Costa Rica and the Inter-American Development Bank, for the Program for the Promotion of Sustainable Agricultural Production.

1That article 50 of the Political Constitution establishes that the State must seek the greatest well-being for all inhabitants of the country, organizing and stimulating production, ensuring an adequate distribution of wealth; it also stipulates that the State must guarantee and preserve the right of individuals to a healthy and ecologically balanced environment, respecting the right to the protection of human health that derives from the right to life; the primary objective of the use and protection of the environment being, therefore, to obtain a development and evolution favorable to human beings in harmony with it, in which environmental quality and economic means are fundamental parameters for the quality of life of individuals.
2That agricultural activity in Costa Rica is a deeply rooted activity in the social organization of the country and forms an integral part of the national economy.
3That in the rational use and exploitation of natural and energy resources, a balance between socioeconomic development and environmental protection must be guaranteed.
4That the Ministry of Agriculture and Livestock has as its main objective to promote the development of national agriculture by providing producers with integrated services, technologies for the protection of crops and herds against pests and diseases; seeking and promoting greater efficiency in the use of production factors.
5That the Ministry of Agriculture and Livestock has as its main function to create the appropriate conditions to develop technologies that increase the productivity and lower the production costs of national agriculture, and thereby raise the level of internal and external competitiveness of producers, the standard of living of producers, and preserve natural resources.
6That to achieve this objective, the institution generates, manages, and disseminates specialized information vital for decision-making by producers and the institution.
7That direct and daily contact with organized national producers, small and medium-sized, the most significant group of national producers and the foundation of the national democratic system, is achieved mainly through Agricultural Extension services.
8That Loan Agreement No. 1436/OCCR was approved between the Government of the Republic and the Inter-American Development Bank (IDB), through which the Program for "Promotion of Sustainable Agricultural Production" will be executed, published in La Gaceta No. 81 of April 27, 2004.
9That the Ministry of Agriculture and Livestock is responsible for the execution of said Promotion Program. Therefore:

THEY DECREE:

Considering:

- The National Directive Council is the highest-ranking decision-making body that has the responsibility of establishing the priorities and guidelines of the Program. It would act as a Council attached to the MAG, as a body of maximum deconcentration, which its Minister will preside over and will be composed of public and private entities, with their active participation and with direct influence on proposals to introduce changes in the execution of actions and the provision of technical services, to achieve the competitiveness of small and medium-sized producers and their organizations, in the development of their agricultural production activities at a national and international level.

- The responsibility of the CND shall be to establish the Program's priorities, review and adjust annual plans, approve its Operational Regulation and future changes with the approval of the Inter-American Development Bank (IDB), review annual financial statements, agree on the execution structure, and resolve any operational aspect that arises during the execution of the Program.

- The CND shall have the following functions and powers:

1. Establish the Program's priorities.

2. Approve the operational plans and semi-annual and annual reports of the Program.

3. Approve the Operational Regulation and possible future modifications and submit it for no-objection to the IDB.

4. Ensure that the criteria for evaluating, prioritizing, and selecting projects submitted by producer organizations are met by the bodies for technical analysis and approval.

5. Approve the minimum requirements, formal and content-related, that must include project profile proposals.

6. Issue the corresponding guidelines to the Mixed Regional Committees, through the analysis and approval of the Operational Regulation of the Mixed Regional Committees (CRM).

7. Approve the composition of the bodies for technical analysis and approval of projects.

8. Act as the higher body to resolve conflicts that may arise at the regional level in the selection and execution of projects.

9. Select through the established procedures and appoint the Program Director, upon prior request for no-objection from the IDB.

10. Approve the assessment scales and scores, as well as the procedures for the approval of project proposals under the terms and conditions established in Law No. 8408.

11. Ratify the personnel designated as counterpart of the MAG, which shall be selected from the Ministry's payroll, without incurring additional hiring, in accordance with what is stipulated in Law No. 8408, Annex A, Title VII, clause 7.01, subparagraph (v).

12. Any others in accordance with its objectives and nature.

8408 Annex A, Title VII, clause 7.02, of seven members:

1. The Minister of MAG or the Vice Minister, who shall preside over it.

2. The Director of SEPSA, who shall act as its Technical Secretariat.

3. The Director of the DNEA, in its capacity as Director and facilitator of agricultural extension.

4. A representative of the National Coordination of Work with Peasant Women (Coordinadora Nacional de Trabajo con la Mujer Campesina, CNTMC).

5. A representative of the National Chamber of Agriculture and Agroindustry (Cámara Nacional de Agricultura y Agroindustria, CNAA).

6. A representative of the National Confederation of Cantonal Agricultural Centers (Confederación Nacional de Centros Agrícolas Cantonales, CNCAC).

7. A representative of Agricultural Cooperatives appointed by the National Institute of Cooperative Development (Instituto Nacional de Fomento Cooperativo, INFOCOOP).

All members who do not come from the Public Sector shall be elected for a period of two years. Each one of the mentioned institutions shall designate its representatives directly.

All members of the Council must have a duly accredited alternate, who shall be designated by the respective organization, in the same act of designation of the principal representative. In the case of the Minister, his alternate shall be the Vice Minister. The Program Director must also attend the Council sessions, but shall only have the right to speak. The Council must be convened by its President. The Council shall require a quorum of four members to meet and make decisions. Its agreements shall be adopted by a simple majority of votes present.

None of the members of the National Directive Council shall receive per diems, nor any other type of payment or emolument.

1Que el artículo 50 de la Constitución Política, establece que el Estado debe procurar el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción, velando por un adecuado reparto de la riqueza; además estipula que el Estado debe garantizar y preservar el derecho de las personas a un ambiente sano y ecológicamente equilibrado, en respeto del derecho a la protección de la salud humana que se deriva del derecho a la vida; siendo entonces que el objetivo primordial del uso y protección del ambiente es obtener un desarrollo y evolución favorable al ser humano en armonía con éste, en el que la calidad ambiental y los medios económicos resultan ser uno de los parámetros fundamentales para la calidad de vida de las personas.
2Que la actividad agropecuaria en Costa Rica es una actividad profundamente arraigada en la organización social del país y que forma parte integral de la economía nacional.
3Que en el uso y aprovechamiento racional de los recursos naturales y energéticos debe garantizarse un balance entre el desarrollo socioeconómico y la protección del ambiente.
4Que el Ministerio de Agricultura y Ganadería tiene como objetivo principal promover el desarrollo de la agricultura nacional brindando al productor servicios integrados, tecnologías para la protección de cultivos y de los hatos contra las plagas y enfermedades; buscando y promoviendo mayor eficiencia en el uso de los factores de producción.
5Que el Ministerio de Agricultura y Ganadería tiene como principal función, crear las condiciones adecuadas para desarrollar tecnologías que aumenten la productividad y bajen los costos de producción de la agricultura nacional, y con ello elevar el nivel de competitividad interna y externa de los productores, el nivel de vida de los productores y preservar los recursos naturales.
6Que para lograr este objetivo, la institución genera, gerencia y difunde información especializada vital para la toma de decisiones de los productores y la institución.
7Que el contacto directo y cotidiano con los productores nacionales organizados, pequeños y medianos, el grupo más significativo de los productores nacionales y la base del sistema democrático nacional, se logra principalmente a través de los servicios de Extensión Agropecuaria.
8Que fue aprobado el Convenio de Préstamo Nº 1436/OCCR entre el Gobierno de la República y el Banco Interamericano de Desarrollo (BID) mediante el cual se ejecutará el Programa de "Fomento de la Producción Agropecuaria Sostenible", publicado en La Gaceta Nº 81 del 27 de abril del 2004.
9Que corresponde al Ministerio de Agricultura y Ganadería la ejecución de dicho Programa de Fomento. Por tanto:

Considerando:

DECRETAN:

- El Consejo Nacional Directivo es el órgano decisorio de mayor jerarquía que tiene la responsabilidad de establecer las prioridades y orientaciones del Programa. Actuaría como un Consejo adscrito al MAG, como órgano de desconcentración máxima, cuyo Ministro lo presidirá y estará conformado por entidades públicas y privadas, contando con su activa participación y con incidencia directa en las propuestas para introducir cambios en la ejecución de acciones y el suministro de servicios técnicos, para lograr la competitividad de pequeños y medianos productores y de sus organizaciones, en el desarrollo de sus actividades agroproductivas a nivel nacional e internacional.

- La responsabilidad del CND, será la de establecer las prioridades del Programa, revisar y ajustar los planes anuales, aprobar su Reglamento Operativo y cambios futuros con el visto bueno del Banco Interamericano de Desarrollo (BID), revisar los estados financieros anuales, concordar sobre la estructura de ejecución y resolver cualquier aspecto operativo que surja durante la ejecución del Programa.

- El CND tendrá las siguientes funciones y atribuciones:

1. Establecer las prioridades del Programa.

2. Aprobar los planes operativos e informes semestrales y anuales del Programa.

3. Aprobar el Reglamento Operativo y posibles modificaciones futuras y presentarlo para no-objeción al BID.

4. Asegurar que los criterios para evaluar, priorizar y seleccionar los proyectos presentados por las organizaciones de productores sean cumplidos por los órganos de análisis y aprobación técnica.

5. Aprobar los requisitos mínimos, formales y de contenido, que deben incluir las propuestas de perfiles de proyectos.

6. Emitir las directrices correspondientes a los Comités Regionales Mixtos, mediante el análisis y aprobación del Reglamento Operativo de los Comités Regionales Mixtos (CRM).

7. Aprobar la conformación de los órganos de análisis y aprobación técnica de los proyectos.

8. Actuar como instancia superior para resolver conflictos que se puedan generar en el ámbito regional en la selección y ejecución de proyectos.

9. Seleccionar mediante los procedimientos establecidos y nombrar al Director del Programa, previa solicitud de noobjeción del BID.

10. Aprobar las escalas de valoración y puntajes, así como los procedimientos para la aprobación de las propuestas de proyectos bajo los términos y condiciones establecidos en la Ley Nº 8408.

11. Ratificar el personal designado como contraparte del MAG, el cual se seleccionará de la planilla del Ministerio, sin incurrir en contrataciones adicionales, de conformidad con lo estipulado en la Ley Nº 8408, Anexo A, Título VII, cláusula 7.01, acápite (v).

12. Cualesquiera otras acorde con sus objetivos y naturaleza.

1. El Ministro del MAG o el Viceministro, quien lo presidirá.

2. El Director de SEPSA, que actuará como su Secretaría Técnica.

3. El Director de la DNEA, en su calidad de ente Director y facilitador de la extensión agropecuaria.

4. Una representante de la Coordinadora Nacional de Trabajo con la Mujer Campesina (CNTMC).

5. Un representante de la Cámara Nacional de Agricultura y Agroindustria. (CNAA).

6. Un representante de la Confederación Nacional de Centros Agrícolas Cantonales (CNCAC).

7. Un representante de las Cooperativas Agropecuarias nombrado por el Instituto Nacional de Fomento Cooperativo (INFOCOOP).

Todos los miembros que no provengan del Sector Público serán electos por un período de dos años. Cada una de las instituciones mencionadas designará a sus representantes en forma directa.

Todos los miembros del Consejo deberán contar con un suplente debidamente acreditado, el cual será designado por la respectiva organización, en el mismo acto de designación del representante propietario. En el caso del Ministro su suplente será el Viceministro. Deberá también asistir a las sesiones del Consejo, el Director del Programa, quien sólo tendrá derecho a voz. El Consejo, deberá ser convocado por su Presidente. El Consejo requerirá de un quórum de cuatro miembros para sesionar y tomar decisiones. Sus acuerdos se adoptarán por mayoría simple de votos presentes.

Ninguno de los miembros del Consejo Nacional Directivo devengará dietas, ni ningún otro tipo de pago o emolumento.

Artículo 6 — It shall be effective as of its publication.
