Sole.-That it is necessary to establish the rules to be used in the negotiation process to set the reduction goal for the pollution load discharged into water bodies, which will allow the desired level of water quality to be achieved in each control zone, so that the process is efficient, transparent and representative and allows the necessary agreements to be reached for the implementation of the environmental discharge levy (canon ambiental por vertidos). Therefore, THE MINISTER OF ENVIRONMENT AND ENERGY RESOLVES:
TO ISSUE THE PROCEDURE FOR THE ACCREDITATION OF REPRESENTATIVES AND CONDUCT OF THE NEGOTIATION TABLES FOR THE SETTING OF REDUCTION GOALS FOR THE POLLUTION LOAD THAT WILL BE ALLOWED TO BE DISCHARGED IN EACH CONTROL ZONE 1.-Convocation and conduct of the negotiation tables (mesas de negociación): The Ministry of Environment and Energy (MINAE) will convene the negotiation tables by publication in the Official Gazette La Gaceta and another national media outlet.
2.-MINAE, through the Directorate of Environmental Quality Management (DIGECA), will bring to each negotiation table a proposed reduction goal for the specific control zone, which it will make known to the representatives of each sector to begin the negotiation.
3.-The representatives of each sector to the negotiation tables must be elected in an assembly, as indicated in subsection b) of article 32 of Executive Decree 31176-MINAE.
4.-The sectors in each control zone will be composed as follows:
5.-To participate in the negotiation tables, each representative must prove their accreditation with a copy of the notarial act (acta notarial) drawn up on the day of the Prior Assembly of Representatives by sector.
6.-Each representative must request the Directorate of Environmental Quality Management (DIGECA) to accredit them as such, by submitting a copy of the respective act (acta), at least three days before the corresponding negotiation table is held.
7.-The Directorate of Environmental Quality Management, which will chair the negotiation tables, will begin the negotiation in each control zone with the proposed reduction goal. The quorum to meet will be half plus one of the representatives, and if this is not reached, it may validly meet half an hour after the first convocation with those present. Agreements will be reached by consensus; however, the taking of sectoral agreements will be permitted if so decided by a negotiation table.
8.-Each of the representatives indicated in point 4 will have the right to speak and vote. They may also be accompanied by one or more advisors, who will not have the right to speak or vote.
9.-In the event that no agreement is reached at the first convocation, the time, place and date will be designated on that same day to continue the negotiations. This designation itself will serve as the convocation, without the need to publish again.
10.-In cases where there are no representatives to a negotiation table or no agreement is reached within three months from the first convocation, MINAE, through DIGECA, will officially set the reduction goals for the respective control zone. 11.-The agreement or agreements resulting from a negotiation table convened by MINAE will be recorded in an act (acta) drawn up by DIGECA, which must be signed by all the accredited representatives who were present at the corresponding negotiation table.

Único.-Que es necesario establecer las reglas que se utilizarán en el proceso de negociación, para fijar la meta de reducción de la carga contaminante vertida a los cuerpos de agua, que permitirá alcanzar el nivel buscado de calidad hídrica en cada zona de control, con el fin de que el proceso sea eficiente, transparente y representativo y permita llegar a los acuerdos necesarios para la implementación del canon ambiental por vertidos. Por tanto, EL MINISTRO DE AMBIENTE Y ENERGÍA, RESUELVE:
DICTAR EL PROCEDIMIENTO PARA LA ACREDITACIÓN DE REPRESENTANTES Y REALIZACIÓN DE LAS MESAS DE NEGOCIACIÓN PARA LA FIJACIÓN DE METAS DE REDUCCIÓN DE LA CARGA CONTAMINANTE QUE SE PERMITIRÁ VERTER EN CADA ZONA DE CONTROL 1.-Convocatoria y realización de las mesas de negociación: El Ministerio de Ambiente y Energía (MINAE), convocará a las mesas de negociación mediante publicación en el Diario Oficial La Gaceta y otro medio de comunicación nacional.
2.-El MINAE, a través de la Dirección de Gestión de Calidad Ambiental (DIGECA), llevará a cada mesa de negociación, una propuesta de meta de reducción, para la zona de control específica, la cual pondrá en conocimiento de los representantes de cada sector para iniciar la negociación.
3.-Los representantes de cada sector a las mesas de negociación deberán estar electos en una asamblea, según lo indicado en el inciso b), del artículo 32 del Decreto Ejecutivo 31176-MINAE.
4.-Los sectores estarán integrados en cada zona de control de la siguiente forma:

7.-La Dirección de Gestión de Calidad Ambiental, quien presidirá las mesas de negociación, iniciará la negociación en cada zona de control, con la propuesta de meta de reducción. El quórum para sesionar será de la mitad más uno de los representantes y si no se completara podrá sesionar válidamente media hora después de la primera convocatoria con los presentes. Los acuerdos se tomarán por consenso, sin embargo se permitirá tomar acuerdos sectoriales si así lo decide alguna mesa de negociación.
8.-Cada uno de los representantes indicados en el punto 4 tendrá derecho a voz y voto. Podrán además hacerse acompañar por uno o más asesores, quienes no tendrán derecho a voz ni voto.
9.-En caso de no llegarse a un acuerdo en la primera convocatoria, se designará ese mismo día hora, lugar y fecha para continuar las negociaciones. El acuerdo mismo se tendrá como convocatoria, sin necesidad de publicar nuevamente.
10.-En los casos que no hubiere representantes a una mesa de negociación o no se llegare a ningún acuerdo en tres meses contados a partir de la primera convocatoria, el MINAE, a través de la DIGECA, fijará de oficio las metas de reducción de la zona de control respectiva.
11.-El acuerdo o acuerdos que resulten de una mesa de negociación convocada por MINAE, se consignará en un acta levantada por la DIGECA y que debe ser firmada por todos los representantes acreditados que estuvieron presentes en la mesa de negociación correspondiente.
