INSTITUTO COSTARRICENSE DE PESCA Y ACUACULTURA INCOOPESCA INCOOPESCA AJDIP/362-2004.—Puntarenas, on the fifth day of the month of August of the year two thousand four.
1.—That by official communication SDGT-135-2004, Mr. Marvin Mora, Technical Director, issues an opinion regarding a request made so that the use of the bolinchero purse seine (chinchorro bolinchero) to catch bait is permitted during the closed season (veda).
2.—That the Technical Directorate recommends authorizing the use of the bolinchero purse seine (chinchorro bolinchero) and, at the same time, suggests modifying agreement AJDIP/252-2004, with the objective of regulating the length of the beach seine (chinchorro playero) for sweeping bait. Therefore:
IT IS AGREED:
1.—To accept the opinion issued by the Technical Directorate through official communication SDGT-135-2004, and to modify articles 3, 4, and 5 of agreement AJDIP/252-2004, so that henceforth they read as follows:
"Article 3.—During the period from June 1 to July 31, 2004, and from October 16 to November 15, 2004, only the horizontal longline (Línea Planera) with three hundred (300) number 6 (N° 6) hooks, the handline (cuerda de mano), and the sweeping beach seine (chinchorro playero de barrer) for extracting bait, which shall not have a bag and whose length shall not be greater than 8 meters, may be used in small-scale artisanal fishing. The use of the trammel net (trasmallo) of any mesh size (luz de malla) is prohibited. This regulation applies in the area comprised between an imaginary straight line running from Punta Torres (84° 43' 52" W, 9° 53' 31" N) to Punta Cuchillos (84° 51' 50" W, 9° 49' 36" N) and from there offshore to the western end of said Gulf on the Nicoya Peninsula (mouth of the Tempisque River).

SE ACUERDA:
1º-Acoger criterio vertido por la Dirección Técnica Mediante oficio SDGT-135-2004, y modificar los artículos 3º, 4º y 5º, del acuerdo AJDIP/252-2004, para que en lo sucesivo se lea de la siguiente manera:
"Artículo 3º-Durante el período comprendido entre el 1°de junio al 31 de julio del 2004 y del 16 de octubre y el 15 de noviembre de 2004, únicamente se puede utilizar en la pesca artesanal en pequeña escala la Línea Planera de trescientos (300) anzuelos número 6 (N° 6), la cuerda de mano, el chinchorro playero de barrer para extraer carnada, el cual no deberá contar con bolsa y su longitud no será mayor de 8 metros. Se prohíbe la utilización del trasmallo de cualquier luz de malla. Esta regulación se aplica en el área comprendida entre una línea recta imaginaria que va desde Punta Torres (84° 43" 52' W, 9° 53" 31' N) hasta Punta Cuchillos (84'51'50"W, 9°49'36"N) y de ahí aguas adentro hasta el extremo occidental de dicho Golfo en la Península de Nicoya (Desembocadura del Río Tempisque).
