1. 1That through agreement No. 2004-94-108, adopted in the extraordinary session No. 94-025 held on April 12, 1994, the Board of Directors approved the Autonomous Service Regulation of the Costa Rican Institute of Aqueducts and Sewers, published in La Gaceta No. 127 of July 5, 1994, which since that time has been the subject of a series of observations and objections from Senior Management, Area Directorates, Regional Headquarters, Union Organizations, as well as external entities.

2º—For the purpose of updating the current Regulation through a comprehensive reform, the Human Resources Directorate and the Legal Directorate of AyA in coordination with Senior Management have proposed a new project called "Autonomous Work Regulation", which incorporates a series of institutional and legal aspects that seek to make it an ideal mechanism that clearly and objectively regulates the rights and duties inherent to the employment relationship with the Institute.

3º—The Institute, in its actions, is not exempt from the changes imposed by society, and with them, the legal and administrative changes that directly intervene in the labor field, which must be incorporated into the internal regulations.

1. 4That the proposed text was made known to the Union Groups, Area Directorates, Regional Headquarters, Internal Audit, among other departments, whose contributions and observations have been incorporated into the project of the Regulation, in order to harmonize the different positions in accordance with the provisions of the legal system.

I.—The Political Constitution in its articles 56 and following establishes the guarantees and principles governing workers' rights. Consequently, the internal regulation issued by the Institution in compliance with the principles enshrined in the Magna Carta is of paramount importance.

II.—The Costa Rican Institute of Aqueducts and Sewers, as an integral part of its functions, must promote and comply with fundamental labor standards, principles, and rights. Given the evolutionary process that societies undergo, as well as the different legal bodies that govern them, it is deemed necessary and advisable to carry out the comprehensive update of the norms that make up the current Autonomous Work Regulation, so that it can become an ideal mechanism to ensure adaptation to any change in the social need it satisfies and thus fulfill its function, in accordance with the legal-social reality that integrates it.

III.—That the Constitutive Law of AyA grants in its article 11.i the power to the Board of Directors to reform the internal regulations necessary for the better development of the Institute's purposes; one of them being to clearly regulate the rules that will govern all the Institution's workers.

IV.—That having consulted the Technical Secretariat of the Budgetary Authority, its recommendations, issued in Official Letter No. STAP-835-04 dated June 2, 2004, are incorporated, for the purposes of the Law of Financial Administration and Public Budgets.

1. 1Que mediante acuerdo N° 2004-94-108, adoptado en la sesión extraordinaria N° 94-025 celebrada el 12 de abril de 1994, la Junta Directiva aprobó el Reglamento Autónomo de Servicio del Instituto Costarricense de Acueductos y Alcantarillados, publicado en La Gaceta N° 127 del 5 de julio de 1994, el cual desde ese momento ha sido objeto de una serie de observaciones y objeciones por parte de la Administración Superior, Direcciones de Áreas, Jefaturas Regionales, Organizaciones Sindicales, así como entes externos.

2º—A efectos de actualizar el Reglamento vigente mediante una reforma integral, la Dirección de Recursos Humanos y la Dirección Jurídica de AyA en coordinación con la Administración Superior han propuesto un nuevo proyecto denominado "Reglamento Autónomo de Trabajo", en el cual se incorporan una serie de aspectos de orden institucional y legal que buscan convertirlo en un mecanismo idóneo que regule de forma clara y objetiva los derechos y deberes propios de la relación de empleo con el Instituto.

3º—El Instituto dentro de su actuar no se encuentra exento de los cambios que impone la sociedad, y con ello de los cambios de orden legal y administrativo que intervienen de forma directa en el campo laboral, los que deben ser incorporados dentro de la normativa interna.

1. 4Que el texto propuesto se hizo del conocimiento de las Agrupaciones Sindicales, Direcciones de Área, Jefaturas Regionales, Auditoría Interna, entre otros departamentos, cuyos aportes y observaciones han sido incorporados al proyecto del Reglamento, a fin de armonizar las distintas posiciones de acuerdo a lo establecido en el ordenamiento jurídico.

I.—La Constitución Política en sus artículos 56 y siguientes establece las garantías y principios que rigen los derechos de los trabajadores. Consecuentemente con lo anterior, deviene de primordial importancia la regulación interna que dicte la Institución en cumplimiento de los principios consagrados en la Carta Magna.

II.—El Instituto Costarricense de Acueductos y Alcantarillados, como parte integral de sus funciones, debe promover y cumplir las normas, principios y derechos laborales fundamentales. Dado el proceso evolutivo por el que atraviesan las sociedades, así como los distintos cuerpos legales que las rigen, se estima necesario y conveniente realizar la actualización integral de las normas que conforman el actual Reglamento Autónomo de Trabajo, a fin de que pueda convertirse en un mecanismo idóneo para asegurar la adaptación a todo cambio en la necesidad social que satisface y de esa forma cumplir su función, acorde con la realidad jurídico-social que la integra.

III.—Que la Ley Constitutiva de AyA otorga en su artículo 11.i la potestad a la Junta Directiva, para reformar los reglamentos internos necesarios para el mejor desarrollo de los fines del Instituto; siendo uno de ellos el regular de forma clara las normas que regirán para todos los trabajadores de la Institución.

IV.—Que consultada la Secretaría Técnica de la Autoridad Presupuestaria, se incorporan sus recomendaciones, emitidas en Oficio N° STAP-835-04 de fecha 02 de junio del 2004, para los efectos de la Ley de la Administración Financiera y Presupuestos Públicos.
