124 of June 25, 2004, the Modification of the Annual Urban Growth Regulation Policy was published, approved in ordinary session No. 37-2004 of June 8, 2004, with no objections within the legal period and in order to guarantee the principles of legal certainty and publicity, in accordance with article IV of Law No. 8220, the following is approved for requesting authorization for a housing development in an urbanization, condominium, or residential complexes:
MINIMUM REQUIREMENTS FOR ASSESSING WATER AVAILABILITY FOR HOUSING DEVELOPMENTS OR STAGES THEREOF, TO BE COUNTED IN URBANIZATIONS, CONDOMINIUM BRANCHES, AND RESIDENTIAL COMPLEXES A. For a water availability request for housing developments whose total demand is less than or equal to 40 (forty) housing units in total, the Developer must submit a letter to the Public Services Area requesting the service, and must include the following documents:
- i)Cadastral plan of the property.
- ii)Land Use Certification.
- iii)Preliminary project in accordance with the location area, signed by a responsible professional.
- iv)Note from the property owner authorizing the development, or a preliminary contract between the parties for sale or partnership.
- v)Description of the preliminary project: Subdivision (Fraccionamiento), urbanization, or green condominium, Individualized Primary Branch Property (Finca Filial Primaria Individualizada, FFPI).
- vi)Water Connection Demand Plan (Plan de demanda de Pajas de Agua).
- vii)Proposed stormwater conveyance and attenuation system before being discharged into watercourses that cause downstream flooding. Said proposal must include the stormwater calculation and solutions for a rainfall intensity with a 10-year frequency and a study of the impact of the project's stormwater discharge on the existing external infrastructure.
- viii)Preliminary project execution schedule.
- ix)Proposal for wastewater treatment.
- x)Suitable document of the legal representative or of the company when it is a legal entity.
- xi)Complete and sign the water availability application.
B. For a water connection availability request for housing developments whose total demand exceeds more than 40 (forty) housing units to be counted in urbanizations, condominium branches, and residential complexes, the Developer must submit a letter to the Municipal Council requesting the service, and must include the following documents:
- i)Cadastral plan of the property.
- ii)Land Use Certification.
- iii)Preliminary project in accordance with the location area, signed by a responsible professional.
- iv)Note from the property owner authorizing the development or a preliminary contract between the parties for sale or partnership.
- v)Description of the preliminary project: subdivision (fraccionamiento), urbanization, or green condominium or Individualized Primary Branch Property (Finca Filial Primaria Individualizada, FFPI).
- vi)Water Connection Demand Plan (Plan de demanda de Pajas de Agua).
- vii)Water supply proposal for current and future users of the sector, planned for a minimum period of 10 years, after consulting the Canton Aqueduct Master Plan and the Public Services Area on the operating conditions of the municipal aqueduct system.
- viii)Proposal for wastewater treatment.
- ix)Proposed stormwater conveyance and attenuation systems before being discharged into watercourses that cause downstream flooding. Said proposal must include the stormwater calculation and its solutions for a rainfall intensity with a 10-year frequency and a study of the impact of the project's stormwater discharge on the existing external infrastructure.
- x)Proposal for actions regarding road widening and signage.
- xi)Proposal for project actions that ensure orderly and proportionate urban development and guarantee minimal urban environmental impact, reflecting the social responsibility of the proposed project.
- xii)Preliminary project execution schedule.
- xiii)Suitable document of the legal representative or of the company when it is a legal entity.
- xiv)Complete and sign the water availability application.
