Complete Text of act: 750D3 N° 31864-H N° 31864-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred upon them by Articles 140, subsections 3) and 18) and 146 of the Political Constitution; Articles 25, subsection 1), 27, subsection 1) and 28, subsection 2) paragraph b) of Law N° 6227, General Law of Public Administration of May 2, 1978; Law N° 8131, Law of the Financial Administration of the Republic and Public Budgets of September 18, 2001; Law N° 7575, Forestry Law of February 13, 1996; and Law N° 7554, Organic Law of the Environment of October 4, 1995.

1That the Organic Law of the Environment N° 7554, published in La Gaceta N° 215 of November 13, 1995, establishes that the Ministry of Environment and Energy (MINAE) is the governing body in environmental matters, and therefore must ensure the protection, conservation and use of natural resources as an indispensable condition for sustainable economic development.
2That the Forest Fund is part of the National System of Conservation Areas, through which the protection, conservation, control and promotion of these protected areas is carried out, due to their wealth of wildlife species and forest cover (bosque forestal).
3That the Forest Fund requires the incorporation of additional resources to implement strategic actions aimed at the effective fulfillment of its institutional mission.
4That by means of Decreto Ejecutivo N° 31092-H and its amendments, published in La Gaceta N° 63 of March 31, 2003, the Budgetary Authority formulated the General Budgetary Policy Guidelines for 2004, which were made known to the Government Council and approved by the President of the Republic, establishing the budget expenditure for 2004 for the entities covered by the scope of the aforementioned Collegiate Body.
5That by means of official communication STAP-CIRCULAR 610-03, of April 24, 2003, the expenditure limit set for the year 2004 was communicated to the Forest Fund.
6That due to the foregoing, it is necessary to modify the budget expenditure set for the Forest Fund in the cited Decree. Therefore,

Texto Completo acta: 750D3 N° 31864-H N° 31864-H EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE HACIENDA Con fundamento en las atribuciones que les confieren los artículos 140, incisos 3) y 18) y 146 de la Constitución Política; los artículos 25, inciso 1), 27, inciso 1) y 28, inciso 2) acápite b) de la Ley N° 6227, Ley General de la Administración Pública de 2 de mayo de 1978; Ley N° 8131, Ley de la Administración Financiera de la República y Presupuestos Públicos de 18 de setiembre de 2001; Ley N° 7575, Ley Forestal de 13 de febrero de 1996; y Ley N° 7554, Ley Orgánica del Ambiente de 4 de octubre de 1995.

1Que la Ley Orgánica del Ambiente N° 7554, publicada en La Gaceta N° 215 del 13 de noviembre de 1995, establece que el Ministerio del Ambiente y Energía (MINAE) es el ente rector en materia ambiental, por lo que debe velar por la protección, conservación y aprovechamiento de los recursos naturales como condición indispensable para el desarrollo económico sostenible.
2Que el Fondo Forestal forma parte del Sistema Nacional de Áreas de Conservación, mediante el cual se lleva a cabo la protección, conservación, control y fomento de estas áreas protegidas, debido a su riqueza en especies de vida silvestre y bosque forestal.
3Que el Fondo Forestal requiere incorporar recursos adicionales para implementar acciones estratégicas con miras al eficaz cumplimiento de su misión institucional.
4Que mediante el Decreto Ejecutivo N° 31092-H y sus reformas, publicado en La Gaceta N° 63 del 31 marzo del 2003, la Autoridad Presupuestaria formuló las Directrices Generales de Política Presupuestaria para el 2004, las cuales fueron conocidas por el Consejo de Gobierno y aprobadas por el Presidente de la República, estableciendo el gasto presupuestario para el 2004, para las entidades cubiertas por el ámbito del mencionado Órgano Colegiado.
5Que mediante oficio STAP-CIRCULAR 610-03, del 24 de abril de 2003, se comunicó al Fondo Forestal el límite de gasto fijado para el año 2004.
6Que por lo anterior, resulta necesario modificar el gasto presupuestario fijado para el Fondo Forestal en el Decreto citado. Por tanto,

Artículo 1 — The budget expenditure for the year 2004 for the Forest Fund, established in Article 1 of Decreto Ejecutivo N° 31092-H and its amendments, published in La Gaceta N° 63 of March 31, 2003, is hereby modified, setting the new limit at ₡212 million.

Artículo 2 — It shall be effective as of its publication.

Artículo 1 — Modifícase al Fondo Forestal el gasto presupuestario para el año 2004, establecido en el artículo 1° del Decreto Ejecutivo N° 31092-H y sus reformas, publicado en La Gaceta N° 63 del 31 marzo del 2003, fijando el nuevo límite en ¢212 millones.

Artículo 2 — Rige a partir de su publicación.
