2nd—That through Decreto Ejecutivo Nº 29547-MOPT, published in La Gaceta Nº 108 of June 6, 2001, the functions of the Directorate of Navigation and Safety were modified, and it was established that the aforementioned Directorate shall ensure the adequate planning, construction, operation, and maintenance of maritime signaling services and aids to navigation in national waters and coasts. 3rd—That for the purpose of preventing mishaps from occurring in the maritime zone adjacent to Puerto Limón that endanger the safety of navigation and human life, it is necessary to establish an order of priorities for vessels and ships that navigate or anchor near these waters, with the due collaboration of the Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica, (JAPDEVA). 4th—That for the purpose of improving the management of navigation in the sea area adjacent to Puerto Limón, it is important to officially establish an official anchorage zone (zona de fondeo), define a sea buoy, as well as indicate the location of a beacon (baliza) that marks the end of the new tourist pier in Puerto Limón. Therefore:

The following:

Regulation on the Definition of the Administrative Regime of the Sea Areas Near Puerto Limón

• a)Beacon (Baliza): Any instrument, apparatus, or body installed by the corresponding authority, which serves to indicate a danger or precise indications for navigation, mainly at the entrance of rivers, canals, and ports. The most commonly used beacons are buoys, anchored vessels, and perches driven into the bottom. b) Dolphin (Duque de Alba): Element designed for defense or mooring, formed by a cluster of piles sunk into the sea floor, the heads of which emerge from the water and are lashed together to form a block. c) IALA: Acronym for the International Association of Marine Aids to Navigation and Lighthouse Authorities. It is a non-governmental international organization whose objective is to bring together marine signaling services to ensure the improvement and harmonization of aids to navigation and maritime traffic management methods. d) Anchorage Zone Triangle (Triángulo de la zona de fondeo): Triangular-shaped area on the sea surface with sufficient depth for vessels to secure or fix themselves by means of anchors.

The limits of the triangular anchorage zone are the sides of the triangle, or perimeter, and its limits are defined in practice between each of the vertices of the triangle, marked by the placement of a lighted buoy (boya luminosa). e) Anchorage Zone (Zona de Fondeo): Maritime zone with sufficient depth for vessels to secure themselves or remain fixed on the surface of the sea by means of anchors. f) Provisional Quarantine Zone (Zona Provisional de Cuarentena). This is a maritime zone provisionally established for ships to anchor while in quarantine; it must be sufficiently distant from other sites to prevent the spread of any contagious disease. Its location is to be defined by the Dirección de Navegación y Seguridad of the Ministerio de Obras Públicas y Transportes in coordination with the Port Management of JAPDEVA, the Regional Directorate of the Ministerio de Salud, and the Regional Directorate of the Ministerio de Agricultura y Ganadería.

• 1)Vertex point NE: Latitude: 09°59'12" NORTH / Longitude: 83°00'24" WEST. 2) Vertex point South: Latitude: 09°58'27" NORTH / Longitude: 83°00' 40" WEST. 3) Vertex point Southwest: Latitude: 09°58'51" NORTH / Longitude: 83°01'29" WEST.

For the signaling of the anchorage area, lighted buoys shall be placed at the points described above; the characteristics of the buoys shall be indicated by the Ministerio de Obras Públicas y Transportes, in accordance with the international regulations governing this matter.

Latitude: 09°59'12" NORTH / Longitude: 83°00'24" WEST (same point Nº 1 above). At this point, a single buoy shall be placed that fulfills two functions: demarcating a vertex of the anchorage zone triangle and marking the location of the sea buoy. The function of this sea buoy is to indicate the location of Puerto Limón to national and international vessels. This buoy must be visible for at least three nautical miles and shall have a white light color. The color of the body of the buoy shall be white with black vertical stripes (according to international IALA standards).

Its position shall be: Latitude: 09°00' 22" North and Longitude: 83° 01' 22" West, with a red flashing light at intervals of 10 seconds.

No anchored vessels shall be permitted between the anchorage zone and the berthing positions of Puerto Limón.

Due publicity must be given to this event in the interest of protecting public health.

In the quarantine area, those ships that, for public health reasons, must remain isolated shall anchor until such time as the officials who decreed the isolation lift it, and the official visit or dispatch of the vessel can subsequently proceed.

Navigation and anchoring by any vessel in this zone is prohibited if it does not have the express authorization of the Capitanía de Puerto.

Single transitory provision: a period of six months is established from the publication of this decree for the Administration to proceed to place the equipment that allows for the signaling of the areas and maritime points established in this decree.

Given at the Presidency of the Republic.—San José, on the eighteenth day of March, two thousand four.

2º—Que mediante el Decreto Ejecutivo Nº 29547- MOPT publicado en La Gaceta Nº 108 del 6 de junio del 2001, se modificaron las funciones de la Dirección de Navegación y Seguridad y se estableció que la precitada Dirección velará por la adecuada planificación, construcción, operación y mantenimiento de los servicios de señalización marítima y ayudas a la navegación en aguas y costas nacionales. 3º—Que con el propósito de evitar que se produzcan percances en la zona marítima aledaña al Puerto de Limón que pongan en peligro la seguridad de la navegación y de la vida humana, se hace necesario establecer un orden de prioridades a los buques y barcos que naveguen o fondean cerca de estas aguas, con la debida colaboración de la Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica, (JAPDEVA). 4º—Que con el propósito de mejorar el ordenamiento de la navegación en el área de mar aledaña a Puerto Limón, es importante establecer oficialmente una zona de fondeo oficial, definir una boya de mar, así como señalar la ubicación de una baliza que indique el extremo del nuevo muelle turístico en Puerto Limón. Por Tanto:

El siguiente:

Reglamento sobre la Definición del Régimen Administrativo de las Áreas de Mar Cercanas a Puerto Limón

• a)Baliza: Todo instrumento, aparato o cuerpo instalado por la autoridad correspondiente, que sirve para señalar un peligro o indicaciones precisas para la navegación, principalmente a la entrada de ríos, canales y puertos. Las balizas más usadas son boyas, embarcaciones fondeadas y perchas clavadas en el fondo. b) Duque de Alba: Elemento proyectado para defensa o amarre, formado por un haz de pilotes hundidos en el fondo marino y cuyas cabezas salen fuera del agua y quedan amarradas entre sí formando un bloque. c) AISM: Siglas de la Asociación Internacional de Señalización Marítima. Es una organización internacional no gubernamental cuyo objetivo es reunir los servicios de señales marítimas, para velar por la mejora y la armonización de las ayudas a la navegación y de los métodos de gestión del tráfico marítimo. d) Triángulo de la zona de fondeo: Área de forma triangular en la superficie marítima de profundidad suficiente para que las embarcaciones puedan asegurar o fijarse por medio de anclas.

Los límites de la zona de fondeo triangular, son los lados del triángulo o perímetro y sus límites se definen en la práctica entre cada uno de los vértices del triángulo, señalados por la colocación de una boya luminosa. e) Zona de Fondeo: Zona marítima con suficiente profundidad para que las embarcaciones puedan asegurarse o mantenerse fijas en la superficie del mar por medio de anclas. f) Zona Provisional de Cuarentena. Es una zona marítima establecida provisionalmente para que los barcos fondeen mientras se encuentren en cuarentena, deberá estar suficientemente alejada de otros sitios para no permitir la propagación de alguna enfermedad contagiosa. Su ubicación corresponde definirla a la Dirección de Navegación y Seguridad del Ministerio de Obras Públicas y Transportes en coordinación con la Gerencia Portuaria de JAPDEVA, la Dirección Regional del Ministerio de Salud y la Dirección Regional del Ministerio de Agricultura y Ganadería.

• 1)Punto vértice NE: Latitud: 09°59’12"NORTE / Longitud: 83°00’24"OESTE. 2) Punto vértice Sur: Latitud: 09°58’27" NORTE / Longitud: 83°00’ 40" OESTE. 3) Punto vértice Suroeste: Latitud: 09°58’51"NORTE / Longitud: 83°01’29"OESTE.

Para la señalización del área de fondeo se ubicarán boyas luminosas en los puntos anteriormente descritos, las características de las boyas serán indicadas por el Ministerio de Obras Públicas y Transportes, conforme a la normativa internacional que rige esta materia.

Latitud: 09°59’12" NORTE / Longitud: 83°00’24" OESTE (mismo punto Nº 1 anterior). En este punto se colocará una sola boya que cumple dos funciones, demarcar un vértice del triángulo de la zona de fondeo y señalar la ubicación de la boya de mar. La función de esta boya de mar es señalar la ubicación de Puerto Limón a las embarcaciones nacionales e internacionales. Esta boya deberá ser visible como mínimo a tres millas náuticas, tendrá un color de luz blanca. El color del cuerpo de la boya será blanco con negro en rayas verticales (según normas internacionales de la AISM).

Su posición será: Latitud: 09°00’ 22" Norte y Longitud: 83° 01’ 22" Oeste, con una luz de destellos color rojo en intervalos de 10 segundos.

No se permitirán embarcaciones fondeadas entre la zona de fondeo y los puestos de atraque de Puerto Limón.

A este evento deberá dársele la debida publicidad en aras de proteger la salud pública.

En el área de cuarentena se fondearán aquellos barcos que por razones de salud pública deban permanecer aislados hasta tanto los funcionarios que decretaron el aislamiento no lo levanten y se pueda proceder posteriormente a la visita oficial o al despacho del buque.

Queda prohibida la navegación y fondeo de cualquier embarcación en esta zona si no cuenta con la autorización expresa de la Capitanía de Puerto.

Transitorio único: se establece un plazo de seis meses a partir de la publicación de este decreto para que la Administración proceda a colocar el equipo que permita señalar las áreas y puntos marítimos establecidos en este decreto.
