in the entirety of the text - Complete Text of Norm 31801 Declares State of Phytosanitary Emergency for the Central American Locust (Schistocerca Piceifrons, Walker) Complete Text record: E3EC5 Nº 31801-MAG Nº 31801-MAG (This decree was repealed by article 5 of executive decree N° 36827 of October 4, 2011) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers conferred upon them by articles 140, subsections 3), 8), 18) and 20) and 146 of the Political Constitution, articles 25, 27.1, 28.2b of Law Nº 6227 of May 2, 1978, General Law of Public Administration, Law Nº 7664 of April 8, 1997, Phytosanitary Protection Law, and the Agreement on Sanitary and Phytosanitary Measures of Law Nº 7473 of December 20, 1994, Law for the Implementation of the Agreements of the Uruguay Round of Multilateral Trade Negotiations.

1. 1That it is an essential function of the State to protect the health and life of people and animals, as well as to guarantee the protection of crops from pests and diseases that may put agricultural production at risk or cause damage.
2. 2That it is the responsibility of the Ministry of Agriculture and Livestock, through the State Phytosanitary Service, to ensure the phytosanitary protection of crops in our country, ordering, once the existence of a pest or disease is verified, the technical and control measures that prevent their spread.
3. 3That the State Phytosanitary Service has confirmed the presence of high populations of the insect known as the Central American Locust (Schistocerca piceifrons, Walker), in the cantons of Abangares, Bagaces, Carrillo, and Liberia.
4. 4That the Central American Locust constitutes a pest of great economic importance that affects basic crops (cultivos básicos), export crops, pastures, and forest species (especies forestales).
5. 5That the Executive Branch, upon prior recommendation of the State Phytosanitary Service, may declare a state of phytosanitary emergency (estado de emergencia fitosanitaria) when pests or diseases of importance exist that constitute or represent a threat to the national economy. Therefore:

1. 1Que es función esencial del Estado proteger la salud y la vida de las personas y animales, así como garantizar la protección de los cultivos de las plagas y enfermedades que puedan poner en riesgo o causar daños a la producción agrícola.
2. 2Que corresponde al Ministerio de Agricultura y Ganadería a través del Servicio Fitosanitario del Estado velar por la protección fitosanitaria de los cultivos en nuestro país, disponiendo, una vez comprobada la existencia de una plaga o enfermedad, las medidas técnicas y de control que eviten la propagación de estas.
3. 3Que el Servicio Fitosanitario del Estado ha confirmado la presencia de altas poblaciones del insecto conocido como Langosta Voladora (Schistocerca piceifrons, Walker), en los cantones de Abangares, Bagaces, Carrillo y Liberia.
4. 4Que la Langosta Voladora constituye una plaga de gran importancia económica que afecta cultivos básicos, de exportación, pastos y especies forestales.
5. 5Que el Poder Ejecutivo, previa recomendación del Servicio Fitosanitario del Estado, podrá decretar estado de emergencia fitosanitaria, cuando existan plagas o enfermedades de importancia, que constituyan o representen una amenaza para la economía nacional. Por tanto:
