throughout the entire text - Complete Text of Norm 31777 Declares matters relating to urban planning and development, as well as urban spatial planning of the country, to be of national priority and public interest Complete Text acta: 73ADC No. 31777-MIVAH-MIDEPLAN No. 31777-MIVAH-MIDEPLAN THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF HOUSING AND HUMAN SETTLEMENTS, AND THE MINISTER OF NATIONAL PLANNING AND ECONOMIC POLICY Using the powers conferred by subsections 3) and 18) of Article 140 of the Political Constitution, the General Public Administration Act, No. 6227 of May 2, 1978, the Urban Planning Act No. 4240 of November 15, 1968, and the National Planning Act No. 5525 of May 2, 1974.
I.-That urban development planning and its execution constitute a national priority that is fully recognized in the Monseñor Víctor Manuel Sanabria National Development Plan 2002-2004, whose fundamental purpose is to improve the quality of life of Costa Ricans.
II.-That, in accordance with Executive Decree No. 31062-MOPT-MIVAH-MINAE published in Alcance No. 22 of La Gaceta No. 81 of April 29, 2003, the Government of the Republic established the National Urban Planning Council (Consejo Nacional de Planificación Urbana), chaired by the Minister of Housing and Human Settlements, and composed, in addition to the aforementioned ministry, of the Ministries of National Planning and Economic Policy, of Public Works and Transport, of Environment and Energy, the National Institute of Housing and Urbanism, the Municipal Development and Advisory Institute, and the National Power and Light Company.
III.-That in accordance with the aforementioned Decree No. 31062-MOPT-MIVAH-MINAE, the Technical Secretariat of the National Urban Development Plan is created as the technical arm of the National Urban Planning Council (Consejo Nacional de Planificación Urbana) and an entity attached to the Urbanism Directorate of the National Institute of Housing and Urbanism, with the purpose -among others- of supporting and collaborating with the aforementioned Urbanism Directorate in the preparation of the Plan GAM.
IV.-That Act No. 8342, enacted on December 18, 2002, as the Act Approving the Framework Agreement relating to the execution of financial and technical assistance and economic cooperation in Costa Rica under the "ALA" regulation, establishes the framework relating to the execution of financial and technical assistance and economic cooperation in Costa Rica. Said framework aims to contribute to the achievement of objectives, the execution of financial and technical assistance, and economic cooperation from the European Community for the benefit of the Republic of Costa Rica.
V.-That by virtue of the aforementioned Act No. 8342, on December 12, 2003, the European Community and the Republic of Costa Rica signed the lower-ranking protocol called "Specific Financing Agreement between the European Community and the Republic of Costa Rica to technically and economically support the development of the project Regional and Urban Planning of the Greater Metropolitan Area -GAM- of the Central Valley of Costa Rica." VI.-The aforementioned Agreement regulates the execution of a project that will have a non-reimbursable allocation of 11 million euros and a national counterpart contribution of 7.5 million euros, the products of which are:
The Urban Plan at the GAM level, the metropolitan guidelines for Alajuela, Heredia, San José, and Cartago, as well as the updating and development of the 31 Regulatory Plans (Planes Reguladores) of the cantons that make up the GAM.
VII.-That within said Agreement, the Ministry of Housing and Human Settlements is established as the direct beneficiary, the Technical Secretariat of the National Urban Development Plan as the Costa Rican technical counterpart, and the members of the National Urban Planning Council (Consejo Nacional de Planificación Urbana) as members of the Advisory Committee.
VIII.-That the Government of the Republic has defined, through official communication No. DM-0179-2004 of March 8, 2004, sent to the Comptroller General of the Republic, the strategy for the National Urban Development Plan and the responsibility of the various entities involved in this Plan, including both the Plan GAM and the Technical Secretariat of the National Urban Development Plan.
IX.-That the Government of the Republic, through its ministries and decentralized institutions, promotes a series of projects linked to urban improvement. The following are cited as part of these projects: reorganization and sectorization of mass passenger transport and the TREM Project (Metropolitan Electric Train); road infrastructure projects; underground electrification and the new public lighting for San José; sanitary sewer systems and wastewater treatment plants; high-density housing projects in urban areas to be regenerated, including the areas comprised within the four central districts of the central canton of San José, and the levy for wastewater discharges into the river network.
X.-That the Comptroller General of the Republic has presented two reports: No. 94/99 of August 13, 1999, "Report of a study on urban planning and construction permits at the National Institute of Housing and Urbanism," and Report No. DFOE-SM-11/2003, "Evaluation of urban development management in Costa Rica" from 2003, in which it expresses its concern about the deficiencies in urban planning that the country presents, and demands the pertinent actions from the Government of the Republic and its institutions. XI.-That the Office of the Attorney General of the Republic, through document C-001-2004 of January 5, 2004, has pronounced on the legality of the creation of the National Urban Planning Council (Consejo Nacional de Planificación Urbana) and the Secretariat of the National Urban Development Plan as instruments of the Executive Branch within the powers conferred by the Urban Planning Act as well as by the administrative oversight powers it must exercise over the Decentralized Public Administration. XII.-That by virtue of the strength and opportunity represented by the existence of a series of economic resources, the Government of the Republic is making its best effort to coordinate said resources related to urban themes, with the purpose of achieving greater efficiency, cost reduction, and coordination among institutions in the generation of urban planning tools, which will make a better environment and development of our cities feasible.

I.-Que la planificación del desarrollo urbano y su ejecución constituyen una prioridad nacional que está plenamente reconocida en el Plan Nacional de Desarrollo Monseñor Víctor Manuel Sanabria 2002-2004, cuyo propósito fundamental es mejorar la calidad de vida de los costarricenses.
II.-Que, de conformidad con el Decreto Ejecutivo N° 31062-MOPT-MIVAH-MINAE publicado en El Alcance N° 22 La Gaceta N° 81 del 29 de abril del 2003, el Gobierno de la República constituyó el Consejo Nacional de Planificación Urbana, presidido por el Ministro de Vivienda y Asentamientos Humanos, e integrado, además del citado ministerio, por los Ministerios de Planificación Nacional y Política Económica, de Obras Públicas y Transportes, de Ambiente y Energía, el Instituto Nacional de Vivienda y Urbanismo, el Instituto de Fomento y Asesoría Municipal y la Compañía Nacional de Fuerza y Luz.
III.-Que de conformidad con el citado Decreto N° 31062-MOPT-MIVAH-MINAE, se crea la Secretaría Técnica del Plan Nacional de Desarrollo Urbano como brazo técnico del Consejo Nacional de Planificación Urbana y ente adscrito a la Dirección de Urbanismo del Instituto Nacional de Vivienda y Urbanismo, con el fin -entre otros- de apoyar y colaborar con la citada Dirección de Urbanismo en la elaboración del Plan GAM.
IV.-Que la Ley Nº 8342 promulgada el 18 de diciembre del 2002 como Ley de Aprobación del Convenio - Marco relativo a la ejecución de la ayuda financiera y técnica y de la cooperación económica en Costa Rica en virtud del reglamento "ALA", establece el marco relativo a la ejecución de la ayuda financiera y técnica y de la cooperación económica en Costa Rica. Dicho marco pretende contribuir a la realización de los objetivos, la ejecución de una ayuda financiera y técnica de una cooperación económica de la Comunidad Europea a favor de la República de Costa Rica.
V.-Que en virtud de la citada Ley N° 8342, el día 12 de diciembre del 2003, la Comunidad Europea y la República de Costa Rica firmaron el protocolo de menor rango denominado "Convenio de Financiación Específico entre la Comunidad Europea y la República de Costa Rica para apoyar técnica y económicamente el desarrollo del proyecto Planificación Regional y Urbana de la Gran Área Metropolitana -GAM- del Valle Central de Costa Rica".
VI.-El antedicho Convenio regula la ejecución de un proyecto que contará con una partida no reembolsable de 11 millones de euros y una contrapartida nacional de 7.5 millones de euros, y cuyos productos son:
El Plan Urbano a nivel de la GAM, las directrices metropolitanas para Alajuela, Heredia, San José y Cartago, así como actualizar y desarrollar los 31 Planes Reguladores de los cantones que integran la GAM.
VII.-Que dentro de dicho Convenio se establece como beneficiario directo al Ministerio de Vivienda y Asentamientos Humanos, como contrapartida técnica costarricense a la Secretaría Técnica del Plan Nacional de Desarrollo Urbano y como miembros del Comité Consultivo a los integrantes del Consejo Nacional de Planificación Urbana.
VIII.-Que el Gobierno de la República ha definido mediante oficio Nº DM-0179-2004 del 8 de marzo del 2004, enviado a la Contraloría General de la República, la estrategia para el Plan Nacional de Desarrollo Urbano y la responsabilidad de las distintas instancias involucradas en este Plan, incluidas tanto el Plan GAM como la Secretaría Técnica del Plan Nacional de Desarrollo Urbano.
IX.-Que el Gobierno de la República, a través de sus ministerios e instituciones descentralizadas impulsa una serie de proyectos vinculados al mejoramiento urbano. Como parte de estos proyectos se citan los siguientes: reorganización y sectorización del transporte masivo de pasajeros y el Proyecto TREM (Tren Eléctrico Metropolitano); proyectos de infraestructura vial; la electrificación subterránea y el nuevo alumbrado público de San José; alcantarillado sanitario y plantas de tratamiento de aguas residuales; proyectos de vivienda de alta densidad en áreas urbanas a regenerar, entre ellas, las áreas comprendidas dentro de los cuatro distritos centrales del cantón Central de San José y el canon por vertidos de aguas servidas a la red fluvial.
X.-Que la Contraloría General de la República ha presentado dos informes: el Nº 94/99 del 13 de agosto de 1999 "Informe de un estudio sobre planificación urbana y permisos de construcción en el Instituto Nacional de Vivienda y Urbanismo", y el Informe Nº DFOE-SM-11/2003 "Evaluación sobre la gestión del desarrollo urbano en Costa Rica" del año 2003, en los cuales emite su preocupación sobre las carencias que en materia de planificación urbana presenta el país, y demanda del Gobierno de la República y sus instituciones, las acciones pertinentes. XI.-Que la Procuraduría General de la República, mediante documento C-001-2004 del 5 de enero del 2004, se ha pronunciado sobre la legalidad de la creación del Consejo Nacional de Planificación Urbana y la Secretaría del Plan Nacional de Desarrollo Urbano como instrumentos del Poder Ejecutivo dentro de las competencias que le confiere la Ley de Planificación Urbana así como por las potestades de tutela administrativa que debe ejercer sobre la Administración Pública Descentralizada. XII.-Que en virtud de la fortaleza y oportunidad que significa la existencia de una serie de recursos económicos, el Gobierno de la República está haciendo el mejor esfuerzo para coordinar dichos recursos relacionados con la temática urbana, con el propósito de lograr mayor eficiencia, disminución de costos, y coordinación entre instituciones, en la generación de las herramientas de la planificación urbana, que harán factible un mejor entorno y desarrollo de nuestras ciudades.
