Amendment to the Seed Law Regulation on Registration of Commercial VarietiesReforma Reglamento a la Ley de Semillas

2º—That it is necessary to make certain modifications to the Regulation to the Seed Law, Executive Decree No. 12907-A, of July 7, 1981, published in La Gaceta No. 180 of September 21, 1981, in order to adapt it to current needs and the level of development of the country's seed sector. 3º—That the Board of Directors of the National Seed Office has among its functions and powers to propose to the Executive Branch the modifications it deems necessary to the Regulation to the Seed Law, for the issuance of the corresponding decrees, for the performance, quality control, and registration of varieties. 4º—That the accumulated experience in the matter of the Commercial Variety Registry (Registro de Variedades Comerciales) has demonstrated that it is advisable to adopt appropriate measures to expedite the registration process so that it is practical and applicable. 5º—That based on new technologies and commercial trends, a change of vision regarding the purpose of the Registry is timely, which must become a commercial variety information bank, including the supporting documentation that backs up their attributes and characteristics. 6º—That it is essential to have truthful information on the agronomic, commercial, and descriptive characteristics of commercial varieties, for the purpose of avoiding practices that may induce error and guarantee human and animal health and the preservation of plants. Therefore:

HEREBY DECREE:

12907-A and its reforms, Regulation to the Seed Law, which shall henceforth read as follows:

"Commercial Variety Registry (Registro de Variedades Comerciales)

Registration shall not be necessary for varieties whose seed is intended exclusively for export, except when it involves certified seed, in which case only the varietal description shall be required for registration purposes, information that would serve as a reference for field inspections within the certification system.

For species in which the Commercial Variety Registry has been established, only seed of those varieties registered in this Registry may be produced and imported for commercial purposes.

For registration in the Commercial Variety Registry, the candidate variety must meet the following requirements:

• a)Distinct from the varieties that are registered in the Registry or were previously registered. Exceptions are cases of re-registrations of varieties when at the request of the interested party or by the Office itself it is deemed convenient. A variety is considered distinct if it is clearly differentiated by one or more important and minimally fluctuating characteristics from any other variety registered or in the process of being registered in the Commercial Variety Registry. b) Uniform (Homogénea). A variety is considered uniform if the individuals that compose it, excluding aberrant types whose number must be kept within reasonable limits, are similar for the set of characteristics that define it, taking into account the particularities of its sexual reproduction or vegetative multiplication system. c) Stable (Estable). A variety is considered stable if, after successive reproductions or multiplications, or at the end of a particular reproduction or multiplication cycle -when such a cycle has been defined-, it remains in conformity with the description regarding its essential characteristics. d) Possess agronomic value or proven use during a minimum of two test cycles in the most representative agroecological zones, or environments of use, except for the exceptions indicated in this Regulation.

A variety is considered to have agronomic or commercial use value if, in comparison with other varieties registered in the Commercial Variety Registry, it represents for the whole of its qualities, at least when cultivated in a specific zone or environment, a value that is at minimum similar to that of other registered varieties, whether in relation to its cultivation, productivity, utilization, quality, or derived products. Inferiority in some of its characteristics may be compensated by others that present themselves as favorable.

Registration applications must be signed by the breeder (obtentor) or its successor in interest (causahabiente), legal representative in Costa Rica, or a sponsor.

In the case of a foreign applicant not domiciled in Costa Rica, they must accredit a representative, a natural or juridical person with legal domicile in the country.

The registration of varieties in the public domain or of an unrecognized breeder may be carried out ex officio by National Research Institutions or through the initiative of third parties. In highly qualified cases of national interest, the National Seed Office may proceed ex officio with the registration of these varieties.

All applications must be submitted to the National Seed Office on the forms provided for this purpose. Both the registration application and its annexes and complementary documentation must be submitted in the Spanish language or, failing that, shall include their translation.

The registration application form shall include at minimum the following information: a) Name and address of the applicant. b) Name and address of the breeder or its successor in interest. c) Botanical classification (genus, species, subspecies or botanical variety). d) Proposed varietal denomination. e) Country of origin where the variety was obtained. f) Method of obtaining (selection, hybridization, mutation, transgenesis, etc.). g) Information in case of being registered or in the process of registration in registries or lists of other countries.

Documents to be attached: I. History of the variety's evaluation and selection process. II. Report of the results of agronomic validation conducted (agronomic value). III. Description of the variety. IV. Report of the transformation event (if the variety is a genetically modified organism). V. Indication of the most suitable agroecological conditions, zones, and planting seasons for cultivating the variety. VI. Complementary information (photographs, diagrams, drawings, plant material, etc.). VII. Description of the agronomic management under which the information was obtained.

For varieties of ornamental species and those determined in due course by the National Seed Office, a facilitated registration system may be established, allowing for the validation of extrapolable foreign information or not requiring the submission of results of agronomic value tests conducted in the country.

If the registration application has not been submitted in accordance with the provisions of this Regulation and the specific regulations for each species or group of species, if applicable, the National Seed Office shall determine a peremptory period to complete the required information, after which, and if what was requested is not fulfilled, it shall be considered rejected.

Upon receipt of the variety registration application, the corresponding fee must be paid, and the applicant must attach the respective proof of payment to it.

The registration of a variety in the Commercial Variety Registry shall be carried out by agreement of the Board of Directors of the National Seed Office, upon the proposal of the Executive Director, considering the report submitted by the Technical Department of the Office, after examination of the application and the information provided.

The National Seed Office may grant, based on the results of the first validation cycle in the country, a provisional registration of the requested variety, for a period of two years. Upon completion of this period and in the event that the variety has demonstrated satisfactory performance or additional information generated in the country is provided before this term, the definitive registration may be granted if so appropriate.

Information generated abroad on the varietal description, as well as from other countries with agroecological conditions similar to those of Costa Rica with respect to agronomic and/or use value, may be provided in order to expedite the registration process and reduce the validation time in the country.

The National Seed Office shall annually publish the list of commercial varieties for the different crops; in cases of provisional registration, the variety shall appear on the list with that indication. When the registration of a variety is approved or rejected, or an already registered variety is excluded, such resolution shall be communicated to the applicant and officially published.

Likewise, information from evaluations conducted through regional research organizations will be accepted for registration purposes.

The National Seed Office may form Variety Qualification Committees (Comités Calificadores de Variedades) for certain species or groups of species, whose integration shall be based on the knowledge, specialization, or recognized competence of its members in each of those crops. The function of these Committees is to advise the Office on varietal registration matters and related issues. The National Seed Office may submit registration applications for commercial varieties to the knowledge of the respective Variety Qualification Committee, which shall issue reports with the corresponding recommendations.

The trials and work aimed at the identification and determination of the agronomic and use value of varieties for their possible registration in the Commercial Variety Registry may be carried out by the applicant, research institutions, or other national or international public or private organizations; these trials must be endorsed by agronomists (ingenieros agrónomos) duly registered with the respective professional association. The National Seed Office may carry out follow-up inspections of these evaluations if deemed pertinent.

In highly qualified situations of national interest, at the discretion of the Governing Body on agricultural matters, notoriously known varieties may be registered, with technical references of their use in other countries with environments similar to Costa Rica, even if they do not have national validation.

• b)It is determined that the registered variety has ceased to be distinct, stable, or sufficiently uniform. c) The breeder itself, its successor in interest, or assignee (derechohabiente) so requests. d) The corresponding fees are not paid. e) The term for requesting the renewal of the registration expires without such request having been made. f) It is proven that the variety has lost the conditions by virtue of which it was registered. Mainly when it is determined that the variety is severely affected by pests or diseases new to the crop, or that it may favor their dissemination. g) A variety that has been provisionally registered shows some unfavorable performance or condition not initially evidenced.

For varieties registered ex officio and those whose permanence in the Registry is considered of great interest -without such condition having been requested- the renewal of the registration may be proposed by the Office itself or through the initiative of third parties.

The applicant for registration must ensure that the variety preserves the original characteristics with which it was registered. The National Seed Office may carry out the corresponding controls to verify varietal conservation.

The registration of a variety in the Commercial Variety Registry implies that its denomination guarantees its identity in accordance with the description that appears in the Registry; as well as the recognition of its agronomic and use value in our country at the time its registration is formalized; with the exception of varieties registered exclusively for export.

The applicant for a registration is obligated to pay the corresponding fees for the concept of registration and its maintenance in force.

The veracity of the information provided and the evaluation of the variety's adaptability and agronomic performance prior to its registration, according to the recommended zones of use in the country, are the exclusive responsibility of the applicant. The responsibility of the National Seed Office is limited to determining that the candidate variety meets the general requirements for its registration according to the data received and to keeping this source of information available.

For those varieties that have been submitted for registration in the Commercial Variety Registry, and that the National Seed Office determines that, due to some particular genetic characteristic, their mismanagement could cause environmental harm, it shall order that they be managed under a necessarily controlled production and commercialization system, and that they be registered in the Registry as a Restricted Use Variety (Variedad de Uso Restringido).

Registration in the Commercial Variety Registry as a restricted use variety shall give the applicant the following rights and obligations: That their authorization is required for the reproduction or multiplication; production; preparation for these purposes; offer for sale, sale or any other form of commercialization; exportation or importation of seed. The inappropriate management of these varieties could put the environment at risk; therefore, non-compliance with the preceding provisions shall be considered an infraction of the Seed Law and the legislation on phytosanitary (Fitosanitaria) and environmental matters.

If the variety was obtained abroad, the denomination must be the same under which it is registered or commercialized in the country of origin, except in very justified cases for linguistic or idiomatic reasons at the discretion of the National Seed Office.

The National Seed Office shall determine whether the proposed denomination is accepted. It shall be mandatory to use the denomination under which the variety is registered in any production or commercialization process of the reproduction or multiplication material.

When the National Seed Office does not consider the proposed denomination appropriate, it shall so communicate to the applicant, who shall have 30 working days to submit a new proposal".

2º—Que es necesario efectuar ciertas modificaciones al Reglamento a la Ley de Semillas, Decreto Ejecutivo Nº 12907-A, de 7 de julio de 1981 publicado en La Gaceta Nº 180 del 21 de setiembre de 1981, con el fin de adecuarlo a las necesidades actuales y al nivel de desarrollo del sector de semillas del país. 3º—Que la Junta Directiva de la Oficina Nacional de Semillas tiene entre sus funciones y atribuciones el proponer al Poder Ejecutivo las modificaciones que considere necesarias al Reglamento a la Ley de Semillas, para la emisión de los decretos correspondientes, para la realización, control de calidad y registro de variedades. 4º—Que la experiencia acumulada en materia de Registro de Variedades Comerciales ha demostrado que es conveniente adoptar medidas apropiadas para agilizar el proceso de registro de tal forma que, este sea práctico y aplicable. 5º—Que en función de las nuevas tecnologías y tendencias comerciales, es oportuno un cambio de visión respecto al sentido del Registro, el cual debe constituirse en un banco de información de variedades comerciales, que incluya los atestados que respalden sus atributos y características. 6º—Que es esencial disponer de información veraz sobre las características agronómicas, comerciales y descriptivas de las variedades comerciales, con la finalidad de evitar prácticas que puedan inducir a error y garantizar la salud humana y animal y la preservación de los vegetales. Por tanto:

"Registro de variedades comerciales

No será necesario la inscripción cuando se trate de variedades cuya semilla se destinará exclusivamente a la exportación, excepto cuando se trate de semilla certificada, en cuyo caso se requerirá únicamente de la descripción varietal para efectos de registro, información que serviría de referencia para las inspecciones de campo dentro del sistema de certificación. En las especies en las que se haya establecido el Registro de Variedades Comerciales, solo podrán producirse e importarse con fines comerciales, semilla de aquellas variedades inscritas en este Registro. Para la inscripción en el Registro de Variedades Comerciales, la variedad candidata debe cumplir con los siguientes requisitos:

• a)Distinta de las variedades que están inscritas en el Registro o lo estuvieron anteriormente. Se exceptúan los casos de reinscripciones de variedades cuando a solicitud del interesado o por la misma Oficina se juzgue conveniente. Se considera que una variedad es distinta, si se diferencia claramente por uno o más caracteres importantes y de poca fluctuación, de cualquier otra variedad inscrita o en proceso de inscripción en el Registro de Variedades Comerciales. b) Homogénea. Se considera que una variedad es homogénea, si los individuos que la componen, con exclusión de los tipos aberrantes cuyo número debe mantenerse dentro de límites razonables, son semejantes para el conjunto de caracteres que la definan, teniendo en cuenta las particularidades de su sistema de reproducción sexual o multiplicación vegetativa. c) Estable. Se considera que una variedad es estable, si después de reproducciones o multiplicaciones sucesivas, o al final de un ciclo particular de reproducción o multiplicación -cuando se haya definido tal ciclo-, permanece conforme con la descripción en cuanto a sus caracteres esenciales. d) Poseer valor agronómico o de uso comprobado durante un mínimo de dos ciclos de pruebas en las zonas agroecológicas más representativas, o ambientes de uso, salvo las excepciones indicadas en este Reglamento.

Se considera que una variedad es de valor agronómico o de uso comercial, si en comparación con otras variedades inscritas en el Registro de Variedades Comerciales, representa para el conjunto de sus cualidades, por lo menos al cultivarse en una zona o ambiente determinados, un valor que sea como mínimo similar al de otras variedades registradas, ya sea en relación con su cultivo, a su productividad, utilización, calidad o productos derivados. La inferioridad en alguno de sus caracteres puede quedar compensada por otros que se presenten como favorables.

Las solicitudes de inscripción deberán ser suscritas por el obtentor o su causahabiente, representante legal en Costa Rica o un patrocinante. Cuando se trate de un solicitante extranjero no radicado en Costa Rica, deberá acreditar un representante, persona natural o jurídica con domicilio legal en el país. La inscripción de variedades de dominio público o de obtentor no reconocido, podrá hacerse de oficio por Instituciones Nacionales de Investigación o mediante iniciativa de terceros. En casos muy calificados de interés nacional, la Oficina Nacional de Semillas podrá de oficio proceder a la inscripción de estas variedades. Toda solicitud deberá presentarse ante la Oficina Nacional de Semillas en los formularios que para tal efecto se faciliten. Tanto la solicitud de inscripción como sus anexos y documentación complementaria deberá presentarse en idioma español o en su defecto contará con su traducción.

El formulario de solicitud de inscripción comprenderá como mínimo la siguiente información: a) Nombre y dirección del solicitante. b) Nombre y dirección del obtentor o su causahabiente. c) Clasificación botánica (género, especie, subespecie o variedad botánica). d) Denominación varietal propuesta. e) País de origen donde fue obtenida la variedad. f) Método de obtención (selección, hibridación, mutación, transgénesis, etc.). g) Información en caso de estar inscrita o en proceso de inscripción en registros o en listas de otros países.

Documentos que se deben adjuntar: I. Historial del proceso de evaluación y selección de la variedad. II. Informe de los resultados de validación agronómica realizados (valor agronómico). III. Descripción de la variedad. IV. Informe del evento de transformación (si la variedad es organismo genéticamente modificado). V. Indicación de las condiciones agroecológicas, zonas y épocas de siembra más adecuadas para el cultivo de la variedad. VI. Información complementaria (fotografías, diagramas, dibujos, material vegetal, etc.). VII. Descripción del manejo agronómico con que fue obtenida la información. Para las variedades de especies ornamentales y las que en su oportunidad determine la Oficina Nacional de Semillas, se podrá establecer un sistema facilitado de registro, pudiéndose convalidar información foránea extrapolable o no requerirse la presentación de resultados de pruebas de valor agronómico efectuados en el país.

Si la solicitud de inscripción no se ha presentado de acuerdo con lo que se establece en este Reglamento y en los reglamentos específicos para cada especie o grupo de especies si fuera el caso, la Oficina Nacional de Semillas determinará un plazo perentorio para completar la información requerida, pasado el cual y si no se cumple con lo solicitado, se dará por rechazada. Recibida la solicitud de inscripción de la variedad, se deberá pagar la tarifa correspondiente, debiendo el solicitante adjuntar a la misma el comprobante de pago respectivo. La inscripción de una variedad en el Registro de Variedades Comerciales, se realizará por acuerdo de la Junta Directiva de la Oficina Nacional de Semillas, a propuesta del Director Ejecutivo, visto el informe remitido por el Departamento Técnico de la Oficina, posterior al examen de la solicitud y de la información aportada. La Oficina Nacional de Semillas podrá conceder, con base en los resultados del primer ciclo de validación en el país, una inscripción provisional de la variedad solicitada, por un periodo de dos años.

Cumplido este periodo y en caso de que la variedad haya evidenciado un comportamiento satisfactorio o se aporte información adicional generada en el país antes de este plazo, podrá otorgarse la inscripción definitiva si así correspondiese. Se podrá aportar información generada en el exterior sobre la descripción varietal así como de otros países con condiciones agroecológicas similares a las de Costa Rica en lo que respecta al valor agronómico y/o de uso, a efectos de agilizar el proceso de inscripción y reducir el tiempo de validación en el país. La Oficina Nacional de Semillas publicará anualmente la lista de variedades comerciales de los diferentes cultivos; en los casos de inscripción provisional, la variedad aparecerá en la lista con esa indicación. Cuando se apruebe o rechace la inscripción de una variedad o se excluya una variedad ya inscrita, se comunicará tal resolución al solicitante y publicará oficialmente.

Igualmente se aceptará para efectos de registro la información de evaluaciones realizadas a través de organismos regionales de investigación. La Oficina Nacional de Semillas podrá conformar Comités Calificadores de Variedades para determinadas especies o grupos de especies, cuya integración estará fundamentada en los conocimientos, especialización o reconocida competencia de sus miembros en cada uno de esos cultivos. La función de estos Comités es la de asesorar a la Oficina en materia de registro varietal y asuntos relacionados. La Oficina Nacional de Semillas podrá someter a conocimiento del Comité Calificador de Variedades respectivo las solicitudes de inscripción de variedades comerciales, el cual emitirá los informes con las recomendaciones correspondientes. Los ensayos y trabajos tendientes a la identificación y determinación del valor agronómico y de uso de las variedades para su posible inscripción en el Registro de Variedades Comerciales podrán ser realizados por el solicitante, instituciones de investigación u otros organismos nacionales o internacionales públicos o privados; estos ensayos deberán ser avalados por ingenieros agrónomos debidamente incorporados al colegio profesional respectivo.

La Oficina Nacional de Semillas podrá llevar a cabo inspecciones de seguimiento de estas evaluaciones si así se estima pertinente. En situaciones muy calificadas de interés nacional a criterio del Ente Rector en materia agrícola, se podrán inscribir en el registro, variedades notoriamente conocidas, con referencias técnicas de su uso en otros países con ambientes similares al de Costa Rica, aunque no cuenten con una validación nacional.

• b)Se determina que la variedad inscrita ha dejado de ser distinta, estable o suficientemente homogénea. c) El propio obtentor, su causahabiente o derechohabiente lo solicita. d) No se paguen las tarifas correspondientes. e) Expira el plazo de solicitud de renovación del registro sin haberse efectuado tal solicitud. f) Se comprueba que la variedad ha perdido sus condiciones, en virtud de las cuales fue inscrita. Principalmente cuando se determina que la variedad es severamente afectada por plagas o enfermedades nuevas para el cultivo, o que pueda favorecer su diseminación. g) Una variedad que ha sido inscrita en carácter de provisionalidad, denota algún comportamiento o condición desfavorables no evidenciados inicialmente.

Para las variedades inscritas de oficio y aquellas en las que se considere de gran interés su permanencia en el Registro -sin haberse solicitado tal condición- la renovación de la inscripción podrá ser propuesta por la misma Oficina o por iniciativa de terceros. El solicitante del registro deberá velar porque la variedad conserve las características originales con que fue inscrita. La Oficina Nacional de Semillas podrá realizar los controles correspondientes para verificar la conservación varietal. La inscripción de una variedad en el Registro de Variedades Comerciales supone que su denominación garantice su identidad de acuerdo con la descripción que figura en el Registro; así como el reconocimiento de su valor agronómico y de uso en nuestro país en el momento de formalizarse su inscripción; con excepción de las variedades inscritas exclusivamente para la exportación. El solicitante de una inscripción quedará obligado al pago de las tarifas correspondientes por concepto del registro y su mantenimiento en vigencia.

Es de exclusiva responsabilidad del solicitante la veracidad de la información suministrada y la evaluación de la adaptabilidad y comportamiento agronómico de la variedad previo a su registro, según las zonas recomendadas de uso en el país. La responsabilidad de la Oficina Nacional de Semillas se circunscribe a determinar que la variedad candidata cumple los requisitos generales para su inscripción de acuerdo a los datos recibidos y a mantener disponible esta fuente de información. Para aquellas variedades que hayan sido presentadas para su inscripción en el Registro de Variedades Comerciales, y que la Oficina Nacional de Semillas determine que por alguna característica genética particular, un mal manejo de las mismas pueda ocasionar un daño ambiental, deberá ordenar, que se manejen bajo un sistema de producción y comercialización necesariamente controlado, y que se proceda a inscribirlas en el Registro como una Variedad de Uso Restringido.

La inscripción en el Registro de Variedades Comerciales como una variedad de uso restringido dará al solicitante los siguientes derechos y obligaciones: Que se requiera su autorización para la reproducción o multiplicación; producción; preparación para estos fines; oferta en venta, venta o cualquier otra forma de comercialización; exportación o importación de semilla. El manejo inapropiado de estas variedades podría poner en riesgo al ambiente; por lo tanto el incumplimiento de las anteriores disposiciones se considerará como una infracción a la Ley de Semillas y a las legislaciones en materia Fitosanitaria y Ambiental.

Si la variedad fue obtenida en el extranjero, la denominación debe ser la misma con que figure inscrita o se comercialice en el país de origen, excepto en casos muy justificados por razones lingüísticas o idiomáticas a criterio de la Oficina Nacional de Semillas. La Oficina Nacional de Semillas determinará si la denominación propuesta es aceptada. Será obligatorio utilizar la denominación con que la variedad quede inscrita en cualquier proceso de producción o comercialización del material de reproducción o multiplicación. Cuando la Oficina Nacional de Semillas no considere apropiada la denominación propuesta, lo comunicará así al solicitante, quien dispondrá de 30 días hábiles para la presentación de una nueva propuesta".
