AJDIP/534.—Puntarenas, on the fifth day of the month of December of the year two thousand three
IT IS AGREED:
1º—The Administration of the Institute, through the Head of the Department of Protection and Registry and the Regional Directors and Chiefs, may authorize the temporary substitution of vessels dedicated to maritime fishing for commercial purposes, in exceptional and duly demonstrated cases before said bodies in such a way that it is verified and proven that the vessel is indeed not in condition to carry out the fishing activity. The foregoing must be accredited in writing and recorded in the respective file.
2º—The term granted for the temporary substitution shall be one calendar year counted from the date of issuance of the respective authorization by the aforementioned bodies. Once the indicated term has expired, the temporary substitution permit shall expire by operation of law and under no circumstance may it be revalidated.
3º—The temporary substitution shall be governed by the same terms and conditions regarding the fulfillment of requirements and procedure, as established in agreement AJDIP/238-2002.
4º—The cost of the temporary substitution permit shall be the same as that established for the commercial fishing license held by the vessel subject to the temporary substitution.
5º—Article No. 1 of agreement AJDIP/132-99, published in La Gaceta No. 104 of May 31, 1999, is repealed. Let it be published.

SE ACUERDA:
1º—La Administración del Instituto, por medio del Jefe del Departamento de Protección y Registro y los Directores y Jefes Regionales podrá autorizar la sustitución temporal de embarcaciones dedicadas a la pesca marítima con fines comerciales, en casos excepcionales y debidamente demostrados ante dichas instancias de forma tal que se constate y compruebe que efectivamente la embarcación no está en condiciones para realizar la actividad de pesca. Lo anterior deberá acreditarse por escrito y constar en el expediente respectivo. 2º—El plazo otorgado para la sustitución temporal, será de un año calendario contado a partir de la fecha de emisión de la autorización respectiva por parte de las instancias mencionadas.
