1That it is the duty of the State to ensure the sustainable development of resources and to increase national social, environmental, economic, and political equilibrium.
2That it is necessary to guarantee that activities carried out in a Private Wildlife Refuge are conducted in complete harmony with the environment and by implementing development in a sustainable manner. 3º-That there is a need to encourage the participation of civil society in the development and monitoring of biodiversity protection, as well as in its conservation. 4º-That through Executive Decree No. 26661-MINAE, published in La Gaceta No. 32, of February 16, 1998, the Ministry of Environment and Energy declared the property Folio Real number 75821-000 of the Partido of Heredia, located in Cerro Dantas, fifth district, Vara Blanca, first canton, Heredia of the province of Heredia, covering an area of fifty-six hectares and 9,560.13 square meters, a Private Wildlife Refuge, named Refugio de Vida Silvestre Privado Cerro Dantas.
5That through a filing dated November 29, 2002, Centro Ecológico Pavo Real S. A., requested from the Heredia Office of the Subregión Central, the renewal of the management category decreed on its property.
6That field inspections were carried out, determining a large forest cover (cobertura boscosa), which remains unaltered and in a perfect state of conservation.

1Que es tarea del Estado asegurar el desarrollo sostenible de los recursos e incrementar el equilibrio social, ambiental, económico y político nacional.
2Que es necesario garantizar que las actividades que se realicen en un Refugio Privado de Vida Silvestre se desarrollen en total armonía con el ambiente e implementando un desarrollo en forma sostenida. 3º-Que existe la necesidad de fomentar la participación de la sociedad civil en el desarrollo y seguimiento de la protección de la biodiversidad, así como en la conservación de esta. 4º-Que mediante Decreto Ejecutivo Nº 26661-MINAE, publicado en La Gaceta Nº 32, del 16 de febrero de 1998, el Ministerio del Ambiente y Energía, declaró la finca Folio Real número 75821-000 del Partido de Heredia, ubicada en Cerro Dantas, distrito quinto, Vara Blanca, cantón primero, Heredia de la provincia de Heredia, en un área de cincuenta y seis hectáreas 9 560,13 metros cuadrados, Refugio de Vida Silvestre Privado, denominado Refugio de Vida Silvestre Privado Cerro Dantas.
5Que mediante escrito del 29 de noviembre del 2002, el Centro Ecológico Pavo Real S. A., solicita a la Oficina de Heredia de la Subregión Central, la renovación de la categoría de manejo decreta en su inmueble.
6Que se realizaron inspecciones de campo determinando una gran masa boscosa, la cual se mantiene inalterable y en un perfecto estado de conservación.
7Que el Plan de Manejo cumple con los objetivos propuestos y aprobados por el Ministerio del Ambiente y Energía. Por tanto:

Artículo 2 — The Refuge shall be called: "Refugio de Vida Silvestre Privado Cerro Dantas".

Artículo 3 — The owner of the property described in article 1 undertakes to abide by the Management Plan, protect biodiversity, and provide collaboration to the officials of the Ministry of Environment and Energy during inspections carried out on the property.

Artículo 4 — It becomes effective upon its publication.

Artículo 2 — Que el Refugio se denominará: "Refugio de Vida Silvestre Privado Cerro Dantas".

Artículo 3 — El propietario de inmueble descrito en el artículo 1, se compromete a acatar el Plan de Manejo, proteger la biodiversidad y a brindar colaboración a los funcionarios del Ministerio del Ambiente y Energía en las inspecciones que se realicen al inmueble.
