in the entirety of the text - Complete Text of Norm 31567 Officially declares the area of Los Inocentes and Surrounding Zones located in the Canton of La Cruz as free of the Mediterranean Fruit Fly (Ceratitis capitata, Wied) Complete Text record: 70553 Nº 31567 Nº 31567 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers conferred by articles 140, subsections 3), 8), 18) and 20) and 146 of the Political Constitution, articles 25, 27.1, 28.2b of Law Nº 6227 of May 2, 1978, General Law of Public Administration, Law Nº 7664 of April 8, 1997, Law of Phytosanitary Protection, Law Nº 1970 of October 26, 1955, International Plant Protection Convention, and Law Nº 7475 of December 20, 1994, Law Approving the Agreement on Agriculture of the Final Act Embodying the Results of the Uruguay Round of Multilateral Trade Negotiations.

1That the Mediterranean fruit fly (Ceratitis capitata, Wied) constitutes a pest of great economic importance that affects a wide range of fruit trees and vegetables, generating heavy economic losses to agriculture and also limiting the possibilities of the products to access international markets, given that it is a pest classified as quarantine.
2That the Mediterranean fruit fly was detected for the first time in Costa Rica in the Central Region in 1955, date and place from which it has spread, and is therefore widely distributed in the country.
3That the State Phytosanitary Service, through internationally accepted detection, control, and monitoring systems, has confirmed the absence of this pest from the area surrounding Hacienda Los Inocentes and surrounding zones located in the district of Santa Cecilia, canton of La Cruz, province of Guanacaste.
4That the contracting parties to the International Plant Protection Convention accept the recognition of pest-free areas and areas of low pest prevalence.
5That the Convention's standards establish the requirements for the establishment and use of pest-free areas (PFAs) as a risk management option for the Phytosanitary Certification of plant products exported from the PFA.
6That it is necessary to adopt the technical and legal measures to prevent reinfestation of the pest in order to reduce the phytosanitary risk for the exploitation of fruit trees and vegetables for export purposes, thereby contributing to the improvement of the quality of life of producers and of the national economy. Therefore:

THEY DECREE:

Considering:

For the purpose of reducing the risk of reinfestation, the State Phytosanitary Service shall proceed to establish the phytosanitary measures required as appropriate.

Otherwise, proceedings shall be in accordance with the provisions of article 15 of the Law of Phytosanitary Protection, without prejudice to the criminal liabilities they may incur, in accordance with the provisions of clauses 17 and 68 of the Law of Phytosanitary Protection.

The State Phytosanitary Service shall arrange the use of those resources for the control and combat of the pest and shall carry out the corresponding liquidation, a posteriori, in accordance with the administrative procedures that regulate the matter.

1Que la mosca del Mediterráneo (Ceratitis capitata, Wied) constituye una plaga de gran importancia económica que afecta un amplio rango de frutales y hortalizas, generando fuertes perjuicios económicos a la agricultura y limitando también las posibilidades de los productos, de accesar a mercados internacionales, dado que se trata de una plaga clasificada como cuarentenaria.
2Que la mosca del Mediterráneo fue detectada por primera vez en Costa Rica en la Región Central en 1955, fecha y lugar a partir de las cuales se ha diseminado, por lo que es de amplia distribución en el país.
3Que el Servicio Fitosanitario del Estado, mediante sistemas de detección, control y monitoreo, aceptados internacionalmente, ha confirmado la ausencia de esta plaga del área circundante a la Hacienda Los Inocentes y zonas circunvecinas ubicadas en el distrito de Santa Cecilia, cantón de La Cruz, provincia de Guanacaste.
4Que las partes contratantes de la Convención Internacional de Protección Fitosanitaria aceptan el reconocimiento de áreas libres y de escasa prevalencia de plagas.
5Que las normas de la Convención establecen los requisitos para el establecimiento y uso de áreas libres de plagas (ALP) como una opción del manejo del riesgo para la Certificación Fitosanitaria de productos vegetales exportados del ALP .
6Que se hace necesario adoptar las medidas técnicas y jurídicas que permitan evitar la reinfestación de la plaga a efecto de disminuir el riesgo fitosanitario para la explotación de frutales y hortalizas con fines de exportación, coadyuvando así al mejoramiento de la calidad de vida de los productores y de la economía nacional. Por tanto:

DECRETAN:

Para efectos de reducir el riesgo de reinfestación el Servicio Fitosanitario del Estado procederá a establecer las medidas fitosanitarias que se requieran según corresponda.

Caso contrario se procederá conforme a lo dispuesto en el artículo 15 de la Ley de Protección Fitosanitaria, sin perjuicio de las responsabilidades penales en que pudiesen incurrir, de conformidad con lo dispuesto en los ordinales 17 y 68 de la Ley de Protección Fitosanitaria.

El Servicio Fitosanitario del Estado dispondrá la utilización de esos recursos para el control y combate de la plaga y efectuará la liquidación correspondiente, a posteriori, conforme a los procedimientos administrativos que regulan la materia.

Artículo 2 — As an immediate effect of the recognition of a pest-free area, the liberated zone shall remain under official control, maintaining a monitoring system using devices for trapping fruit flies.

Artículo 4 — All persons, natural or legal, public or private, in particular the agents related, directly or indirectly, to the production, commercialization, and movement of fruits and vegetables into this area, who have knowledge of the pest must report it to the State Phytosanitary Service.

Artículo 5 — In the event of an outbreak of the Mediterranean fruit fly within the pest-free area, the owners or occupants by any title of the fruit and vegetable plantations within the free zone must execute all phytosanitary measures ordered to them by the State Phytosanitary Service.

Artículo 6 — For the use of the funds contemplated in article 66 of the Law of Phytosanitary Protection, any outbreak of the pest in the area recognized as free shall be declared a state of emergency in this Executive Decree.

Artículo 8 — It shall be effective upon its publication.

Artículo 2 — Como efecto inmediato del reconocimiento de área libre de la plaga, la zona liberada quedará bajo control oficial manteniendo un sistema de monitoreo usando dispositivos para trampeo de moscas de la fruta.

Artículo 6 — Para la utilización de los fondos contemplados en el artículo 66 de la Ley de Protección Fitosanitaria, se declarará estado de emergencia cualquier brote de la plaga en el área que se reconoce como libre, en este Decreto Ejecutivo.
