throughout the text - Complete Text of Regulation 31555 Zoning and Regionalization Incentive Regulation for officials of the Ministry of Agriculture and Livestock Complete Text record: 11BBF3 No. 31555-MAG No. 31555-MAG (This executive decree was repealed by article 11 of the Regulation for the payment of zoning for officials of the Ministry of Agriculture and Livestock, approved by executive decree No. 40690 of September 12, 2017) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers conferred by articles 140, subsections 3), 8), 18) and 20) and 146 of the Political Constitution, articles 25, 27.1 and 28.2.b of Law No. 6227 of May 2, 1978, General Law of Public Administration and Law No. 7064 of April 29, 1987, Law for the Promotion of Agricultural Production which incorporates the Organic Law of the Ministry of Agriculture and Livestock.
1st-That the Zoning and Regionalization Incentive Regulation of this Ministry, Executive Decree No. 15484-MAG of May 18, 1984, has as its fundamental purpose to be an instrument that allows the official to be granted the maximum possible facilities and comforts in the performance of their duties when having to travel to or reside permanently in remote areas, thereby sacrificing the advantages that enjoying all the services offered by the capital would represent.
2nd-That the Office of the Comptroller General of the Republic periodically establishes maximum and minimum amounts to be paid for zoning, taking into account the cost of living.
3rd-That at the time of enacting Executive Decree No. 15484-MAG, some workplaces did not exist, making it necessary to incorporate them into the respective lists, in order not to place the people who work there at a disadvantage.
4th-That in many cases the officials must move their family to the new place of work, which also merits its regulation. That the official who receives zoning, according to the current regulations, loses that compensation when bringing their family to live with them and must incur heavy expenses for that move.
5th-That in the majority of cases the officials who live in a house or apartment provided by the Ministry perform the function of watchmen by living adjacent to offices and warehouses belonging to this Institution. In addition, they must attend to the inquiries of producers who require their services during non-working hours or days.
6th-That it is necessary to make modifications to the existing regulations, with the purpose of adapting them to reality, taking into account the progress that some areas of the country have had that were considered difficult to access and that did not meet necessary basic aspects, but those conditions changed, for which it is advisable to change the percentages of certain zones.
7th-That the current regulations have not been modified since their enactment and that it is necessary by reason of the above, to adapt them to the new needs of the Institution, in order to offer the national community a better public service. Therefore:
THEY DECREE:
The following:
Zoning and Regionalization Incentive Regulation for officials of the Ministry of Agriculture and Livestock Article 1st-For the purposes of this Regulation, the following shall be understood as:
Article 2nd-The payment of zoning shall be percentage-based, taking into consideration means and risks of transport, climate, healthiness, conditions, facilities and local cost of living, possibilities of education and medical care for the servant and their family, such that one hundred percent corresponds to the maximum sum that the Office of the Comptroller General of the Republic sets, for the payment of zoning to public servants.
Article 3rd-Only one of the benefits established in the present Regulation may be recognized to each official. The recognition of payment of zoning or of regionalization incentive (incentivo por regionalización) shall be made by means of a Personnel Action (P-21) by the Human Resources Department of the MAG. Any subsequent variant that produces modifications in the amount of the granted benefit, must be communicated by the respective National Director or Regional Director to the Human Resources Department, in writing within a period no greater than eight working days, upon knowledge of such facts or conditions, otherwise they may become subject to the disciplinary or civil consequences, that said omission may cause. Likewise, the person to whom sums had been paid in excess without being entitled to them, must reimburse them to the resources of the Ministry (State).
Article 4th-For the official who is transferred to a place different from their legal domicile, who was enjoying the benefit of zoning at the time of transfer, said amount shall be adjusted, to that which corresponds to the zone to which they are transferred. If the official subsequently moves their nuclear family to live with them and thereby changes their legal domicile, the zoning must be readjusted to regionalization incentive (incentivo por regionalización).
Article 5th-The servant shall not lose the right to earn the sum set for the concept of regionalization incentive (incentivo por regionalización) or zoning in the following cases:
Article 6th-The servant who for reasons of training or another reason is obliged to remain more than one month away from their place of work and who during that time had their benefit frozen, upon their return, prior communication to the Human Resources Department in writing of their return to work, shall regain the right to enjoy the same.
Article 7th-Travel and transportation expenses shall continue to be regulated independently from zoning or regionalization incentive (incentivo por regionalización), in accordance with the provisions contained in the corresponding Regulation, enacted by the Office of the Comptroller General of the Republic.
Article 8th-In order to resolve cases not provided for in this Regulation, a Zoning and Regionalization Incentive Commission shall be appointed, which shall be composed in the following manner:
Each proprietary representative must have their respective alternate. The members of the Commission shall serve in their positions for two years.
Article 9th-The Commission shall be sworn in by the Minister of Agriculture and Livestock and shall be chaired by the Head of the Human Resources Department or their representative, who shall convene a session each time it is required or at the request of four of its members and agreements shall be adopted by simple majority of votes present. A quorum to meet shall be four of its members. The Human Resources Department shall provide secretarial support to said Commission.
Considering:
The Administration shall grant leave with pay to the members of the Commission, during the time required to fulfill their functions.
In the event that a longer time is required, it must communicate this to the parties, eight days in advance, and said period may be extended only once by decision of the Commission for a maximum of 15 calendar days.
The benefit of living in a house or apartment provided or leased on behalf of the Ministry, is estimated at:

15484-MAG of May 18, 1984, published in La Gaceta No. 131 of July 11, 1984, and its amendments are repealed.
Transitional I.-All officials who enjoy the benefit of zoning or regionalization incentive (incentivo por regionalización), within a term no greater than three months from the publication of this Regulation, regardless of whether some right assists them in accordance with the previous rules, must provide a sworn statement by themselves and a declaration of their domicile to the Human Resources Department, which must have been signed and sealed by the competent authority of their territorial circumscription. The Human Resources Department shall suppress ex officio the zoning of those officials who, on the date of entry into force of this Regulation, were enjoying it, if they fail to comply with the provisions herein.
Transitional II.-The Commission shall be formed and sworn in within fifteen working days, after publication of this Regulation and within the two following calendar months after its formation, it shall dictate, in the case it is required, the other rules for its operation. Reglamento de Zonaje e Incentivo por Regionalizaciónde los funcionarios del Ministerio de Agricultura y Ganadería
Considerando:
DECRETAN:
El reconocimiento de pago de zonaje o de incentivo por regionalización se hará mediante Acción de Personal (P-21) por el Departamento de Recursos Humanos del MAG. Toda variante posterior que produzca modificaciones en el monto del beneficio otorgado, deberá ser comunicado por el Director Nacional o Director Regional respectivo al Departamento de Recursos Humanos, en forma escrita en un plazo no mayor de ocho días hábiles, al conocimiento de tales hechos o condiciones, de lo contrario podrá hacerse acreedor a las consecuencias disciplinarias o civiles, que dicha omisión ocasionare. Asimismo a la persona que se le hubieren girado sumas de más sin corresponderle, deberá reembolsarlas a los recursos del Ministerio (Estado).
Si el funcionario posteriormente traslada su núcleo familiar a vivir consigo y por ende varia su domicilio legal, se le deberá reajustar el zonaje a incentivo por regionalización.
Cada representante propietario deberá contar con su respectivo suplente. Los miembros integrantes de la Comisión durarán en sus cargos dos años.
Harán quórum para sesionar cuatro de sus miembros. El Departamento de Recursos Humanos proveerá el soporte secretarial a dicha Comisión.
La Administración concederá licencia con goce de salario a los miembros de la Comisión, durante el tiempo que se requiera para cumplir sus funciones.
En el caso de que se requiera un tiempo mayor deberá comunicarlo a las partes, con ocho días de anticipación, pudiendo prorrogarse dicho plazo por una sola vez a decisión de la Comisión por un máximo de 15 días naturales.
El beneficio de habitar casa o departamento facilitado o arrendado por cuenta del Ministerio, se estima en:
% a) Apartamento o casa en forma individual 60 b) Apartamento o casa compartida por dos servidores 40 c) Apartamento o casa compartida por tres servidores 25 d) Apartamento o casa compartida por más de tres servidores 15 El importe de este beneficio se deducirá de la suma de zonaje que corresponde según el artículo siguiente.

El Departamento de Recursos Humanos suprimirá de oficio el zonaje de aquellos funcionarios que a la fecha de entrada en vigencia del presente Reglamento lo estuvieren disfrutando, si incumplieren lo aquí dispuesto.
