Complete Text of record: F36D4 Nº 31449-MINAE Nº 31449-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF THE ENVIRONMENT AND ENERGY In exercise of the powers conferred by Article 140, subsections 3) and 18) and 146 of the Wildlife Conservation Law (Ley de Conservación de la Vida Silvestre) N° 7317 dated October 30, 1992, and Articles 6, 11, and 27 of the General Law of Public Administration (Ley General de la Administración Pública).

1. 1That it is in the Government's interest to strengthen administrative structures in the field of natural resources, in order to have defined policies that guarantee the rational use of said resources.
2. 2That the corporation (sociedad) named Santuario Ecológico Vela Mar S. A., legal entity number three - one hundred one - one hundred fifty-seven thousand six hundred ninety-one, represented by Mr. Marco Aurelio Herrera Parrales, of legal age, married once, businessman, resident of Tres Ríos, holder of identity card number two - one hundred ninety-nine - eight hundred sixty-six, who is its President with powers of general unrestricted attorney-in-fact (apoderado generalísimo) without limit of sum, being able to act separately, legal representation (personería) registered in the Mercantile Section of the Public Registry, at volume eight hundred thirty-nine, folio one hundred forty-six, entry two hundred twenty-three, is the owner of two properties (inmuebles) registered in the Public Registry: 1) Real Folio Registration number one hundred twelve thousand three hundred ninety-seven - zero zero zero, which according to the Registry is lot A, mountain and pasture land (terreno de montaña y repastos) with a house, located in the third district which is Sierpe, fifth canton which is Osa, of the province of Puntarenas, bounded on the north by public road; south, Instituto de Desarrollo Rural(*) and Concepción Pérez Pérez; east, Sérvulo Sandoval Mata; and west, road and Santuario Ecológico Vela Mar Sociedad Anónima; it measures: two million three hundred forty-four thousand seven hundred fifty-seven square meters and eighty-eight square decimeters (metros con ochenta y ocho decímetros cuadrados); property represented by cadastral map (plano catastrado) number P- two hundred sixty thousand five hundred seventy-eight - one thousand nine hundred ninety-five. 2) Real Folio Registration number one hundred twelve thousand three hundred ninety-eight - zero zero zero, which according to the Registry is lot B, pasture land (terreno de potrero), located in the third district which is Sierpe, fifth canton which is Osa, of the province of Puntarenas, bounded on the north by Mario Jiménez Roig and Mario González González and Municipalidad de Osa; south, road; east, road; and west, Santuario Ecológico Vela Mar Sociedad Anónima; it measures five hundred forty-six thousand sixty-nine square meters and twenty-three square decimeters (metros con veintitrés decímetros cuadrados), property represented by cadastral map number P- two hundred fifty-six thousand eight hundred seventeen - one thousand nine hundred ninety-five.

1. 3That the area described above constitutes a very important nucleus for the conservation of Wildlife (Vida Silvestre), within the management category of Private Wildlife Refuge (Refugio de Vida Silvestre Privado). That as forests and wildlife species continue to disappear from our planet, this management category allows for their conservation and management within a framework of sustainable development, simultaneously serving as an environmental regulator, through the implementation of a Management Plan (Plan de Manejo).
2. 4That due to the current state of the natural resources of the region, the national opening towards the protection of wild areas, and the biodiversity of said region, it proves to be a very fragile area, its preservation being necessary.
3. 5That after having conducted an inspection visit to the area intended to be subjected to the Private Wildlife Refuge (Refugio de Vida Silvestre Privado) status, it was concluded that said site holds great ecological and biodiversity importance, as it is located within the Golfo Dulce Forest Reserve (Reserva Forestal Golfo Dulce) and also forms part of the Osa Biological Corridor (Corredor Biológico de Osa), where there is a relationship with the migration or distribution of species that have a wide range of action for their survival. Likewise, it is located in one of the few sites where ecosystems such as the Boca Ganado mangrove swamp (manglar), wetlands (humedales), and forest ecosystems (ecosistemas boscosos) with different stages of ecological development and extensive biodiversity converge.
4. 6That by means of resolution ACOSA-D-07, at fifteen hundred hours on March third, two thousand three, the Directorate of the Osa Conservation Area (Área de Conservación Osa), accepted the request for voluntary submission made by the Representative of the Santuario Ecológico Vela Mar S.A. Corporation (Sociedad), to voluntarily submit to Wildlife Refuge (Refugio de Vida Silvestre) Private Category. Therefore:

1. 1Que es interés del Gobierno fortalecer las estructuras administrativas en el campo de los recursos naturales, a fin de contar con políticas definidas que garanticen el uso racional de dichos recursos.
2. 2Que la sociedad denominada Santuario Ecológico Vela Mar S. A. cédula de persona jurídica número tres - ciento uno - ciento cincuenta y siete mil seiscientos noventa y uno, representada por el señor Marco Aurelio Herrera Parrales, mayor, casado una vez, empresario, vecino de Tres Ríos, portador de la cédula de identidad número dos - ciento noventa y nueve - ochocientos sesenta y seis, quien es su Presidente con facultades de apoderado generalísimo sin límite de suma, pudiendo actuar en forma separada, personería inscrita en la Sección Mercantil del Registro Público, al tomo ochocientos treinta y nueve, folio ciento cuarenta y seis, asiento doscientos veintitrés, es propietaria de dos inmuebles inscritos en el Registro Público: 1) Folio Real Matrícula número ciento doce mil trescientos noventa y siete - cero cero cero, que según Registro es lote A terreno de montaña y repastos con una casa, situado en el distrito tercero que es Sierpe, cantón quinto que es Osa, de la provincia de Puntarenas, linda al norte, camino público; al sur, Instituto de Desarrollo Rural(*) y Concepción Pérez Pérez; al este, Sérvulo Sandoval Mata, y al oeste, camino y Santuario Ecológico Vela Mar Sociedad Anónima, mide: dos millones trescientos cuarenta y cuatro mil setecientos cincuenta y siete metros con ochenta y ocho decímetros cuadrados; inmueble que se representa mediante plano catastrado número P- doscientos sesenta mil quinientos setenta y ocho - mil novecientos noventa y cinco. 2) Folio Real Matrícula número ciento doce mil trescientos noventa y ocho - cero cero cero, que según Registro es lote B terreno de potrero, situado en el distrito tercero que es Sierpe, cantón quinto que es Osa, de la provincia de Puntarenas, colinda al norte, Mario Jiménez Roig y Mario González González y Municipalidad de Osa; al sur, camino; al este, camino, y al oeste, Santuario Ecológico Vela Mar Sociedad Anónima, mide quinientos cuarenta y seis mil sesenta y nueve metros con veintitrés decímetros cuadrados, inmueble representado mediante plano catastrado número P-doscientos cincuenta y seis mil ochocientos diecisiete - mil novecientos noventa y cinco.

1. 3Que el área antes descrita constituye un núcleo muy importante para la conservación de la Vida Silvestre, dentro de la categoría de manejo de Refugio de Vida Silvestre Privado. Que por continuar desapareciendo de nuestro planeta los bosques y las especies de vida silvestre esta categoría de manejo permite conservarlas y manejarlas dentro de un desarrollo sostenible sirviendo a la vez como regulador ambiental, mediante la implementación de un Plan de Manejo.
2. 4Que debido al estado actual de los recursos naturales de la región, y a la apertura nacional hacia la protección de las áreas silvestres, y a la biodiversidad de dicha región resulta ser un área muy frágil, siendo necesaria su preservación.
3. 5Que luego de haberse realizado visita de inspección al área que se pretende someter a Refugio de Vida Silvestre Privado, se llegó a la conclusión que dicho sitio es de mucha importancia ecológica y de biodiversidad, al encontrarse dentro de la Reserva Forestal Golfo Dulce y además formar parte del Corredor Biológico de Osa, donde existe una relación con la migración o distribución de especies que tienen un amplio espacio de acción para su sobreviviencia. Asimismo, se encuentra en uno de los pocos sitios donde confluyen ecosistemas como el manglar de Boca Ganado, humedales y ecosistemas boscosos con diferentes estadio de desarrollo ecológico y de amplia biodiversidad.
4. 6Que por medio de la resolución ACOSA-D-07, de las quince horas del tres de marzo del dos mil tres, la Dirección del Área de Conservación Osa, aceptó la solicitud de sometimiento voluntario que realizó el Representante de la Sociedad Santuario Ecológico Vela Mar S.A., para someterse voluntariamente a Refugio de Vida Silvestre Categoría Privado. Por tanto:
