in the entirety of the text - Complete Text of Norm 31401 Declares of Public Utility for the interests of the State the Rural Water Association La Lucha-La Vega de San Carlos Complete Text acta: 17A703 Nº 31401-J Nº 31401-J (This executive decree was repealed by article 1 of executive decree N° 45182 of July 30, 2025) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF JUSTICE AND GRACE Based on the provisions of articles 140, subsection 18), and 146 of the Political Constitution, article 32 of the Law of Associations and articles 27 and following of its Regulations.

I.-That article 32 of the Law of Associations Nº 218 of August eight, nineteen thirty-nine and its amendments, grants the Executive Branch the power to declare of Public Utility simple, federated, or confederated Associations, whose development and activities are particularly useful for the interests of the State, and that thereby contribute to solving a social need.

II.-That the Rural Water Association La Lucha-La Vega de San Carlos, legal entity identification number Nº 3-002-254101, was registered in the Registry of Associations of the Public Registry on November two, nineteen ninety-nine, under case file number 11639.

III.-That among the purposes pursued by the Association are the following: "a) Build a Water System in La Lucha de la Tigra de San Carlos, fifty meters north of the school, province of Alajuela. b) Administer, operate, and maintain in good condition the water system, in accordance with the provisions and Regulations issued on the matter by Acueductos y Alcantarillados. c) Obtain the effective participation of the community in the construction and maintenance of the water system. d) Collaborate with educational programs and campaigns that are undertaken. e) Help explain and disseminate in the community the provisions and regulations of Acueductos y Alcantarillados. f) Cooperate with the plans and works undertaken by Acueductos y Alcantarillados in the community. g) Participate in the surveillance and protection of the water system's supply sources, prevent their contamination, and help protect the hydrographic basins of the region." IV.-That such purposes solve a social need of the highest order, such as the supply of drinking water to the benefiting communities, for which they deserve the support of the Costa Rican State. Therefore:

I.-Que el artículo 32 de la Ley de Asociaciones Nº 218 de ocho de agosto de mil novecientos treinta y nueve y sus reformas, confiere al Poder Ejecutivo la potestad de declarar de Utilidad Pública a las Asociaciones simples, federadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los intereses del Estado, y que por ello contribuyan a solventar una necesidad social.

II.-Que la Asociación de Acueducto Rural La Lucha-La Vega de San Carlos, cédula de persona jurídica Nº 3-002-254101 se inscribió en el Registro de Asociaciones del Registro Público desde el día dos de noviembre de mil novecientos noventa y nueve, bajo el expediente número 11639.

III.-Que entre los fines que persigue la Asociación se encuentran los siguientes: "a) Construir un Acueducto en la Lucha de la Tigra de San Carlos, cincuenta metros al norte de la escuela, provincia de Alajuela. b) Administrar, operar y conservar en buenas condiciones el acueducto, de acuerdo con las disposiciones y Reglamentos que al respecto emita Acueductos y Alcantarillados. c) Obtener la participación efectiva de la comunidad, en la construcción y mantenimiento del acueducto. d) Colaborar con los programas y campañas de índole educativas que se emprendan. e) Ayudar a explicar y divulgar en la comunidad las disposiciones y reglamentos de Acueductos y Alcantarillados. f) Cooperar con los planes y obras que emprende Acueductos y Alcantarillados en la comunidad. g) Participar en la vigilancia y protección de las fuentes de abastecimiento del acueducto, evitar las contaminaciones de las mismas y ayudar a la protección de las cuencas hidrográficas de la región." IV.-Que tales fines solventan una necesidad social de primer orden, como lo es el suministro de agua potable a las comunidades que beneficia, por lo cual merecen el apoyo del Estado Costarricense. Por tanto:
