Complete Text of proceeding: EEB6C Nº 31397-MINAE Nº 31397-MINAE (This decree was repealed by Article 18 of Executive Decree N° 37480 of January 9, 2013, "Declares the national strategy for integrated fire management in Costa Rica and its National Action Plan, ratifies the National Commission on Forest Fires (CONIFOR) and creates the National Program for Integrated Fire Management, the COTENA, CENMIF, of the National System of Conservation Areas") THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Exercising the powers conferred in Article 50 and subsections 3) and 18) of Article 140 and 146 of the Political Constitution.

1That it is the duty of the State and of civil society to ensure the protection of natural resources and to establish the corresponding preventive measures to avoid their deterioration.
2That Executive Decree Nº 21859-MIRENEM, dated December 7, 1992, published on February 8, 1993, created the Committee against Fires Guanacaste, as the coordinating, support, and monitoring body for the Forest Fire Program for the Chorotega Region, this being the body that has coordinated inter-institutional, public, and private actions to prevent and control forest and agricultural fires in the Chorotega Region.
3That in the province of Guanacaste and the districts of Paquera, Lepanto, and Cóbano in the province of Puntarenas, 70% of the area affected by the forest and agricultural fires that occur each year in the country is recorded, which are considered the fundamental cause of the deterioration of the environment, causing extensive and irreparable losses to diverse resources.
4That Article 35 of the Forestry Law (Ley Forestal) Nº 7575, declares all actions undertaken for the purpose of preventing and extinguishing forest fires to be of public interest, and that it is the responsibility of the State Forest Administration (Administración Forestal del Estado) to order and channel actions aimed at preventing such fires.
5That through Executive Decree Nº 29149-MINAE, dated November 13, 2000, published on December 13, 2000, the National Fire Management Strategy in Costa Rica 2000-2005 (Estrategia Nacional Manejo del Fuego en Costa Rica 2000- 2005) is declared, as the official instrument for planning, control, and monitoring in this matter, and in which the directives and guidelines to be developed in the country are established.
6That the National Commission on Forest Fires (CONIFOR) exists, in force by Executive Decree Nº 29149-MINAE, published on December 13, 2000, which requires the execution of actions that demand close management and coordination in each region among the parties involved, as well as a national body, in order to strengthen the actions that have been undertaken.
7That to strengthen the actions developed to date in the country and mainly in Guanacaste and the districts of Paquera, Lepanto, and Cóbano, in the province of Puntarenas, it is necessary to establish the national body in this zone, in accordance with current conditions. Therefore:

THEY DECREE:

Considering:

The CENAINFO will be the body for management, coordination, supervision, and execution of the National Fire Management Program (Programa Nacional para el Manejo del Fuego) in compliance with the provisions of the National Commission on Forest Fires (Comisión Nacional sobre Incendios Forestales) and the National Fire Management Strategy in Costa Rica (Estrategia Nacional Manejo del Fuego en Costa Rica). It shall be the responsibility of the CENAINFO to support and strengthen coordination efforts with the different Centers for Forest Fire Response that exist in the country.

Its coverage will encompass the territories comprised by the Arenal-Tempisque Conservation Area (Área de Conservación Arenal-Tempisque), the Guanacaste Conservation Area (Área de Conservación Guanacaste), and the Tempisque Conservation Area (Área de Conservación Tempisque).

The CAIFOGUA will be a body attached to the CENAINFO and will be governed by the provisions of the National Fire Management Strategy in Costa Rica 2000-2005 (Estrategia Nacional Manejo del Fuego en Costa Rica 2000-2005) or, failing that, by what legally applies.

The directors of the Arenal-Tempisque, Guanacaste, and Tempisque Conservation Areas, Ministry of Agriculture and Livestock (Ministerio de Agricultura y Ganadería), Ministry of Public Security (Ministerio de Seguridad Pública), Ministry of Public Education (Ministerio de Educación Pública), National Insurance Institute (Instituto Nacional de Seguros), National Commission for Risk Prevention and Emergency Response (Comisión Nacional de Prevención del Riesgo y Atención de Emergencias), Costa Rican Electricity Institute (Instituto Costarricense de Electricidad), Costa Rican Institute of Aqueducts and Sewers (Instituto Costarricense de Acueductos y Alcantarillados), Institute of Agricultural Development (Instituto de Desarrollo Agrario). Each of the indicated institutions shall designate and notify the General Directorate of SINAC, within a period of no more than three months, of the appointment of its representatives, who must be officials assigned to the region and with coordination authority within their institution's structure.

This Commission shall be organized by an executive secretary, three directors, an inspector's office (fiscalía), and the remaining members (vocales). The position of coordinator shall be held by the representative of the General Directorate of the National System of Conservation Areas (Dirección General del Sistema Nacional de Áreas de Conservación).

a)To elect and be elected to the respective positions.
b)To actively participate and support the development of fire management actions in the region, maintaining in effect the directives and guidelines of the CAIFOGUA.
c)To participate with voice and vote in ordinary or extraordinary meetings.
d)To report to the inspector's office (fiscalía), corresponding administrative or judicial body, any irregularity that they notice in the performance of the duties of the members or bodies of the CAIFOGUA.
e)To ensure the effective flow of information.
f)To undertake the corresponding steps before the institution they represent for the fulfillment of the plans, programs, actions, or activities defined by the CAIFOGUA, in coordination with the respective representative before the CONIFOR.

a)To be a facilitating, coordinating, and supervising entity that provides support to the institutions and organizations assigned to the region and that make efforts to address the issue generated by forest and agricultural fires.
b)The CAIFOGUA is based on the participation and commitment of the institutions and organizations.
c)The CAIFOGUA seeks and promotes the participation of community organizations and recognizes spaces for the participation of men and women representing civil society.
d)The CAIFOGUA is part of the national structure for fire management and addresses the issue of fires from the perspective of environmental conservation and sustainable development.

a)To achieve the participation of civil society, State institutions, and private organizations linked to the conservation of natural resources in the prevention and control of forest and agricultural fires in the region.
b)To increase knowledge about the different factors and processes that interact in the issue of forest fires in the region.
c)To promote the formulation and transformation of regional policies regarding fire management (manejo del fuego).

On the other hand, the basic activities to develop will focus on the following six aspects:

a)Strengthening of the organization.
b)Resource management.
c)Strengthening community participation through forest fire-fighting brigades (brigadas contra incendios forestales).
d)Research.
e)Influence on the political and legal framework.
f)Coordination of the Regional Fire Management Program.

Likewise, each of the public or private institutions or organizations is empowered to assign technical, human, or economic resources according to their possibilities, in such a way that they can contribute to the achievement of the objectives, plans, and programs of the CAIFOGUA.

1Que es deber del Estado y de la sociedad civil velar por la protección de los recursos naturales y establecer las medidas preventivas que correspondan para evitar el deterioro de los mismos.
2Que el Decreto Ejecutivo Nº 21859-MIRENEM, de fecha 7 de diciembre de 1992, publicado el 8 de febrero de 1993, creó el Comité contra Incendios Guanacaste, como la instancia de coordinación, apoyo y seguimiento del Programa de Incendios Forestales para la Región Chorotega, siendo este el organismo que ha coordinado acciones interinstitucionales, públicas y privadas, para prevenir y controlar los incendios forestales y agrícolas en la Región Chorotega.
3Que en la provincia de Guanacaste y los distritos de Paquera, Lepanto y Cóbano de la provincia de Puntarenas, se registra el 70% del área afectada por los incendios forestales y agrícolas, que se presentan cada año en el país, los cuales se consideran como la causa fundamental de deterioro del ambiente, provocando cuantiosas e irreparables pérdidas a diversos recursos.
4Que el artículo 35 de la Ley Forestal Nº 7575, declara de interés público todas las acciones que se emprendan, con el fin de prevenir y extinguir los incendios forestales, así como que le corresponde a la Administración Forestal del Estado ordenar y encausar las acciones tendientes a prevenir esos incendios.
5Que mediante Decreto Ejecutivo Nº 29149-MINAE, de fecha 13 de noviembre del 2000 publicado el 13 de diciembre del 2000, se declara la Estrategia Nacional Manejo del Fuego en Costa Rica 2000- 2005, como el instrumento oficial de planificación, control y seguimiento en esta materia y en la que se establecen las directrices y lineamientos a desarrollar en el país.
6Que existe la Comisión Nacional sobre Incendios Forestales (CONIFOR), vigente por el Decreto Ejecutivo Nº 29149-MINAE, publicado el 13 de diciembre del 2000, la cual requiere la ejecución de acciones que demandan de una estrecha gestión y coordinación en cada región entre las partes involucradas, así como de una instancia nacional, a efecto de fortalecer las acciones que se han venido desarrollando.
7Que para fortalecer las acciones desarrolladas hasta la fecha en el país y principalmente en Guanacaste y los distritos de Paquera, Lepanto y Cóbano, de la provincia de Puntarenas, se hace necesario establecer la instancia nacional en esta zona, acorde a las condiciones actuales. Por tanto:

Considerando:

DECRETAN:

El CENAINFO será la instancia de gestión, coordinación, supervisión y ejecución del Programa Nacional para el Manejo del Fuego en cumplimiento con lo dispuesto por la Comisión Nacional sobre Incendios Forestales y la Estrategia Nacional Manejo del Fuego en Costa Rica. Será responsabilidad del CENAINFO apoyar y fortalecer las acciones de coordinación con los diferentes Centros para la Atención de Incendios Forestales que existan en el país.

Su cobertura abarcará los territorios comprendidos por el Área de Conservación Arenal-Tempisque, Área de Conservación Guanacaste y el Área de Conservación Tempisque.

El CAIFOGUA será una instancia adscrita al CENAINFO y se enmarcará por lo establecido en la Estrategia Nacional Manejo del Fuego en Costa Rica 2000-2005 o en su defecto por lo que legalmente corresponda.

Los directores de las Áreas de Conservación Arenal-Tempisque, Guanacote y Tempisque, Ministerio de Agricultura y Ganadería, Ministerio de Seguridad Pública, Ministerio de Educación Pública, Instituto Nacional de Seguros, Comisión Nacional de Prevención del Riesgo y Atención de Emergencias, Instituto Costarricense de Electricidad, Instituto Costarricense de Acueductos y Alcantarillados, Instituto de Desarrollo Agrario. Cada de una de las instituciones señaladas designará y notificará ante la Dirección General del SINAC y en un plazo no mayor de tres meses, el nombramiento de sus representantes, los cuales deben ser funcionarios destacados en la región y con facultades de coordinación dentro de la estructura de su institución.

Esta Comisión estará organizada por una secretaría ejecutiva, tres directores, una fiscalía y los restantes vocales. El cargo de coordinador lo ocupará el representante de la Dirección General del Sistema Nacional de Áreas de Conservación.

a)Elegir y ser electos en los cargos respectivos.
b)Participar y apoyar activamente en el desarrollo de acciones sobre manejo del fuego en la región, manteniendo en función las directrices y lineamientos del CAIFOGUA.
c)Participar con voz y voto en las reuniones ordinarias o extraordinarias.
d)Denunciar ante la fiscalía, ente administrativo o judicial correspondiente, cualquier irregularidad que notare en el desempeño de las funciones de los miembros u órganos del CAIFOGUA.
e)Velar por el flujo efectivo de la información.
f)Realizar las gestiones correspondientes ante la institución que representa para el cumplimiento de los planes, programas, acciones o actividades definidas por el CAIFOGUA, en coordinación con el representante respectivo ante la CONIFOR.

a)Ser un ente facilitador, coordinador y supervisor que brinda apoyo a las instituciones y organizaciones destacadas en la región y que realizan esfuerzos para atender la problemática generarada por los incendios forestales y agrícolas.
b)El CAIFOGUA se apoya en la participación y el compromiso de las instituciones y organizaciones.
c)El CAIFOGUA busca y promueve la participación de las organizaciones comunitarias y reconoce los espacios para la participación de hombres y mujeres representantes de la sociedad civil.
d)El CAIFOGUA es parte de la estructura nacional para el manejo del fuego y atiende la problemática de los incendios desde la perspectiva de conservación del ambiente y el desarrollo sostenible.

a)Lograr la participación de la sociedad civil, las instituciones del Estado y organizaciones privadas vinculadas a la conservación de los recursos naturales en la prevención y control de los incendios forestales y agrícolas en la región.
b)Aumentar el conocimiento sobre los diferentes factores y procesos que interactúan en la problemática de los incendios forestales en la región.
c)Promover la formulación y transformación de políticas regionales con respecto al manejo del fuego.

Por otra parte, las actividades básicas a desarrollar se centrarán en los siguientes seis aspectos:

a)Fortalecimiento de la organización.
b)Gestión de recursos.
c)Fortalecimiento de la participación comunitaria por medio de las brigadas contra incendios forestales.
d)Investigación.
e)Incidencia en el marco político y legal.
f)Coordinación del Programa Regional para el Manejo del Fuego.

Así mismo se faculta a cada una de las instituciones u organizaciones públicas o privadas, para asignar los recursos técnicos, humanos o económicos de acuerdo a sus posibilidades, de tal forma que puedan contribuir con el logro de los objetivos, planes y programas del CAIFOGUA.

Artículo 1 — The National Center for Forest Fire Response (CENAINFO) is created, administratively attached to the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación) of the Ministry of Environment and Energy.

Artículo 4 — The Regional Inter-Institutional Commission shall meet at least once a month and extraordinarily when necessary, convened by the coordinator or the inspector (fiscal).

Artículo 5 — The rights and duties of the members of the Regional Inter-Institutional Commission are as follows:

Artículo 6 — The mission of the CAIFOGUA is to develop the technical capacity allowing it to resolve the regional issue of forest and agricultural fires.

Artículo 7 — For the execution of its actions, the CAIFOGUA shall be governed by the following guidelines:

Artículo 8 — The general objectives of the CAIFOGUA are the following:

Artículo 9 — To achieve its purposes and fulfill its guidelines and objectives, the CAIFOGUA must coordinate and develop actions in three strategic programmatic areas: organization, prevention, and operations.

Artículo 10 — To obtain resources, the CAIFOGUA is empowered to undertake the necessary steps allowing it to fulfill its objectives.

Artículo 11 — Executive Decree Nº 21859- MIRENEM is repealed, dated December 7, 1992, published in La Gaceta Nº 26 on February 8, 1993.

Artículo 12 — It shall be effective upon its publication and repeals any other provisions that oppose it.

Artículo 1 — Créase el Centro Nacional para La Atención de Incendios Forestales (CENAINFO), adscrito administrativamente al Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía.

Artículo 4 — La Comisión Regional Interinstitucional se reunirá al menos una vez al mes y extraordinariamente cuando sea necesario, convocada por el coordinador o el fiscal.

Artículo 5 — Son derechos y deberes de los miembros de la Comisión Regional Interinstitucional los siguientes:

Artículo 6 — La misión del CAIFOGUA es desarrollar la capacidad técnica que le permita resolver la problemática regional de los incendios forestales y agrícolas.

Artículo 7 — Para la ejecución de sus acciones el CAIFOGUA se regirá por los siguientes lineamientos:

Artículo 9 — Par la consecución de sus fines y el cumplimiento de sus lineamientos y objetivos, el CAIFOGUA, deberá coordinar y desarrollar acciones en tres áreas estratégicas programáticas: organización, prevención y operaciones.

Artículo 10 — Para la consecución de los recursos se faculta al CAIFOGUA para realizar las gestiones necesarias que le permitan el cumplimiento de sus objetivos.

Artículo 11 — Deróguese el Decreto Ejecutivo Nº 21859- MIRENEM, de fecha 7 de diciembre de 1992, publicado en La Gaceta Nº 26 del 8 de febrero de 1993.

Artículo 12 — Rige a partir de su publicación y deroga cualesquiera otras disposiciones que se le opongan.
