Complete Text of record: 6DF1E N° 28704-MINAE N° 28704-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In use of the powers conferred in subsections 3) and 18) of article 140 of the Political Constitution.

1That in the month of October, on the occasion of the celebration of the Tenth Anniversary of the creation of the Constitutional Chamber (Sala Constitucional), Dr. Ramón Ojeda Mestre, Secretary General of the International Court, visited the country, and during the visit he made to the President of the Republic, he referred to the possibility that the Government of Costa Rica would present its candidacy to host the "World Congress on Environmental Law and Policy" to be held in the month of January of the year 2001, whose general objective is to foster deep reflection, through a respectable group of global personalities, in the political and legal sphere, on the perspectives of the environment on the most complex issues of the future at the start of the new era.
2That on November 8, 1999, the Second Vice Presidency of the Republic and the Ministry of Environment and Energy presented before the International Court of Environmental Arbitration and Conciliation, the Official Candidacy of Costa Rica, for the purpose of assuming the hosting and organization of the World Congress "World Congress on Environmental Law and Policy", to be held from January 8 to 11, 2001.
3That after analyzing the proposal presented by Costa Rica, the International Court resolved it affirmatively, considering that our country has developed a series of participatory and innovative mechanisms, aimed at protecting the environment, which has been recognized internationally.
4That in accordance with previous experiences in events of this nature, in its organization and financing, participation must be given to Non-Governmental Organizations linked to the fields of the Environment and Law, who will be largely responsible for procuring economic support for this activity, making it necessary then to identify the organization that will receive those funds and to foresee the existence of a transparent financial mechanism, such as the figure of the Trust, to ensure their timely and correct use.
5That Costa Rica, in its capacity as host of the World Congress, will be declared the World Capital of the Environment from January 8 to 11, 2001. Therefore,

Whereas:

Decree:

a)To rescue the extragovernmental thinking of the most lucid minds in the world, in the political and legal sphere, on the perspectives of the environment on the most complex issues of the future at the start of the new era.
b)To create an original and balanced response to the environmental issue, taking into consideration the demands of Humanity for the new millennium.

To gather in a single document the contributions of the highest personalities, as well as the conclusions reached by the World Congress, to distribute it to Governments, International Organizations, Universities, and Forums, to contribute to environmental thinking.

c)To revitalize the channels of Law for the achievement of environmental objectives and to decisively stimulate the active participation of young legal professionals in their diverse disciplines.

d)Of Public Security and Government.
e)Costa Rican Tourism Institute.

To do so, they must have resources for this type of activity and comply with the established procedures for the transfer of funds.

Texto Completo acta: 6DF1E N° 28704-MINAE N° 28704-MINAE EL PRESIDENTE DE LA REPÚBLICA Y LA MINISTRA DEL AMBIENTE Y ENERGÍA En uso de las facultades conferidas en los incisos 3) y 18) del artículo 140 de la Constitución Política.

1Que en el mes de octubre con motivo de la celebración del Décimo Aniversario de creación de la Sala Constitucional, visitó el país el Dr. Ramón Ojeda Mestre, Secretario General de la Corte Internacional, quien en la visita que realizara al señor Presidente de la República, se refirió a la posibilidad de que el Gobierno de Costa Rica presentara su candidatura para ser la sede del "Congreso Mundial de Derecho y Política Ambiental" que se celebrará en el mes de enero del año 2001 y cuyo objetivo general es propiciar una profunda reflexión, a través de un respetable grupo de personalidades mundiales, en el ámbito político y jurídico, acerca de las perspectivas del ambiente en los temas más complejos del futuro al iniciarse la nueva era.
2Que el 8 de noviembre de 1999 la Segunda Vicepresidencia de La República y el Ministerio del Ambiente y Energía presentaron ante la Corte Internacional de Arbitraje y Conciliación Ambiental, la Candidatura Oficial de Costa Rica, con el fin de asumir la sede y organización del Congreso Mundial " Congreso Mundial de Derecho y Política Ambiental", a efectuarse del 8 al 11 de enero del año 2001.
3Que la Corte Internacional después de analizar la propuesta presentada por Costa Rica, resolvió esta en forma afirmativa, al considerar que nuestro país ha desarrollado una serie de mecanismos participativos e innovadores, orientados a la protección del medio ambiente, lo cual ha sido reconocido a nivel internacional.
4Que acorde con experiencias anteriores en eventos de esta naturaleza, en su organización y financiamiento deberá darse participación a Organizaciones No Gubernamentales vinculadas a los campos del Ambiente y el Derecho, a las que les corresponderá en gran medida procurar el apoyo económico para esta actividad, siendo necesario entonces identificar a la organización que recibirá esos fondos y prever la existencia de un mecanismo financiero transparente, como es la figura del Fideicomiso, que asegure el uso oportuno y correcto de los mismos.
5Que Costa Rica en su calidad de sede del Congreso Mundial será declarada del 8 al 11 de enero del 2001 la Capital Mundial del Ambiente. Por tanto,

Considerando:

Decretan:

a)Rescatar el pensamiento extragubernamental de las mentes más lúcidas del mundo, en el ámbito político y jurídico, sobre las perspectivas del ambiente en los temas más complejos del futuro al iniciarse la nueva era.
b)Crear una respuesta original y equilibrada del tema ambiental tomando en consideración las exigencias de la Humanidad para el nuevo milenio.

Reunir en un único documento los aportes de las más altas personalidades, así como las conclusiones a que llegue el Congreso Mundial, para distribuirlo a los Gobiernos, Organismos Internacionales, Universidades y Foros, para contribuir al pensamiento del ambiente.

c)Revitalizar los cauces del Derecho para el logro de objetivos ambientales y estimular de manera decidida la participación activa de los jóvenes profesionales del Derecho en sus diversas disciplinas.

Artículo 1 — —To declare of public interest the celebration of the "World Congress on Environmental Law and Policy", which will take place in our country from January 8 to 11, 2001, and whose purpose is:

Artículo 2 — —To create the Organizing Commission whose purpose will be to support and advise the Ministry of Environment and Energy in the organization of the Congress, which will be composed of the following Ministers and Presidents of Autonomous Institutions or their representatives:

Artículo 4 — —In order to facilitate the organization of this event, the Ministry of Environment and Energy will provide an official from the Ministry of Environment and Energy as coordinator of the activities related to the Congress.

Artículo 5 — —The different State Institutions are urged to collaborate and contribute funds for this event.

Artículo 6 — —In order to finance the Congress, the National Parks Foundation may establish a Trust in one of the banks of the National Banking System, which will be responsible for the handling and administration of the funds allocated to this event.

Artículo 7 — —Effective as of its publication.

Artículo 4 — Con el fin de facilitar la organización de este evento el Ministerio del Ambiente y Energía, facilitará un funcionario del Ministerio del Ambiente y Energía como coordinador de las actividades relativas al Congreso.

Artículo 5 — Se insta a las diferentes Instituciones del Estado, a colaborar y aportar fondos para este evento.

Artículo 6 — Con el fin de financiar el Congreso, la Fundación de Parques Nacionales podrá establecer un Fideicomiso en uno de los bancos del Sistema Bancario Nacional, que se encargará del manejo y administración de los fondos que se destinen a este evento.

Artículo 7 — Rige a partir de su publicación.
