Full Text of record: 6DD3E No. AJDIP/386 No. AJDIP/386.—Puntarenas, on the twelfth day of September, two thousand three.

1. 1That this Board, in an effort to promote and guarantee the protection of the marine resources of the Golfo de Nicoya, adopted agreement AJDIP/318-2003, regulating closed seasons (vedas), determining restricted areas and species for the months of September and October 2003.
2. 2That the Defensoría de los Habitantes, in response to requests from certain fishermen affected by the aforementioned regulatory provision, suggested a modification to the Closed Season Agreement (Acuerdo de Vedas), providing the respective proposal, which was fully endorsed and supported by the Closed Season Commission (Comisión de Vedas).
3. 3That by reason of the foregoing, this Board considers it appropriate to modify subsections a) and b) of Article 3 of Closed Season Agreement No. AJDIP/318-2003, published in the Official Gazette La Gaceta No. 166, of August 29, 2003. Therefore:

Subsections a) and b) of Article 3 of agreement AJDIP/318-2003, published in the Official Gazette La Gaceta No. 166, of August 29, 2003, are hereby amended to read as follows:

"Article 3— a- During the period from October 1 to October 31, 2003, artisanal fishing (pesca artesanal) using any fishing gear, whether gillnet (trasmallo), line, or handline (cuerda de mano), is prohibited. This regulation applies to the area within an imaginary straight line running from Punta Torres (84°43´52´´W, 9°53´31´´N) to Punta Cuchillos (84º51´50´´W, 9º49´36´´N) and from there inland waters to the western end of said Gulf on the Península de Nicoya (mouth of the Río Tempisque).

b- During the period from September 12 to September 30 of the current year, the use of handlines (cuerdas de mano) will be permitted twenty-four hours a day, and the use of bottom longline (línea de fondo or Planera), the latter only during the day (from 6:00 a.m. to 6:00 p.m.), with a maximum of 100 hooks number 6 or smaller, both types of fishing gear in the area within an imaginary straight line running from the cruise ship pier of the City of Puntarenas (84º49´51´´W, 9º58´26´´N) to the place known as Punta Llorona (84º54´20´´W, 9º51´45´´N) and from there to the western end of said Gulf on the Península de Nicoya (mouth of the Río Tempisque).

1. 1Que esta Junta en aras de fomentar y garantizar la protección de los recursos marinos del Golfo de Nicoya, adoptó el acuerdo AJDIP/318- 2003, de regulación de vedas, determinando áreas y especies restringidas para los meses de setiembre y octubre del 2003.
2. 2Que la Defensoría de los Habitantes atendiendo solicitudes de ciertos pescadores afectados por la disposición normativa señalada, sugirió una modificación al Acuerdo de Vedas, aportando la respectiva propuesta, la cual fue avalada y apoya en pleno por la Comisión de Vedas.
3. 3Que en razón de lo anterior, esta Junta considera conveniente modificar los incisos a), y b), artículo 3º, del Acuerdo de Vedas Nº AJDIP/ 318-2003, publicado en el Diario Oficial La Gaceta Nº 166, del 29 de agosto del 2003. Por tanto:

Modifíquese los incisos a), y b), artículo 3º, del acuerdo AJDIP/318- 2003, publicado en el Diario Oficial La Gaceta Nº 166, del 29 de agosto del 2003, para que se lea de la siguiente manera: 2003, para que se lea de la siguiente manera:

"Artículo 3º- a- Durante el período comprendido del 1° de octubre al 31 de octubre del 2003, se prohíbe la pesca artesanal utilizando cualquier arte de pesca, sea el trasmallo, la línea y cuerda de mano. Esta regulación se aplica al área comprendida entre una línea recta imaginaria que va desde Punta Torres (84°43´52´´W, 9°53´31´´N) hasta Punta Cuchillos (84º51´50´´W , 9º49´36´´N) y de ahí aguas adentro hasta el extremo occidental de dicho Golfo en la Península de Nicoya (Desembocadura del Río Tempisque).

b- Durante el período comprendido del 12 de setiembre al 30 de setiembre del año en curso, se permitirá el uso de cuerdas de mano, durante las veinticuatro horas del día y la utilización de línea de fondo (Planera), únicamente de día esta última (de las 6:00 a las 18:00 horas), con un máximo de 100 anzuelos número 6 o inferior, ambos artes de pesca en la zona comprendida entre una línea recta imaginaria que va desde el muelle de cruceros de la Ciudad de Puntarenas (84º49´51´´W , 9º58´26´´N) hasta el lugar conocido como Punta Llorona (84º54´20´´W , 9º51´45´´N) y de ella hasta el extremo occidental de dicho Golfo en la Península de Nicoya (desembocadura del Río Tempisque).
