PRESIDENCY OF THE REPUBLIC THE FIRST VICE PRESIDENT EXERCISING THE PRESIDENCY OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred by Article 140, subsections 3) and 18) of the Political Constitution and in accordance with the provisions of Article 7 of the Wildlife Conservation Law No. 7317 of December 7, 1992, and Articles 32 and 38 of the Organic Environmental Law No. 7554 of November 13, 1995, the Forestry Law No. 7575, and Articles 6, 11, and 27 of the General Public Administration Law,
1. That it is in the government's interest to strengthen administrative structures in the area of natural resources, in order to have policies that guarantee the rational use of said resources.
2. That on April 17, 1998, Executive Decree No. 26824-MINAE was published, creating the Pejeperro National Wildlife Refuge (Refugio Nacional de Vida Silvestre Pejeperro), mixed category, in the Jiménez district of the Golfito canton in the province of Puntarenas, which includes the area comprising the maritime-terrestrial zone (zona marítimo terrestre) from the point located at 8º 24'17'' north latitude and 83º 22'02'' west longitude to the point located at 8º 22'49'' north latitude and 83º 22'49'' west longitude, according to the cartographic sheet of the Instituto Geográfico Nacional, Carate, scale 1:50,000. It includes the Pejeperro Lagoon in its entirety, as well as fifty meters of protection zone around it, and the properties of Mr. Trinidad Bellanero Sánchez, registered under the Folio Real System Nos. 6-36366-000 and 6-44353-000, delimited by cadastral plans Nos. P-353324-96 and P-408916-80. This process was carried out through a formal request by Mr. Bellanero.
3. That on February 15, 1999, Mr. Marvin Rodríguez Chavarría, a resident of Puerto Jiménez, holder of identification card No. 1-551-629, in his capacity as president of Agropepe, Sociedad Anónima, legal identification number No. 3-101-128835, submitted to the Director of the Osa Conservation Area (Area de Conservación Osa, ACOSA) the request to add his property to the Refuge. This property is under the Folio Real System No. 6-094570-000 and the cadastral plan is No. P-317730-78, and it measures 71 ha, 5,592 m², and 38 dm².
4. That Agropepe, S.A., submitted all administrative requirements and attached a management plan for the administration and protection of that sector of the refuge, and voluntarily agreed to join this Wildlife Protection Regime for the period corresponding to the Pejeperro National Wildlife Refuge. Likewise, the maritime-terrestrial zone with an area of 44 ha, 6,011 m², and 40 dm², which Agropepe holds under a concession from the Municipality of Golfito and which borders the Pejeperro Lagoon.
5. That some of the properties included within the refuge border the Maritime-Terrestrial Zone, which are state-owned, public domain, unattachable, and imprescriptible lands, therefore subject to a change in management category by the State.
6. That in the preliminary studies conducted by the administration in the area, the incorporation of the property into the protected wilderness area (área silvestre protegida) has been recommended for the protection of biodiversity, to provide opportunities for scientific research and recreation.
