Complete Text record: 68662 No. 31250 No. 31250 THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred upon them by Article 140, subsections 3) and 18) and 146 of the Political Constitution and section 6 of the General Law on Public Administration and Articles 3, subsection m), 19, subsection b), 33, and 34 of the Forest Law No. 7575 of February 13, 1996.
1st—That Article 19, subsection b) of the Forest Law No. 7575, despite establishing the prohibition of land-use change (cambio de uso del suelo) when in the presence of forest cover (cobertura boscosa), permits such change of use when it involves infrastructure works carried out by the State. 2nd—That Article 3, subsection m) of the Forest Law No. 7575 declares as activities of national convenience those carried out by centralized State agencies, autonomous institutions, or private companies, whose social benefits outweigh the socio-environmental costs. 3rd—That the efficient and timely supply of electrical services not only forms part of the government's policies for the country's development, but also leads to the improvement of citizens' quality of life. 4th—That the Constitutive Law of the Costa Rican Electricity Institute (Decreto Ley No. 449 of April 8, 1949), establishes, at the national level, the fundamental obligation to build new hydroelectric power plants. Likewise, it assigned the Institute the task of conserving and defending the country's hydraulic resources by protecting watersheds, sources, and the channels of rivers and water currents. 5th—That one of the main responsibilities of the Costa Rican Electricity Institute is the preparation of the National Electric System in electricity generation, transmission, and distribution. These plans, in addition to guaranteeing an adequate balance between electricity supply and demand, must comply with economic and environmental requirements. 6th—That the current Electricity Generation Expansion Plan of the Costa Rican Electricity Institute, prepared under the premise of minimizing the total cost for the country's economy, including investment and operation costs, while maintaining the reliability and robustness of the system, indicates the order for incorporating new plants into the national generation system to satisfy future electricity demand needs. According to this plan, the Pirrís Hydroelectric Project must be incorporated into the generation system in the year 2007. 7th—That the works of the Pirrís Hydroelectric Project are located in the provinces of San José, cantons 5 Tarrazú, 6 Aserrí, and 20 León Cortés (Caraigres Sheet of the National Geographic Institute, scale 1:50000) and Puntarenas, canton 9 Parrita (Quepos Sheet of the National Geographic Institute, scale 1:50000), works that need to be constructed within the protection areas of the Pirrís River and its tributaries (mainly in the Napoleón and Zapote streams). There exists the possibility that the cutting of forest species declared to be under a ban (veda) or in danger of extinction may be required. 8th—That in session No. 5388 of March 19, 2002, the Board of Directors of the Costa Rican Electricity Institute issued an environmental policy and a series of principles that establish, among other aspects, the duty to develop all activities under the philosophy of sustainable development and to apply the best practices that prevent, mitigate, restore, or compensate for environmental and social damages. 9th—That the Costa Rican Electricity Institute has facilities dedicated to the production of nurseries for tree species in danger of extinction, with the purpose of replacing those species that must be removed in the works carried out. In those cases where the replacement is carried out on land belonging to other institutions, the Costa Rican Electricity Institute shall also provide the authorization of the respective entity, in which it accepts the establishment of the plantation. The trees planted in accordance with Executive Decree No. 25700-MINAE may not be harvested by reason of being species on the verge of extinction or in danger of extinction.

En aquellos casos en que la reposición se realice en terrenos de otras instituciones, el Instituto Costarricense de Electricidad, aportará además la autorización del ente respectivo, en donde acepte el establecimiento de la plantación. Los árboles plantados de acuerdo al Decreto Ejecutivo Nº 25700-MINAE no podrán ser aprovechados en razón de ser especies en vías o peligro de extinción.
