7317, Wildlife Conservation Law (Ley de Conservación de la Vida Silvestre) establishes in article 47 that: "The release of fauna or flora obtained through seizures, scientific or cultural collection, or that which originates from scientific or cultural breeding farms and nurseries, from zoos and botanical gardens, may not be carried out without a scientific consultation that guarantees that they will not cause damage to the ecosystem in which they will be released".

7317 establishes that: "the import or export of fauna or flora included in Appendices I, II and III of the Convention on International Trade in Endangered Species of Wild Fauna and Flora shall not be permitted when the Scientific Authority verifies that said import or export is carried out to the detriment of national wild flora and fauna".

7317 establishes that: "The Executive Branch shall appoint one or several Scientific Authorities, whose function shall be to supply the scientific information necessary for the granting of permits or certificates for the import and export of wild flora and fauna".

27620-MINAE so that it reads as follows: "The following are designated as Scientific Authorities, in accordance with the provisions of article 74 of Law No. 7317, Wildlife Conservation Law (Ley de Conservación de la Vida Silvestre) and the Convention on International Trade in Endangered Species of Wild Fauna and Flora, the following institutions and entities, which shall issue scientific criteria, depending on the specialty of each institution and the criterion requested:

• a)Biology School (Escuela de Biología), the Lankester Garden (Jardín Lankester), the Clodomiro Picado Institute (Instituto Clodomiro Picado) and the Forest Products Laboratory of the Engineering Faculty of the University of Costa Rica.
• b)The Veterinary Medicine School (Escuela de Veterinaria), the Biological Sciences School (Escuela de Ciencias Biológicas) and the Regional Program in Wildlife Management for Mesoamerica and the Caribbean of the National University.
• c)The Forest Engineering Department of the Technological Institute of Costa Rica.
• d)The Biologists Association of Costa Rica (Colegio de Biólogos de Costa Rica).
• e)The Natural History Department of the National Museum of Costa Rica.
• f)The Pro-Zoological Foundation (Fundación Prozoológicos) while it administers the Simón Bolivar National Zoological Park and Botanical Garden (Parque Zoológico y Jardín Botánico Nacional Simón Bolivar).
• g)The Veterinary Medicine Association (Colegio de Médicos Veterinarios)-

The functions of the Council of Representatives of the Scientific Authorities shall be the following:

• a)To recommend that the import, export, and introduction from the sea of specimens of wild flora and fauna that are included in the CITES appendices does not pose any danger to national populations or will not harm their survival, and to exempt re-export certificates that do not require the advice of the Scientific Authority.
• b)To issue required opinions or formulate recommendations to the Administrative Authority, before it issues its opinion and issues permits or certificates, on the capacity of the recipient to house and properly care for live imported specimens of species included in Appendix I and those introduced from the sea.
• c)To monitor the status of populations and compile biological information on native species affected by trade and export data in order to recommend effective corrective measures, which limit the export of specimens in order to maintain them throughout their entire distribution area at a level consistent with the function they perform in the ecosystem or well above the level from which they could meet the requirements for inclusion in Appendix I.
• d)To inform the administrative authority whether or not the scientific institutions that request their registration in the Registry to obtain scientific exchange labels meet the criteria stated in Resolution 2.14 of the Conference of the Parties and in other more stringent national standards or requirements.
• e)That the opinions and advice for export permits for species that are included in the appendices be based on scientific analyses of the available information on the status, distribution, and population trends, the collection, and other biological and ecological factors as appropriate, and on the information on the trade of the species in question.
• f)To examine all applications submitted under paragraphs 4 and 5 of Article VII of the convention, and to inform the administrative authority whether the applicant establishment meets the criteria to produce specimens considered to be bred in captivity or artificially reproduced in accordance with the convention and the relevant resolutions.
• g)To compile and analyze information on the biological status of species affected by trade in order to facilitate the preparation of the necessary proposals to amend the appendices.
• h)To analyze the proposals for amending the appendices submitted by other parties and to formulate recommendations on the position that the national delegation should take on the matter.
• i)To issue a criterion regarding the proposals and projects for the reintroduction of wild flora and fauna species that are or are not included in the CITES appendices.
• j)To issue a criterion regarding the release throughout the national territory of animals from captive breeding, plants reproduced in nurseries, seizures, or voluntary surrender.
• k)To issue a criterion regarding applications for the extraction of wild flora and fauna species that are or are not included in the CITES appendices.
• l)To issue a criterion regarding the import and export of invasive and dangerous wild flora and wildlife fauna species.
• m)To analyze and issue a criterion regarding scientific research intended to be carried out with wild flora and fauna.

7317 establece que: "no se permitirá la importación o la exportación de la fauna o la flora comprendida en los apéndices I, II y III de la Convención sobre el Comercio Internacional de Especies Amenazadas de Fauna y Flora Silvestres, cuando la autoridad científica compruebe que esa importación o exportación se efectúa en detrimento de la flora y de la fauna silvestre nacionales".

7317 establece que: "Poder Ejecutivo nombrará una o varias autoridades científicas, cuya función será la de suministrar la información científica, necesaria para el otorgamiento de los permisos o de los certificados de importación y exportación de la flora y la fauna silvestres".

• b)La Escuela de Veterinaria, la Escuela de Ciencias Biológicas y el Programa Regional en Manejo de Vida Silvestre para Mesoamérica y del Caribe de la Universidad Nacional, e) El Departamento de Ingeniería Forestal del Instituto Tecnológico de Costa Rica.
• d)El Colegio de Biólogos de Costa Rica.
• e)El Departamento de Historia Natural del Museo Nacional de Costa Rica.
• f)La Fundación Prozoológicos mientras administra el Parque Zoológico y Jardín Botánico Nacional Simón Bolivar.
• g)El Colegio de Médicos Veterinarios-

Serán funciones del Consejo de Representantes de las Autoridades Científicas las siguientes:

• a)Recomendar que la importación, la exportación y la introducción procedente del mar, de especímenes de flora y fauna silvestre que se encuentran incluidas en los apéndices CITES, no significa ningún peligro para las poblaciones nacionales o perjudicaran o no la supervivencia de las mismas y exceptúan los certificados de reexportación que no requieren del asesoramiento de la Autoridad Científica.
• b)Emitir dictámenes requeridos o formular recomendaciones a la Autoridad Administrativa, antes de que ésta emita su dictamen y expida los permisos o certificados, sobre la capacidad del destinatario para albergar y cuidar adecuadamente especímenes, vivos importados de especies incluidas en el apéndice I y los introducidos procedentes del mar.
• c)Vigilar el estado de las poblaciones y recopilar información biológica de las especies nativas afectadas por el comercio y los datos sobre exportación a fin de recomendar medidas correctivas eficaces, que limiten la exportación de especímenes a fin de mantenerlas en toda su área de distribución en un nivel consistente con la función que se desempeña en el ecosistema o bien por encima del nivel a partir del cual podrían reunir los requisitos de inclusión en el apéndice I.
• d)Informar a la autoridad administrativa, si las instituciones científicas que solicitan su inscripción en el Registro para obtener etiquetas de intercambio científico, cumplen o no los criterios enunciados en la resolución 2,14 de la Conferencia de las Partes y en otras normas o prescripciones nacionales más estrictas.
• e)Que los dictámenes y asesoramientos para permisos de exportación de especies, que se encuentran incluidos en los apéndices se basen en análisis científicos de la información disponible sobre el estado, la distribución y las tendencias de la población, la recolección y otros factores biológicos y ecológicos según proceda y en la información sobre el comercio de las especies de que se trate.
• f)Examinar todas las solicitudes presentadas en virtud de los párrafos 4 y 5 del articulo VIl de la convención, e informar a la autoridad administrativa si el establecimiento solicitante cumple los criterios para producir especímenes que se consideren criados en cautividad o reproducidos artificialmente con arreglo a la convención y las resoluciones pertinentes.
• g)Compilar y analizar información sobre la situación biológica de las especies afectadas por el comercio a fin de facilitar la preparación de las propuestas necesarias para enmendar los apéndices.
• h)Analizar las propuestas de enmienda a los apéndices presentadas por otras partes y formular recomendaciones acerca de la posición que la delegación nacional deba asumir al respecto.
• i)Emitir criterio respecto a las propuestas y proyectos de reintroducción de especies de flora y fauna silvestres que estén o no incluidas en los apéndices de CITES.
• j)Emitir criterio respecto a la liberación en todo el territorio nacional de animales procedentes de la cría en cautiverio, plantas reproducidas en viveros, decomisos o entrega voluntaria.
• k)Emitir criterio respecto a las solicitudes de extracción de especies de flora y fauna silvestres que se encuentren incluidas o no en los apéndices de CITES.
• I)Emitir criterio respecto a la importación y exportación de especies invasoras y peligrosas de flora y da fauna silvestres.
• II)Analizar y emitir criterio respecto a investigaciones de tipo científico que se pretendan desarrollar con flora y fauna silvestres.
