Se permite el libre acceso a las recomendaciones e informes de la Comisión de la ZMT una vez aprobados por el Concejo Municipal, así como a la base de datos de concesiones otorgadas. Antes de entregar un expediente, el funcionario verifica su orden y foliado, y el consultante debe registrarse en un libro de control con datos personales y firma. Solo se permite el uso de lápiz durante la consulta, y cualquier anomalía detectada al finalizar la jornada debe comunicarse al Alcalde y al Departamento Legal. **Full Text of Regulation 12** **Regulation for the Proper Management of the Maritime-Terrestrial Zone Department Regarding the Consultation and Photocopying of Granted Concession and In-Process Case Files.** **Full Text of Record: 67BB4** **MUNICIPALITY OF OSA** **MUNICIPALITY OF OSA** **Article 1.** With the purpose of providing good service to interested parties, the Mayor may designate which hours of the daily workday will not be open to the public, so that the Department officials may proceed to organize the documentation of the case files and foliate them. For such purposes, visible signs shall be placed in the municipal facilities so that private individuals are duly informed of the hours during which they may appear at the Department to conduct the respective consultations. The same procedure shall be followed for the weekly meeting of the Maritime-Terrestrial Zone Commission.

**Article 2.** Except when it involves the applicant for the concession (concesión) themselves, who must identify themselves to the respective official with their current identity card, any interested party wishing to review a case file in process must also provide a written authorization from the applicant for the concession, which must be duly authenticated by an attorney and bear the respective stamp of the Bar Association (Colegio de Abogados). Said authorization shall be attached to the case file to be consulted; in the event of multiple case files, the respective authorizations must be provided for each one.

**Article 3.** Free access is permitted for any private individual to the recommendations and reports issued by the Maritime-Terrestrial Zone Commission, once they have been duly and firmly approved by the Municipal Council (Concejo Municipal). Likewise, free consultation of the database of granted concessions shall be permitted, once it has been established.

**Article 4.** Before providing a case file to an interested party or a duly authorized private individual, the municipal official shall proceed to verify that it is duly organized and foliated. Having verified the foregoing, they shall request the interested party to record their details in the Department's Case File Consultation Control Log. Said control log shall have a specific space for the following information: the date, the full name and surnames of the consultant, the consultant's identity card or passport number, the number of the case file to be consulted, the consultant's signature, the time of delivery and return of the case file, and a space for observations that the official deems necessary to note in relation to the consultation made or at the end of the consultation period, as established in the following article.

**Article 5.** Once the service hours for private individuals have concluded, the official in charge shall proceed to review each of the case files consulted, with the purpose of verifying that no anomaly has occurred. In the event of detecting any anomaly, they shall note it in the control log and immediately communicate it in writing to the Mayor and the Legal Department, for pertinent purposes.

**Article 6.** Consultants of case files may only use a pencil. The use of ink pens, ballpoint pens, or fountain pens is not permitted. Should it be confirmed that the consultant is not complying with this obligation, the case file shall be withdrawn from them, and the respective indication shall be made in the observations space of the case file control log.

**Article 7.** In the event the consultant wishes to photocopy the case file, they shall indicate to the official the folios to be photocopied, who shall proceed to note this circumstance in the observations space of the case file control log. The cost of the photocopies must be paid by the private individual.

**Article 8.** Department officials may not provide information regarding in-process concession case files that is requested by private individuals via telephone.

**Article 9.** Except in very exceptional cases and with prior written justification from the Municipal Mayor, the consultation and photocopying of case files shall be permitted during hours not designated for handling consultations.

**Article 10.** Any writ or document related to a Department case file must be submitted to the Municipality's Document Reception Office. Said office shall forward it to the Department on the following day. For such purposes, the official in charge shall receive said documentation, making the respective indication in the Internal Correspondence Control Log, where mention shall be made of the date the document was received in the department, the name of the sender or interested party, subject or reason, the number of folios comprising the document, and the signatures of the official delivering it and the one receiving it.

**Article 11.** This internal regulation takes effect upon its publication.

Dicha autorización se adjuntará al expediente a consultar; en caso de tratarse de varios expedientes, deberán aportarse las autorizaciones respectivas para cada una de ellos.

Constatado lo anterior, le solicitará al interesado a que se anote en el libro de Control de Consulta de Expedientes del Departamento. Dicho libro de control contará con un espacio determinado para la siguiente información: la fecha, el nombre completo y apellidos del consultante, el número de cédula de identidad o pasaporte del consultante, el número del expediente a consultar, la firma del consultante, la hora de entrega y la de devolución del expediente, y un espacio para las observaciones que el funcionario considere necesario anotar en relación con la consulta realizada o al final de la jornada de consulta tal y como se establece en el artículo siguiente.

En caso de detectar alguna anomalía, lo anotará en el libro de control y lo comunicará de inmediato por escrito al Alcalde y al Departamento Legal, para los fines pertinentes.

No se permitirá la utilización de lapiceros, bolígrafos o plumas, de constatarse que el consultante no cumple con esta obligación se procederá a retirársele el expediente y se hará la indicación respectiva en el espacio de observaciones del libro de control de expedientes.

El costo de las fotocopias deberá ser cancelada por el particular.
