Declaration of Public Interest of the Activities of the Development Agency for the Huetar Norte RegionDeclaración de interés público de las actividades de la Asociación Agencia para el Desarrollo de la Región Huetar Norte

The activities aimed at strengthening the comprehensive development plans of the Huetar Norte Region, carried out by the Association Agency for the Development of the Huetar Norte Region, registered in the Associations Registry, with legal ID number 3-002-333739, are hereby declared of public interest.

The activities of the Association Agency for the Development of the Huetar Norte Region covered by the declaration of public interest shall be the following:

• a)Promoting, before the State, the development of investments and infrastructure that strengthen the social and economic condition of the Region.
• b)Promoting investment attraction plans and the promotion of exports that allow for the creation of stable jobs.
• c)Stimulating industrial growth.
• d)Developing endogenous potential, through support measures for local development initiatives, job creation, and activities of small and medium-sized enterprises.
• e)Promoting the incorporation of appropriate and advanced technologies in the Region, in order to offer productive sectors better competitive conditions.
• f)Promoting the development of the service sector, as well as the emergence and establishment of new enterprises in this field; likewise, implementing an economic and social policy that responds to the needs of enterprises in the Region to compete in the global market.
• g)Creating new opportunities for the young population of the Huetar Norte Region, in the field of their professional development as potential new entrepreneurs, based on educational actions and policies.
• h)Seeking the increase of added value to the production of the Huetar Norte Region; and mediating and promoting the economic and social development of said Region.

All activities covered by the declaration contained in this article must be carried out in pursuit of achieving sustainable development and proper environmental management.

The Branches of Government of the Republic, including their bodies or dependencies, autonomous institutions, municipalities, non-state public entities, and public enterprises are hereby authorized to donate, to the Association Agency for the Development of the Huetar Norte Region, economic resources up to an amount equivalent to one hundred base salaries each, calculated according to Article 2 of Law No. 7337, of May 5, 1993, provided that such contribution does not affect the ordinary performance of the respective entity. These resources must be used solely for the development of the projects that this Association may implement for the benefit of the Huetar Norte Region.

Likewise, they are authorized to enter into, with the referred Association, cooperation agreements and agreements for the loan of human resources, office implements, infrastructure, or any other type of movable goods, as well as for the paid provision of technical-academic services. To this end, they shall follow the legal and constitutional stipulations that regulate the matter according to the Costa Rican legal system.

The Association Agency for the Development of the Huetar Norte Region shall be authorized to enter into the aforementioned agreements with entities and bodies, both public and private, as well as to form part of international agencies that pursue the achievement of objectives and activities consistent with those regulated in this Law.

The Dirección General de Migración y Extranjería, of the Ministerio de Gobernación y Policía, is hereby authorized to grant temporary entry permits to foreign academic experts who enter the country required to implement projects to be carried out by this Association, for stays of days or hours, or for temporary residence, so that they may participate in the development of the activities indicated in Article 2 of this Law.

In any case, such persons must comply with the migratory requirements established in the legislation in force and demonstrate that they are entering the country in the capacity of academic experts. To this end, they must provide a certification issued by the Association, duly authenticated by a notario público, detailing the activity or project in which they will participate, as well as the period of stay in the country; in addition, they must provide a copy of the corresponding academic degrees.

It becomes effective upon its publication.

Decláranse de interés público las actividades destinadas a fortalecer los planes de desarrollo integral de la Región Huetar Norte, que realice la Asociación Agencia para el Desarrollo de la Región Huetar Norte, inscrita en el Registro de Asociaciones, con la cédula jurídica Nº 3-002-333739.

Las actividades de la Asociación Agencia para el Desarrollo de la Región Huetar Norte cubiertas por la declaración de interés público, serán las siguientes:

• a)Promover, ante el Estado, el desarrollo de inversiones e infraestructura que fortalezcan la condición social y económica de la Región.
• b)Impulsar planes de atracción de inversiones y la promoción de las c) Estimular el crecimiento industrial.
• d)Desarrollar el potencial endógeno, mediante medidas de apoyo a las iniciativas de desarrollo local, la generación de empleo y actividades de la pequeña y mediana empresa.
• e)Impulsar la incorporación de tecnologías apropiadas y avanzadas en la Región, a fin de ofrecer a los sectores productivos mejores condiciones de competencia.
• f)Promover el desarrollo del sector servicios así, como el surgimiento y establecimiento de nuevas empresas en este campo; asimismo, instrumentar una política económica y social que responda a las necesidades de las empresas de la Región para competir en el mercado mundial.
• g)Crear nuevas oportunidades para la población joven de la Región Huetar Norte, en el campo de su desarrollo profesional como nuevos empresarios potenciales, a partir de acciones y políticas educativas.
• h)Procurar el incremento del valor agregado a la producción de la Región Huetar Norte; y mediar e impulsar el desarrollo económico y social de dicha Región.

Todas las actividades cubiertas por la declaración contenida en este artículo, deberán realizarse en procura de lograr un desarrollo sostenible y un manejo adecuado del medio ambiente.

Autorízase a los Poderes de la República, incluso a sus órganos o dependencias, a las instituciones autónomas, las municipalidades, los entes públicos no estatales y las empresas públicas para que donen, a la Asociación Agencia para el Desarrollo de la Región Huetar Norte, recursos económicos hasta por el monto equivalente a cien salarios base cada una, calculados según el artículo 2º de la Ley Nº 7337, del 5 de mayo de 1993, siempre y cuando dicha contribución no afecte el desempeño ordinario de la entidad respectiva. Esos recursos deberán ser utilizados únicamente en el desarrollo de los proyectos que esta Asociación llegue a implementar en provecho de la Región Huetar Norte.

Asimismo, estarán autorizados para celebrar, con la referida Asociación, convenios de cooperación y préstamo de recursos humanos, de implementos de oficina, de infraestructura o de cualquier otro tipo de bien mueble, así como de prestación remunerada de servicios técnico-académicos. Para ello, seguirán las estipulaciones legales y constitucionales que regulen la materia según el ordenamiento jurídico costarricense.

La Asociación Agencia para el Desarrollo de la Región Huetar Norte estará autorizada para suscribir los mencionados convenios con entes y órganos, tanto públicos como privados, así como para formar parte de agencias internacionales que persigan la realización de objetivos y actividades contestes a las reguladas en la presente Ley.

Autorízase a la Dirección General de Migración y Extranjería, del Ministerio de Gobernación y Policía, para que, a los expertos académicos extranjeros que ingresen al país requeridos para implementar proyectos por realizar por parte de esta Asociación, les conceda el permiso de ingreso temporal, para estancias de días u horas o para residencia temporal, a fin de que participen en el desarrollo de las actividades indicadas en el artículo 2º de esta Ley.

En todo caso, dichas personas deberán cumplir los requisitos migratorios establecidos en la legislación vigente y demostrar que ingresan al país en la condición de expertos académicos. Para ello, deberán aportar una certificación extendida por la Asociación, debidamente autenticada por notario público, con el detalle de la actividad o del proyecto en el que participarán, así como el período de permanencia en el país; además, deberán aportar una copia de los títulos académicos correspondientes.
