Complete Text acta: 659B1 Nº 31191-MINAE Nº 31191-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF THE ENVIRONMENT AND ENERGY Based on the powers conferred by articles 140 subsections 3) and 18) and 50 of the Political Constitution; article 11 of the Biodiversity Law No. 7788 published on May 27, 1998, the Organic Law of the Environment No. 7554 published on November 13, 1995, the Mining Code Law No. 6797 published on October 4, 1982, the Executive Decree No. 30477-MINAE, published on June 12, 2002, and the General Law of Public Administration No. 6227 of May 2, 1978.
1st-That in the Official Gazette La Gaceta No. 166 of August 30, 2002, the Executive Branch issued Executive Decree No. 30646-MINAE, which creates the Evaluation and Diagnosis Commission for Geological and Mining Activities of the Directorate of Geology and Mines of the Ministry of the Environment and Energy to carry out the tasks of analysis, diagnosis, and evaluation of the different stages developed in the Directorate of Geology and Mines with the purpose of issuing a final report that serves as support in decision-making to provide agility to the public service and elevate the quality of the services provided, contributing to improve in the future the projection of geology and mining in Costa Rica. To fulfill this task, this Commission was granted a period of 6 months, extendable under justification, for the issuance of a Report to the Ministerial Hierarch, a period that expires on February 28, 2003.
2nd-That on February 11, the Coordinator of this Commission formally requests an extension for the issuance of the final report, based on the following: a) The first stage of the analysis process has been concluded at the internal level and with related social sectors. b) The Commission is proceeding with the review of the first draft of "Organizational Diagnosis of the situation of the Directorate of Geology and Mines". c) The process of logical and physical design of the information system, the redesign of organizational processes, standardization of procedures and instructions, and the analysis of the demand and supply capacity of the services of the Directorate of Geology and Mines must be carried out. d) The technical-legal analysis process on competencies and demands in relation to the existing structure and the profile of the officials must be concluded, which will result in a recommendation on the organizational, regulatory, and procedural structure to follow.
3rd-That the preceding reasonings are clear indicators of the institutional need to continue with the initiated process, given that there are pending inputs for elaboration and analysis that must necessarily be reflected in the final report, which is an institutional priority. Therefore, They Decree:
