75 to La Gaceta No. 199 of October 16, 2002, Regulation for the regulation and control of the efficient use of fuel at a preferential price intended for the non-sport national fishing fleet in jurisdictional waters or outside them, so that henceforth it reads as follows:
- k)Other regulatory provisions:
Natural person beneficiaries of vessels of the small-scale artisanal fleet must be up to date in the payment of the fees of any existing contributory regime of the Caja Costarricense de Seguro Social.
Natural or legal person beneficiaries of vessels of the medium-scale longline artisanal fleet, advanced longline, and semi-industrial fleet must be up to date with the payment of the employer-worker contributions of the contributory regime of the Caja Costarricense de Seguro Social.
For the purposes of the foregoing mandates, the permit holder must, on a one-time basis, demonstrate by means of a certification issued by the competent authority of the Caja Costarricense de Seguro Social, that he/she is enrolled in any contributory regime of the Caja Costarricense de Seguro Social.
INCOPESCA, relying on the lists provided by the Caja Costarricense de Seguro Social, shall verify the beneficiary's compliance with the payment of his/her fees for the Contributory Regime in which he/she is enrolled.
When, in accordance with the lists that the Caja Costarricense de Seguro Social provides for these purposes, the beneficiary is indicated as delinquent, the request must be rejected outright, with the express mention "rejected for non-compliance with Article 74 CCSS law" and must be stamped by the official at the time of verifying such condition. When this situation arises, in order to reiterate his/her request, the administrated party must demonstrate through certification from the Caja Costarricense de Seguro Social that his/her condition has been modified, indicating that he/she is up to date in his/her obligation.
Legal persons must provide a certification of legal status each time it is modified, accompanied by a photocopy of the identity card or Residence card of the legal representative.
In the case of legal persons that are owners of vessels, for exempt fuel requests, the legal representative may authorize up to a maximum of three workers from his/her company, who must be duly noted on a form attached to the contract signed with INCOPESCA on this matter. These authorized persons may be substituted at any time by the legal representative, upon prior notification to the SCAC.
