Complete Text of record: 60703 Nº 30961-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In accordance with the provisions of articles 11, 50, 89, 140 subsections 3), 8), 18) of the Political Constitution; articles 7 and 8 of the Convention on Biological Diversity and its Annexes, ratified by Costa Rica through Law No. 7416 published in La Gaceta No. 143 of July 28, 1994; articles 11 and 49 of the Biodiversity Law, No. 7788 published in La Gaceta No. 101 of May 27, 1998; articles 1, 3 and 25 of the Wildlife Conservation Law, No. 7317 published in La Gaceta No. 235 of December 7, 1992; articles 1 and 6 of the Forest Law, No. 7575 published in Alcance No. 21 to La Gaceta No. 72 of April 16, 1996; in the provisions of articles 11 and 27 of the General Law of Public Administration, and

1That through Executive Decree No. 25167-MINAE published in La Gaceta No. 111 of June 12, 1996, the Executive Branch declares a restriction on the timber harvesting of the forest tree species Almendro (Dipteryx panamensis) in the zones comprised between the San Carlos River and the Sarapiquí River, along the north side of the San Juan River (Costa Rica - Nicaragua border), along the west side longitude 84° 15, along the south side 10° 33 and along the east side longitude 83° 53, basing this decision on the need to regulate the felling of this forest species, as its fruits constitute a food source, and its trunk, the ideal site for the nesting of the Green Macaw (Lapa Verde) (Ara ambigua), given the size and height characteristics of this tree in said zone.
2That through Executive Decree No. 25663-MINAE published in La Gaceta No. 243 of December 18, 1996, the Executive Branch decides to maintain the restriction on felling or harvesting of the Almendro tree, in the geographic zone described through Executive Decree No. 25167-MINAE cited previously, considering it necessary to prolong in time the protective effects created by said decree for these species.
3That through ruling of the Constitutional Chamber 2002-02486 of 10:54 a.m. on March 8, 2002, said court declares with merit the amparo appeal processed within file 01-011865-007-CO, in which it was alleged, against this Administration, the non-compliance with the necessary measures to guarantee adequate protection for the Green Macaw (Lapa Verde), by allowing that, in application of the technical parameters contained in Executive Decrees No. 25167-MINAE and No. 25663-MINAE, the Administration has continued issuing authorizations for the restricted felling of the Almendro tree, consequently proceeding, the aforementioned Court in that same ruling, to annul subsections 1), 2), 5), and 7), of article III of Executive Decree No. 25663-MINAE, which established the technical parameters for authorizing the restricted felling of the Almendro tree in the influence zone of the mentioned decrees.
4That through the cited judgment, the Constitutional Chamber also recommends that the Ministry of Environment and Energy (MINAE) verify whether the actions adopted through the decrees in question are both economically and legally effective to favor the maintenance and development of the areas intended for Almendro trees, in order to comply with the obligations imposed by law; implement the necessary sanctioning legal measures to procure effective protection of the species Ara ambigua and provide a surveillance plan for the green macaw (lapa verde) and the felling of the Almendro tree throughout the country.
5That the restriction on the harvesting of the species Almendro (Dipteryx panamensis) introduces a limitation greater than that established in the Principles, Criteria and Indicators of sustainability for other commercial species, therefore the State, through the State Forestry Administration, will consider the possibility of including within the PSA (Pago de Servicios Ambientales) program the farms where this species is found.
6That for the fulfillment of the recommendations given by the Constitutional Chamber, this Ministry requires a period of at least nine months, eventually extendable, to complete the technical studies aimed at complying with the mentioned recommendations.
7That the Green Macaw (Lapa Verde) (Ara ambigua) is a wildlife species that is in danger of extinction, according to the provisions of article 25 of the Wildlife Conservation Law, No. 7317 and 58 of its Regulations, Executive Decree No. 26435-MINAE, published in La Gaceta No. 233 of December 3, 1997, whose viability conditions the State must ensure, through the adoption of permanent and even precautionary measures that are necessary, in order to guarantee the existence of said species. Therefore,

2002-02486 of March 8, 2002 issued by the Constitutional Chamber, which orders that the Ministry of Environment and Energy (MINAE) must verify whether the actions adopted through Decrees Nos. 25167-MINAE and 25663-MINAE are both economically and legally effective to favor the maintenance and development of the areas intended for Almendro (Dipteryx panamensis) trees and in order to comply with the obligations imposed by law; as well as implement the necessary sanctioning legal measures to procure effective protection of the species Ara ambigua; and provide a surveillance plan for the green macaw (lapa verde) and prevent the felling of the Almendro tree throughout the country.

Those Almendro (Dipteryx panamensis) trees rendered unable to be harvested due to the application of other legal provisions will not be considered subject to payment for environmental services, among them, those trees located in protection areas, individuals less than 60 centimeters DBH (Diameter at Breast Height, DAP), remnant trees (árboles remanentes), seed trees (Árbol Padre, AP) from Management Plans that have not yet completed the felling cycle. In the case of land subject to private possession, the provisions of article 89 of the Regulations to the Forest Law must be complied with, without prejudice to the special regulations established by FONAFIFO for properties in this condition.

The encumbrances to which the recognition of this environmental service gives rise will be registered before the Public Registry, for lands subject to ownership and, in the case of farms in possession, before the Project Registry of the respective Conservation Area (Área de Conservación).

7575, for the trees whose harvesting is denied in application of this decree. This will be done in coordination with an Internal Commission created by the Directorate of SINAC to address the problem of the almendro tree and the green macaw (lapa verde).

Sole Transitory Provision: The National System of Conservation Areas is authorized, in fulfilling the competencies established by article 6 subsections a), c), e), and q) of the Forest Law No. 7575 and in article 22 of the Biodiversity Law No. 7788, to receive donations, establish agreements, and execute or manage the necessary contracts to fulfill the purposes of this decree. The National System of Conservation Areas, or where applicable, FONAFIFO, may select through the contractual modality of background-based selection (concurso de antecedentes), the suitable persons to generate the required information. Likewise, SINAC is authorized to make, within the framework of its economic limit, the modifications to the budgetary items that are necessary and compatible with the fulfillment of these purposes described in this decree.

1Que mediante Decreto Ejecutivo N° 25167-MINAE publicado en La Gaceta N° 111 del 12 de junio de 1996, el Poder Ejecutivo declara una restricción para el aprovechamiento maderable del árbol forestal de la especie Almendro (Dipteryx panamensis) en las zonas comprendidas entre el Río San Carlos y el Río Sarapiquí, por el lado norte del río San Juan (frontera Costa Rica - Nicaragua), por el lado, oeste longitud 84° 15, por el lado sur 10° 33 y por el este longitud 83° 53, fundamentando esta decisión en la necesidad de regular la corta de esta especie forestal, al constituir sus frutos fuente de alimentación, y su tronco, el sitio idóneo para el anidamiento de la Lapa Verde (Ara ambigua), dadas las características de porte y altura de este árbol en dicha zona.
2Que mediante Decreto Ejecutivo N° 25663-MINAE publicado en La Gaceta N° 243 del 18 de diciembre de 1996, el Poder Ejecutivo decide mantener la restricción a la corta o aprovechamiento del árbol de Almendro, en la zona geográfica descrita mediante el Decreto Ejecutivo N° 25167-MINAE de cita previa, por considerar necesaria la prolongación en el tiempo, de los efectos de protección creados por dicho decreto para estas especies.
3Que mediante voto de la Sala Constitucional 2002-02486 de las 10,54 horas del 8 de marzo del 2002, dicho tribunal declara con lugar el recurso de amparo tramitado dentro del expediente 01-011865-007-CO, en el cual se alegó, en contra de esta Administración, el incumplimiento de las medidas necesarias para garantizar la adecuada protección a la Lapa Verde, al permitir que, en aplicación de los parámetros técnicos contenidos en los Decretos Ejecutivos N° 25167-MINAE y N° 25663-MINAE, la Administración haya continuado emitiendo autorizaciones para la corta restringida del Almendro, procediendo en consecuencia, el mencionado Tribunal en ese mismo fallo, a anular los incisos 1), 2), 5), y 7), del artículo III del Decreto Ejecutivo N° 25663-MINAE, en los que se establecían los parámetros técnicos para autorizar la corta restringida del Almendro en la zona de influencia de los mencionados decretos.
4Que mediante la citada sentencia, la Sala Constitucional también recomienda al Ministerio del Ambiente y Energía (MINAE), verificar si las acciones adoptadas mediante los decretos de marras, son tanto económica como legalmente efectivas para favorecer el mantenimiento y el desarrollo de las áreas destinadas a los árboles de Almendro, en aras de cumplir con las obligaciones impuestas por ley; implementar las medidas legales sancionatorias necesarias para procurar un efectivo resguardo de la especie Ara ambigua y dar un plan de vigilancia hacia la lapa verde y la tala del árbol de Almendro en todo el país.
5Que la restricción para el aprovechamiento de la especie Almendro (Dipteryx panamensis) introduce una limitación superior a la establecida en los Principios, Criterios e Indicadores de sostenibilidad para las demás especies comerciales, por ello el Estado, a través de la Administración Forestal del Estado, considerará la posibilidad de incluir dentro del programa de PSA (Pago de Servicios Ambientales) las fincas donde se encuentra esta especie.
6Que para la realización de las recomendaciones dadas por la Sala Constitucional, este Ministerio requiere de un período de al menos nueve meses, eventualmente prorrogables, para concretar el cumplimiento de los, estudios técnicos tendientes a cumplir con las mencionadas recomendaciones.
7Que la Lapa Verde (Ara ambigua) es una especie de la vida silvestre que se encuentra en peligro de extinción, según lo dispuesto en los artículos 25 de la Ley de Conservación de la Fauna y Flora Silvestre, N° 7317 y 58 de su Reglamento, Decreto Ejecutivo N° 26435-MINAE, publicado en La Gaceta N° 233 del 3 de diciembre de 1997, cuyas condiciones de viabilidad debe procurar el Estado, mediante la adopción de medidas permanentes y aun cautelares que sean necesarias, con la finalidad de garantizar la existencia de dicha especie. Por tanto,

Considerando:

Decretan:

25167-MINAE y 25663-MINAE, son tanto económica como legalmente efectivas para favorecer el mantenimiento y el desarrollo de las áreas destinadas a los árboles de Almendro (Dipteryx panamensis) y en aras de cumplir con las obligaciones impuestas por ley; así como implementar las medidas legales sancionatorias necesarias para procurar un efectivo resguardo de la especie Ara ambigua; y dar un plan de vigilancia hacia la lapa verde y evitar la tala del árbol de Almendro en todo el país.

No se considerarán sujetos a pago de servicio ambiental aquellos árboles de Almendro (Dipteryx panamensis) imposibilitados para el aprovechamiento en función de la aplicación de las demás disposiciones legales, entre ellos, aquellos árboles ubicados en áreas de protección, individuos menores a 60 centímetros de DAP (Diámetro Altura de Pecho) árboles remanentes, árboles AP (Árbol Padre) de los Planes de Manejo que aún no han cumplido el ciclo de corta. En tratándose de terrenos sujetos a posesión particular, deberá cumplirse con lo dispuesto en el artículo 89 del Reglamento a la Ley Forestal, sin perjuicio de las regulaciones especiales que disponga el FONAFIFO para inmuebles en esta condición.

Las afectaciones a que da origen el reconocimiento de este servicio ambiental, se inscribirán ante el Registro Público, en terrenos sujetos al dominio y en el caso de las fincas en posesión, ante el Registro de Proyectos de la respectiva Área de Conservación.

Esta se hará en coordinación con una Comisión Interna creada por la Dirección del SINAC para atender la problemática del almendro, la lapa verde.

Transitorio Único: Se autoriza al Sistema Nacional de Áreas de Conservación, para que en el cumplimiento de las competencias que determinan los artículos 6 incisos a), c), e), y q), de la Ley Forestal Nº 7575 y en el artículo 22 de la Ley de la Biodiversidad Nº 7788, reciba donaciones, establezca convenios, y realice o gestione los contratos necesarios para cumplir con los fines del presente decreto. El Sistema Nacional de Áreas de Conservación, o en su caso, el FONAFIFO, podrá elegir mediante la modalidad contractual de concurso de antecedentes, a las personas idóneas para generar la información requerida. De igual manera, se autoriza al SINAC a realizar, dentro del marco de su límite económico, las modificaciones de las partidas presupuestarias que sean necesarias y compatibles con el cumplimiento de estos fines descritos en el presente decreto.
