7064 of April 29, 1987, grants the Ministry of Agriculture and Livestock the competence as the Governing Body to set policies that regulate the National Agricultural Sector, and likewise to establish mechanisms and regulations for the management of sustainable production.

30280-MAG of April 6, 2002, published in La Gaceta No. 74 of April 18 of the same year, the Regulation for the Production, Industrialization and Commercialization of Sustainable Coffee was issued, which it has been deemed necessary to issue again, making the pertinent adjustments and modifications for its better application. Therefore,

Principles of Sustainable Coffee Production

• 1)Promote the reduction, reuse, and recycling of waste to improve soil fertility.
• 2)Encourage the use of efficient technologies that utilize renewable energy.
• 3)Foster and intensify biological cycles within the coffee production system, encompassing soil flora and fauna, plants, and animals.
• 4)Maintain and increase the fertility of coffee-growing soils.
• 5)Comply with local legislation and international conventions ratified by the Legislative Assembly of Costa Rica related to employee wages and benefits.
• 6)Protection of workers against workplace hazards.
• 7)Maintain and increase the cup quality of the coffee.
• 8)Stimulate the preservation of biodiversity and the conservation of soil and water.
• 9)Use of coffee production systems where interaction among their components is favored to obtain a closed system regarding organic matter and soil fertility.
• 10)Gradually seek the reduced use of agrochemicals (agroquímicos) as well as other practices that favor the conservation of natural and productive resources, such as biological control, watershed protection, and soil conservation, in coffee production systems.
• 11)The production, industrialization, and commercialization of sustainable coffee will seek, to the extent that the market allows, to achieve an integral benefit to rural communities by increasing producer income, expanding employment and training opportunities, and trying to improve infrastructure and public services.

• 1)Agrochemical (Agroquímico): A synthetically produced molecule with a specific action, used for the benefit of crops.
• 2)Coffee year (Año cafetalero): The one-year period between October first and September thirtieth.
• 3)Harvest year (Año de cosecha): The one-year period between April first and March thirty-first.
• 4)Sustainable processing (Beneficiado sostenible): Process that processes the coffee bean from a sustainable coffee plantation, and which is carried out according to the specifications of this Regulation.
• 5)Coffee: The complete coffee fruit, ripe, green, or in cherry form. Its endosperm (washed or in mucilage) or in its green coffee (café oro) condition. Also, the roasted or ground decaffeinated bean, liquid or soluble.
• 6)Sustainable coffee (Café sostenible): That product ready to be commercialized (fruit, green coffee, roasted, ground, or any other industrial process) that has been produced under a sustainable coffee production and industrialization system.
• 7)Certification: It is the procedure by which official certification entities, or officially recognized certification entities, accredited by the Costa Rican Accreditation Body (Ente Costarricense de Acreditación, ECA) provide written or equivalent assurance that the production units (unidades productivas) conform to the requirements established in this Regulation.
• 8)Commercialization: The possession or display for sale, the offering for sale, delivery, or any other form of introduction to the market.
• 9)Soil conservation (Conservación del suelo): Any action tending to reduce or eliminate soil erosion.
• 10)Elaboration or processing: Transformation, packaging, preservation, and packing operations of agricultural products.
• 11)Group (Grupo): A set of producers (more than two) from a common geographical area (zona geográfica común) who belong to a legally constituted organization and with an internal control system in operation, as well as a central administration responsible for compliance with the provisions of this Regulation.
• 12)ICAFÉ: Coffee Institute of Costa Rica (Instituto del Café de Costa Rica).
• 13)Industrialization: Industrial process after the harvest of the fruit in the field.
• 14)Inspection: The task of evaluating, visiting, supervising, or verifying the sustainable nature of production and industrialization, the processes, or the appropriate facilities for them, carried out by an inspector at the request of ICAFÉ, the Service, the producer, or the industrializer.
• 15)Sustainable Coffee Inspector (Inspector en Café Sostenible): A natural person, an official or contracted by ICAFÉ, who complies with the provisions of Article 19 of this Regulation, accredited before the Service and simultaneously trained to carry out inspections aimed at obtaining sustainable certification, on the farm, industrializer, and commercialization, duly registered with the service.
• 16)Ministry: Ministry of Agriculture and Livestock.
• 17)Sustainable coffee production model (Modelo de producción de café sostenible): An economically viable model that addresses the social and environmental needs of all participants in the coffee supply chain, from the producer to the consumer, complying with the principles stipulated in Chapter I.
• 18)Operator (Operador): A natural or legal person who participates in any stage of the sustainable coffee certification process (producer, industrializer, exporter, roaster, or commercializer).
• 19)Production: The operations carried out in the production unit (unidad productiva) for obtaining, processing, and/or commercializing sustainable coffee.
• 20)Recycling: Subjecting a used material to a process so that it can be reused.
• 21)Registry: Database administered by the Service, relating to sustainable coffee production farms, sustainable coffee industrialists, commercializers, and Sustainable Coffee Inspectors.
• 22)Seed: Any grain, tuber, bulb, or any living part of the plant used to reproduce a species.
• 23)State Phytosanitary Service (Servicio Fitosanitario del Estado): SFE.
• 24)Sustainability (Sostenibilidad): That development or process which meets the needs of the present without compromising the ability of future generations to meet their own needs.
• 25)Production Unit (Unidad Productiva): Farm, plot, processing plant, warehouse, and/or establishment where sustainable coffee production, processing, storage, and/or commercialization activities are carried out.
• 26)Manual of Inspection Procedures for Sustainable Coffee (Manual de Procedimientos de Inspección en Café Sostenible):

A set of regulations, procedural provisions, and forms, which establishes the form and content for carrying out inspections in the field of sustainable coffee, which will be prepared jointly between the MAG and ICAFÉ.

• 27)Common geographical area (Zona geográfica común): The ICAFÉ electoral zones defined in Law 2762 and its amendments and in Article 73 and concordant articles of its Regulation shall be understood as such.

Certification

Industries may only be certified individually. However, to commercialize sustainable coffee, it must in all cases come from a certified farm, either individually or included in a group of producers, as sustainable and subjected to industrialization processes certified as such.

• 1)The producer, industrializer, exporter, or commercializer of sustainable coffee and the inspector must: make a complete description of the unit, indicating the storage and production areas as well as the plots or sustainable coffee collection zones.
• 2)The inspector must carry out the corresponding inspection for each operator (operador) or group and issue a recommendation on whether the operator or group qualifies or not for certification as sustainable.
• 3)Both the description of the sustainable unit and the measures recommended by the inspector shall be included in the inspection report, which shall be signed by the operator or the legal representative of the group and the inspector.
• 4)There must be a commitment from the operator or group to carry out the operations in accordance with the provisions of this Regulation, and, in the event that incomplete procedures are determined, the application of the recommendations established in said report.
• 5)In the event that applications are submitted by groups of producers, all members of the group have the same obligations that are individually requested in this regulation. Any document subscribed by a group must be presented by a legal entity that demonstrates the authority to manage and commit on behalf of the group members. In the case of applications, the legal entity must be authorized to manage the obtaining of the "Sustainable Coffee" (Café Sostenible) certification as a group. The inspector, through sampling, shall carry out the inspection of the group and generate a report based on the sample; with that report, the Service shall issue or deny group certification.
• 6)The SFE shall define the procedure to follow to define the sample in the case of group certifications.
• 7)Certification is for the entire group; therefore, if it is proven that any of its members is not complying with what is indicated in this Regulation and it is considered grounds for suspending the certification, following what is indicated in Article 37 of this regulation, the certification shall be withdrawn from the group as a whole.
• 8)The group, to be considered for a certification, must meet the following requirements:
• a)Have an administration responsible for compliance with the provisions of this Regulation.

b) Have an Internal Control System (SIC).

• c)Have centralized information on each of the group members.
• d)Ensure that both the central administration and the person responsible for the SIC have a direct relationship with the group members.
• e)Commercialize their product(s) jointly when the destination is exportation.
• 9)The responsibilities of the central administration of the group shall be:

a) Install an Internal Control System (SIC).

• b)Ensure the implementation of said system.
• c)Train its members for compliance with this Regulation.
• d)Respond to the SFE or control body for its members' compliance with the provisions established in this Regulation and immediately notify them of any change in the group or any detected anomaly or corrective measure taken.
• e)Designate and train internal inspectors.
• f)Evaluate cases of new incorporations into the group and exclusions and communicate them to the SFE.
• g)Inform its members about the bases of sustainable production and the obligations or responsibilities of certification.
• 10)The Internal Control System (SIC) that the central administration must establish shall comply with:
• a)Maintaining centralized, complete, and updated information on each of its members.
• b)Having a duly documented register of inclusions and exclusions.
• c)Inspecting 100% of the members at least once a year.
• d)Keeping the respective producer records with the following information:
• 1)Full name.
• 2)Identification number.
• 3)Productive area.
• 4)Production estimates.
• 5)Plot number.
• 6)Production (volumes).
• 7)Sketches and/or maps of the farm location.
• 8)Visit sheets signed by the inspector and the producer.
• 9)Receipts (copies) of coffee sales.
• 10)Other observations.

• 1)The quantities of sustainable coffee received, processed, and sold.
• 2)The payroll and production records of the processing plant.

In turn, the Service may issue, at the request of the interested party, a confirmation that they are duly registered.

In the event that the parties are represented by a third party, the authenticated legal power of attorney supporting their representation must be added to the registration request.

• 1)Full name and qualifications of the natural or legal person requesting registration.
• 2)Description of the activity they are engaged in.
• 3)Attach a photocopy of the identity card or legal identification document.
• 4)Exact address of the natural or legal person, postal address, telephone and fax number.
• 5)Place to receive notifications: name, postal address, postal box, telephone and fax number.
• 6)In the case of a legal person: domiciliary and postal address, telephone and fax number of the legal representative of the company. Attach their respective valid legal certification (personería jurídica) issued no more than three months prior.

• 1)Professional in Agronomy graduated from a recognized university with a minimum of three years of experience and extensive knowledge of the coffee production and industrialization process.
• 2)Basic knowledge of computing and administration to be applied directly in this activity.
• 3)Availability to visit the farms and/or coffee processing plants registered with ICAFE.
• 4)Ability to prepare concise and coherent reports on the aspects evaluated in the coffee plantations and processing plants.
• 5)Sworn declaration that they will observe and respect the confidentiality of the information collected, which is the property of the producer or industrializer.
• 6)May not have a commercial relationship or interest with companies, organizations, or producers with whom they have inspection links.

In all cases, if contamination occurs, it must be documented in the farm records, and the producer shall immediately contact the Service.

Control Body

• 1)Receive the inspection request and forward it to the ICAFE inspector so they can proceed with the inspection.
• 2)Authorize and supervise sustainable coffee inspectors.
• 3)Maintain the national registry of inspectors, farms, coffee processing plants, and commercializers certified as sustainable.
• 4)Establish a supervision system for all those natural or legal persons involved in the sustainable coffee production, industrialization, and commercialization process.
• 5)Make available to interested parties an updated list with the names and addresses of the operators (operadores) subject to this regulation, as well as the certified production units (unidades productivas) and date of certification.
• 6)Carry out the training of the persons in charge of conducting inspections of the production units.
• 7)It shall be the body that establishes corrective measures for certified operators; likewise, it shall be the instance before which they may appeal to present their claims in case of non-conformity. In the second instance, the superior hierarchical authority of the Ministry of Agriculture shall resolve.

The Service shall take the necessary measures to:

• 1)Ensure that the inspections carried out are objective.
• 2)Withdraw the authorization from the inspector, or the certification of the production unit (unidad productiva) when it does not comply with the requirements established in the current legislation or regulations, informing ICAFE so that it may take the appropriate measures.

Once this period has expired and the requested items have not been fulfilled, the Service shall proceed to reject the application.

To renew the certification, the interested party must comply with the provisions of the preceding articles. The renewal application must be submitted no later than sixty calendar days before the certification expires. In the event that the certification renewal application is submitted late, and/or the certification has expired, the production harvested outside the certification period shall not qualify as sustainable coffee.

Of the Administrative Procedures for the Application of this Regulation

Likewise, their actions must be free from discriminatory treatment, and all procedures must guarantee transparency. The Service must respect information considered the client's property or expressly indicated as confidential. The disclosure of information subsequent to certification shall be made at the discretion of the Service and in compliance with its powers for public ends or objectives or with the client's consent.

It is before this administrative body where interested parties may submit the corresponding complaints verbally or in writing.

The measure or suspension shall be established by the Service, and its resolution may be appealed before the superior hierarchical authority within a period of 5 calendar days after receiving the notification.

Por tanto,

Principios de la producción de café sostenible

• 1)Promover la reducción, reutilización y el reciclaje de desechos, para mejorar la fertilidad del suelo.
• 2)Fomentar el uso de tecnologías eficientes, que utilicen energía renovable.
• 3)Fomentar e intensificar los ciclos biológicos dentro del sistema de producción de café, ello comprende la flora y la fauna del suelo, las plantas y los animales.
• 4)Mantener e incrementar la fertilidad de los suelos cafetaleros.
• 5)Cumplir con la legislación local y convenciones internacionales ratificadas por la Asamblea Legislativa de Costa Rica relacionadas con salarios y beneficios de empleados.
• 6)Protección de los trabajadores contra los peligros en el lugar de trabajo.
• 7)Mantener e incrementar la calidad de taza del café.
• 8)Estimular la preservación de la biodiversidad y la conservación del suelo y el agua.
• 9)Utilización de sistemas de producción de café donde se favorezcan la interacción entre sus componentes para obtener un sistema cerrado en lo que respecta a la materia orgánica y la fertilidad del suelo.
• 10)Procurar en forma gradual el menor uso de agroquímicos así como otras prácticas que favorezcan la conservación de los recursos naturales y productivos, tales como control biológico, protección de cuencas y conservación del suelo, en los sistemas de producción de café.
• 11)La producción, industrialización y la comercialización de café sostenible buscarán, en la medida en la que el mercado lo permita, alcanzar un beneficio integral a las comunidades rurales incrementando los ingresos del productor, expandiendo las oportunidades de empleo y capacitación, y tratando de mejorar la infraestructura y los servicios públicos.

• 1)Agroquímico: Molécula producida sintéticamente con una acción especí.ca, que se utiliza para beneficio de los cultivos.
• 2)Año cafetalero: El período de un año comprendido entre el primero de octubre y el 30 de setiembre.
• 3)Año de cosecha: El período de un año entre el primero de abril y el 31 de marzo.
• 4)Beneficiado sostenible: Proceso que beneficia el grano de café proveniente de una plantación de café sostenible, y que se realiza según las especificaciones del presente Reglamento.
• 5)Café: El fruto del café completo, maduro, verde o en bellota. Su endospermo (lavado o en mucílago) o en su condición de café oro. También el grano tostado o molido descafeinado, líquido o soluble.
• 6)Café sostenible: Aquel producto listo para ser comercializado (fruta, oro, tostado, molido, o cualquier otro proceso industrial) que haya sido producido bajo un sistema de producción e industrialización de café sostenible.
• 7)Certificación: Es el procedimiento mediante el cual las entidades oficiales de certificación, o las entidades de certificación oficialmente reconocidas, acreditadas por el Ente Costarricense de Acreditación (ECA) proveen seguridad escrita o equivalente de que las unidades productivas se ajustan a los requisitos, establecidos en este Reglamento.
• 8)Comercialización: La tenencia o exposición para la venta, la puesta en venta, la entrega o cualquier otra forma de introducción al mercado.
• 9)Conservación del suelo: Es toda acción tendiente a disminuir o eliminar la erosión del suelo.
• 10)Elaboración o procesamiento: Operaciones de transformación, envasado, conservación y empaque de productos agropecuarios.
• 11)Grupo: Conjunto de productores (mayor de dos) de una zona geográ.ca común que pertenecen a una organización legalmente constituida y con un sistema de control interno en operación, así como una administración central responsable del cumplimiento de la normativa del presente Reglamento.
• 12)ICAFÉ: Instituto del Café de Costa Rica.
• 13)Industrialización: Proceso industrial posterior a la recolección de la fruta en campo.
• 14)Inspección: Labor de evaluar, visitar, fiscalizar o verificar la naturaleza sostenible de la producción y de industrialización, los procesos o las instalaciones apropiadas para los mismos, que realiza un inspector a requerimiento del ICAFÉ, del Servicio, productor o el industrializador.
• 15)Inspector en Café Sostenible: Persona física, funcionario o contratada por el ICAFÉ, que cumpla con lo dispuesto en el artículo 19 de este Reglamento, acreditado ante el Servicio y a la vez capacitada para realizar inspecciones tendientes a obtener certificación sostenible, en finca, industrializado y comercialización, debidamente inscrita ante el servicio.
• 16)Ministerio: Ministerio de Agricultura y Ganadería.
• 17)Modelo de producción de café sostenible: Modelo económico viable que se ocupa de las necesidades sociales y ambientales de todos los participantes de la cadena de abastecimiento del café, desde el productor hasta el consumidor, cumpliendo con los principios estipulados en el Capítulo I.
• 18)Operador: Persona física o jurídica que participa en cualquier etapa del proceso de certificación de café sostenible (productor, industrializador, 19) Producción: Las operaciones realizadas en la unidad productiva para la obtención, procesamiento y/o comercialización de café sostenible.
• 20)Reciclaje: Someter un material usado a un proceso para que se pueda volver a utilizar.
• 21)Registro: Base de datos administrada por el Servicio, relativa a fincas de producción de café sostenible, industriales de café sostenible, comercializadores e inspectores de Café Sostenible.
• 22)Semilla: Todo grano, tubérculo, bulbo o cualquier parte viva del vegetal que se utilice para reproducir una especie.
• 23)Servicio Fitosanitario del Estado: SFE.
• 24)Sostenibilidad: Es aquel desarrollo o proceso, que cumple con las necesidades del presente sin comprometer la capacidad de futuras generaciones para cumplir sus propias necesidades.
• 25)Unidad Productiva: Finca, parcela, planta procesadora, almacén y/ o establecimiento donde se llevan a cabo actividades de producción, proceso, almacenamiento y/o comercialización de café sostenible.
• 26)Manual de Procedimientos de Inspección en Café Sostenible:

Conjunto de regulaciones, disposiciones procedimentales y formularios, que establece la forma y contenido para la realización de las inspecciones en materia de café sostenible, el cual será elaborado en forma conjunta entre el MAG y el ICAFÉ.

• 27)Zona geográ.ca común: Se entenderá como tal las zonas electorales del ICAFÉ definidas en la Ley 2762 y sus reformas y en el artículo 73 y concordantes de su Reglamento.

Certificación

Las industrias solo podrán certificarse en forma individual. No obstante, para comercializar café sostenible, éste deberá en todo caso provenir de una finca certificada, individual o incluida en un grupo de productores, como sostenible y sujeta a procesos de industrialización certificados como tal.

• 1)El productor, industrializador, exportador o comercializador de café sostenible y el inspector deberán: hacer una descripción completa de la unidad, indicando las zonas de almacenamiento y producción así como las parcelas o las zonas de recolección de café sostenible.
• 2)El inspector deberá realizar la inspección correspondiente a cada operador o grupo y emitir su recomendación sobre si el operador o grupo cali.ca o no para la certificación como sostenible.
• 3)Tanto la descripción de la unidad sostenible como las medidas recomendadas por el inspector se incluirán en el informe de inspección, el cual será firmado por el operador o representante legal del grupo y el inspector.
• 4)Debe existir el compromiso del operador o grupo de realizar las operaciones de acuerdo con lo dispuesto en este Reglamento y, en el caso de que se determinen procedimientos inconclusos, la aplicación de las recomendaciones establecidas en dicho informe.
• 5)En el caso que las solicitudes sean presentadas por grupos de productores, todos los integrantes del grupo tienen las mismas obligaciones que de manera individual se solicitan en este reglamento. Todo documento suscrito por un grupo, deberá ser presentado por una persona jurídica que demuestre las facultades para gestionar y comprometerse en nombre de los miembros del grupo. En el caso de las solicitudes la persona jurídica debe estar facultada para gestionar la obtención de la certificación de "Café Sostenible" como grupo. El inspector, por medio de muestreo, realizará la inspección del grupo y generará un informe con base en la muestra; con ese informe el Servicio emitirá o denegará la certificación grupal.
• 6)El SFE definirá el procedimiento a seguir para definir la muestra en el caso de las certificaciones de grupo.
• 7)La certificación es para todo el grupo; por tanto, si se comprueba que alguno de su integrantes no está cumpliendo con lo indicado en este Reglamento y se considere que es motivo para suspender la certificación, siguiendo lo indicado en el artículo 37 de este reglamento, la certificación será retirada al grupo como un todo.
• 8)El grupo, para ser considerado en una certificación, debe cumplir con los siguientes requisitos:
• a)Tener una administración responsable del cumplimiento de la normativa del presente Reglamento.

b) Tener un Sistema Interno de Control (SIC).

• c)Tener información centralizada de cada uno de los integrantes del grupo.
• d)Velar porque tanto la administración central, como el responsable del SIC, tengan relación directa con los integrantes del grupo.
• e)Comercializar en forma conjunta su(s) producto(s) cuando el destino es la exportación.
• 9)Serán responsabilidades de la administración central del grupo:

a) Instalar un Sistema Interno de Control (SIC).

• b)Velar por la implementación de dicho sistema.
• c)Capacitar a sus miembros para el cumplimiento del presente Reglamento.
• d)Responder ante el SFE u órgano de control por el cumplimiento de sus miembros de la normativa establecida en el presente Reglamento y comunicar a éstos en forma inmediata de cualquier cambio en el grupo o de cualquier anomalía detectada o medida correctiva tomada.
• e)Designar y capacitar inspectores internos.
• f)Evaluar los casos de nuevas incorporaciones al grupo y exclusiones y comunicarlas al SFE.
• g)Informar a sus miembros sobre las bases de la producción sostenible y las obligaciones o responsabilidades de la certificación.
• 10)El Sistema Interno de Control (SIC) que la administración central debe establecer cumplirá con:
• a)Mantener centralizada, completa y actualizada, la información de cada uno de sus miembros.
• b)Contar con un registro de inclusiones y exclusiones debidamente documentada.
• c)Realizar la inspección del 100% de los miembros por lo menos una vez al año.
• d)Llevar los registros respectivos de productores con la siguiente información:
• 1)Nombre completo.
• 2)Número de cédula.
• 3)Área productiva.
• 4)Estimaciones de producción.
• 5)Número de parcela.
• 6)Producción (volúmenes).
• 7)Croquis y/o mapas de ubicación de la .nca.
• 8)Hojas de vistas firmadas por el inspector y por el productor.
• 9)Recibos (copias) de ventas de café.
• 10)Otras observaciones.

• 1)Las cantidades de café sostenible recibidas, procesadas y vendidas.
• 2)Los registros de planillas y de producción de la planta procesadora.

industrializadores y productores respaldando la cantidad de sacos exportada.

A su vez el Servicio podrá emitir a solicitud del interesado una constancia de que se encuentra debidamente registrado.

En el caso de que las instancias estén representadas por un tercero, a la solicitud de inscripción se debe adicionar el poder legal autenticado que lo respalda en su representación.

• 1)Nombre completo y calidades de la persona física o jurídica que solicita la inscripción.
• 2)Descripción de la actividad a la que se dedica.
• 3)Adjuntar fotocopia de la cédula de identidad o jurídica.

• 6)En el caso de persona jurídica: dirección domiciliaria y postal, número de teléfono y facsímil del representante legal de la empresa. Adjuntar su respectiva personería jurídica vigente con un máximo de tres meses de expedida.

• 1)Profesional en Agronomía graduado de una universidad reconocida con un mínimo de tres años de experiencia y amplio conocimiento del proceso productivo y de la industrialización del café.
• 2)Conocimientos básicos de cómputo y de administración para ser aplicados directamente en esta actividad.
• 3)Disponibilidad para visitar las fincas y/o las plantas procesadoras de café inscritos ante el ICAFE.
• 4)Capacidad para preparar informes concisos y coherentes sobre los aspectos evaluados en las plantaciones y plantas procesadoras de café.
• 5)Declaración jurada de que observará y respetará la confidencialidad de la información que se recolecte, la cual es propiedad del productor o industrializador.
• 6)No podrá tener relación o interés comercial con empresas, organizaciones o productores con los que tenga vínculos de inspección.

En todos los casos, si se produce una contaminación, la misma debe documentarse en los registros de la finca y el productor se comunicará en forma inmediata con el Servicio.

Órgano de control

• 1)Recibir la solicitud de inspección y remitirla al inspector del ICAFE para que proceda a la realización de la inspección.
• 2)Autorizar y fiscalizar a los inspectores de café sostenible.
• 3)Llevar el registro nacional de inspectores, fincas, plantas procesadoras de café y comercializadores certificados como sostenibles.
• 4)Establecer un sistema de supervisión a todas aquellas personas físicas o jurídicas que intervengan en el proceso de producción, industrialización y comercialización de café sostenible.
• 5)Poner a disposición de los interesados una lista actualizada con los nombres y direcciones de los operadores que estén sometidos al presente reglamento, así como las unidades productivas certificadas y fecha de certificación.
• 6)Realizar la capacitación a las personas encargadas de efectuar las inspecciones a las unidades productivas.
• 7)Será el órgano que establecerá las medidas correctivas a los operadores certificados, igualmente será ante el cual podrán recurrir éstos para presentar sus reclamos en caso de inconformidad. En segunda instancia resolverá el superior jerárquico del Ministerio de Agricultura.

El Servicio tomará las medidas necesarias para:

• 1)Asegurar que las inspecciones realizadas sean objetivas.
• 2)Retirar la autorización al inspector, o la certificación de la unidad productiva cuando no cumpla con los requisitos establecidos en la legislación o normativa vigente, informando al ICAFE para que tome las medidas que correspondan.

Vencido este plazo y no cumplido lo solicitado, el Servicio procederá a rechazar la solicitud.

Para renovar la certificación, el interesado deberá cumplir con lo establecido en los artículos anteriores. La solicitud de renovación deberá presentarse a más tardar sesenta días naturales antes de que la certificación pierda vigencia. En caso de que la solicitud de renovación de certificación se presente en forma tardía, y/o vencida la certificación, la producción cosechada fuera del período de certificación no calificará como café sostenible.

De los procedimientos administrativos para la aplicación de este Reglamento

Asimismo su actuación deberá estar exenta de trato discriminatorio y todos los procedimientos deberán garantizar transparencia. El Servicio deberá respetar la información considerada propiedad del cliente o que se indique expresamente como confidencial. La divulgación de la información subsecuente a la certificación, se hará a discreción del Servicio y en cumplimiento de sus competencias para fines u objetivos públicos o con el consentimiento del cliente.

Es ante esta instancia administrativa donde los interesados podrán presentar las denuncias correspondientes en forma verbal o escrita.

La medida o suspensión será establecida por el Servicio y su resolución podrá ser apelada ante el superior jerárquico dentro de un plazo de 5 días naturales después de recibida la notificación.
