Complete Text of acta: F3CC1 Nº 30930-MAG Nº 30930-MAG (This executive decree was repealed by article 1 of executive decree N° 37947 of July 18, 2013) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF AGRICULTURE AND LIVESTOCK In exercise of the powers conferred upon them by articles 140, subsections 3), 8), 18), and 20) and 146 of the Political Constitution, articles 25, 27.1, 28.1.b of Law Nº 6227 of May 2, 1978, General Law of Public Administration, and Law Nº 7064 of April 29, 1987, Law for the Promotion of Agricultural Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock.

1That it is in the Government's interest to execute and consolidate the plantain and oil palm project of the Southern Pacific Region, as a viable alternative to improve the socioeconomic situation of the region, because these are crops that promote the use of labor, broad participation of benefits in the scale economy, generation of foreign currency for the country, and foster greater rootedness and stability of the benefits.
2That it is necessary to establish, in the region, the transformation of the current use of the banana farms.
3That our country has efficient development in research and technology in the agricultural and industrial area of both crops, in addition to the agro-ecological conditions for the development of the crops in the region.
4That it is a priority to facilitate an effective reconversion of these farms, as well as of the beneficiaries, into models of greater production and productivity, through the establishment of permanent and intensive plantations of plantain for export and oil palm, directed to domestic and external consumption.
5That it is important to support the effort made by the institutions of the agricultural sector and the Cooperative of Banana Exporters of the Southern Zone of the Province of Puntarenas, which seek to improve their socioeconomic situation and a better way of life by establishing a stable agricultural and industrial activity in the cantons of Osa, Corredores, and Golfito, which have established their interest in participating in the execution of the plantain and oil palm Project.
6That the cultivation of plantain and oil palm can become a sustainable and appropriate activity for the socioeconomic development of this southern zone of the Province of Puntarenas, making it appropriate to promote the development and promotion of these projects, through the allocation of resources and support from the Institutions of the Costa Rican State. Therefore,

THEY DECREE:

Considering:

- A General Coordinator of the Project. - A Professional in Agronomy in charge of the crops. - A Professional responsible for organizational support (acompañamiento), administrative matters, and training. - A Project Administrator.

All human resources shall be contracted for the duration of the project's execution and in a concerted manner between the IDA and SURCOOP R.L.

Its functions shall include: a) Administratively contracting the acquisition of goods and services, in accordance with the legal norms and procedures applicable to the matter, that are necessary for SURCOOP R.L. to carry out the field implementation of the development project. b) Preparing all detailed operational plans and budgets for the project and supervising the adequate and timely execution. c) Establishing the necessary coordination with the various entities participating in the execution of the diverse components of the Project; d) Submitting the reports required by the Administration of the Institute; e) Administering the project resources.

- The Minister of Agriculture and Livestock or their representative, who shall preside over it. - The Executive President or Manager of the IDA or the representative that either of them designates for this purpose. - The Executive President of the National Production Council or the representative that they designate for this purpose. - The Manager or Deputy Manager of the National Groundwater, Irrigation, and Drainage Service. - The President of the Board of Directors or Executive Director of JUDESUR. - A representative of the Cooperativa Agropecuaria de Servicios Múltiples del Sur. - The Regional Director of the Agricultural Sector. - The MAG Manager of the National Plantain and Oil Palm Program. - A representative of INFOCOOP.

The representative members from the public entities comprising the Commission shall serve for the duration of their term in office.

The representative member of the producers shall serve in the position for periods of two years, may be designated for successive periods, and may be freely removed by the indicated organization.

A quorum for sessions shall consist of five members of the Commission, and its agreements shall be adopted by a simple majority of votes present.

a)Recommending actions, requirements, and strategies for the promotion and development of the activities in the country, so that the competent public institutions execute the corresponding actions to achieve this end.
b)Following up on and coordinating the necessary and required aspects, in the contracts, works, and support that the executors of the Agroindustrial Development Project of the Southern Zone would receive.
c)Managing resources and economic support from the Government to the competent Institutions, for the execution of the Agroindustrial Development Project of the Southern Region of the Province of Puntarenas.
d)Any others that are consistent with and necessary for the fulfillment of the purposes of the Commission.

1Que es de interés del Gobierno, la ejecución y consolidación del proyecto de plátano y palma aceitera de la Región Pacífico Sur, como alternativa viable para mejorar la situación socioeconómica de la región, en razón de que son cultivos que promueven la utilización de mano de obra, amplia participación de los beneficios en la economía de escala, generación de divisas al país y propician un mayor arraigo y estabilidad de los beneficios.
2Que se hace necesario establecer en la región, la transformación del uso actual de las fincas bananeras.
3Que nuestro país tiene un eficiente desarrollo en investigación y tecnología en el área agrícola e industrial de ambos cultivos, además de las condiciones agro-ecológicas para el desarrollo de los cultivos en la región.
4Que es prioritario facilitar una reconversión efectiva de estas fincas, así como de los beneficiarios, en modelos de mayor producción y productividad, mediante el establecimiento de plantaciones permanentes e intensivas de plátano para la
5Que es importante apoyar el esfuerzo que efectúan las instituciones del sector agropecuario y Cooperativa de Exportadores Bananeros de la Zona Sur de la Provincia de Puntarenas, que buscan mejorar su situación socioeconómica y una mejor forma de vida estableciendo una actividad agrícola e industrial estable en los cantones de Osa, Corredores y Golfito, las cuales han establecido su interés en participar en la realización del Proyecto de plátano y palma aceitera.
6Que el cultivo de plátano y palma aceitera puede convertirse en una actividad sostenible y apropiada para el desarrollo socioeconómico de esta zona sur de la Provincia de Puntarenas, resultando procedente promover el desarrollo y fomento de estos proyectos, mediante la asignación de recursos y apoyo de las Instituciones del Estado Costarricense. Por tanto,

Considerando:

DECRETAN:

- Un Coordinador General del Proyecto. - Un Profesional en Agronomía encargado de los cultivos. - Un Profesional responsable del acompañamiento organizativo, administrativo y capacitación. - Un Administrador del Proyecto.

Todo el recurso humano será contratado por el tiempo de ejecución del mismo y en forma concertada entre el IDA y SURCOOP R.L.

Entre sus funciones estarán: a) Contratar administrativamente la adquisición de los bienes y servicios, de conformidad con las normas jurídicas y procedimientos aplicables en la materia, que sean necesarios para que SURCOOP R.L., pueda llevar a cabo la implementación en campo, del proyecto de desarrollo. b) Preparar todos los planes detallados operativos y presupuestos del proyecto y supervisar la adecuada y oportuna ejecución. c) Establecer la coordinación necesaria con las diversas entidades que participan en la ejecución de los diversos componentes del Proyecto; d) Presentar los informes requeridos por la Administración del Instituto; e) Administrar los recursos del proyecto.

- El Ministro de Agricultura y Ganadería o su representante, quien la presidirá. - El Presidente Ejecutivo o Gerente del IDA o el representante que cualquiera de éstos designe al efecto. - El Presidente Ejecutivo del Consejo Nacional de Producción o el representante que éste designe al efecto. - E1 Gerente o Subgerente del Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento. - El Presidente de la Junta Directiva o Director Ejecutivo de JUDESUR. - Un representante de la Cooperativa Agropecuaria de Servicios Múltiples del Sur. - El Director Regional del Sector Agropecuario. - El Gerente del MAG del Programa Nacional de Plátano y el de Palma Aceitera. - Un representante del INFOCOOP.

Los miembros representantes de las instancias públicas integrantes de la Comisión, lo serán durante el tiempo que permanezcan en el ejercicio del cargo.

El miembro representante de los productores ejercerá el cargo por períodos de dos años, pudiendo ser designado para períodos sucesivos y de libre remoción por la organización indicada.

Harán quórum para sesionar cinco miembros de la Comisión y sus acuerdos se adoptarán por mayoría simple de votos presentes.

a)Recomendar las acciones, requerimientos y estrategias de fomento y desarrollo de las actividades en el país, con el fin de que las instituciones públicas competentes ejecuten las acciones correspondientes para lograr tal fin. b) Darle seguimiento y coordinar los aspectos necesarios y requeridos, en los contratos, obras y apoyo que recibieran los ejecutantes del Proyecto de Desarrollo Agroindustrial de la Zona Sur. c) Gestionar recursos y el apoyo económico del Gobierno a las Instituciones competentes, para la ejecución del Proyecto de Desarrollo Agroindustrial de la Región Sur de la Provincia de Puntarenas. d) Cualesquiera otras que sean congruentes y necesarias para el cumplimiento de los fines de la Comisión.

Declaration of Public Interest for the Southern Zone Agroindustrial ProjectDeclaratoria de Interés Público para el Proyecto Agroindustrial de la Zona Sur

Artículo 1 — —The execution of the Agroindustrial Development Project for the Southern Zone of the Province of Puntarenas is declared to be of national and social public interest.

Artículo 3 — —The Executing Unit must prepare Internal Regulations to govern its functioning and operation.

Artículo 4 — —For the purposes of support (acompañamiento) and decision-making in a concerted manner and with participation from the beneficiaries and supporting institutions, an Interinstitutional Consultative Commission is constituted, composed of:

Artículo 8 — —The Cooperativa Agropecuaria de Servicios Múltiples del Sur (SURCOOP R.L.) shall be responsible for the field implementation of the project for the establishment and development of plantain and oil palm cultivation.

Artículo 9 — —Shall take effect from its publication.

Artículo 1 — Se declara de interés público nacional y social, la ejecución del Proyecto de Desarrollo Agroindustrial de la Zona Sur de la Provincia de Puntarenas.

Artículo 3 — —La Unidad Ejecutora deberá elaborar un Reglamento Interno que regule su funcionamiento y operación.

Artículo 4 — —Para los efectos de acompañamiento y toma de decisiones de forma concertada y con participación de los beneficiarios e instituciones de apoyo, se constituye una Comisión Interinstitucional de Consulta, integrada por:

Artículo 8 — —La Cooperativa Agropecuaria de Servicios Múltiples del Sur (SURCOOP R.L.), será la responsable de la implementación en campo del proyecto de establecimiento y desarrollo del cultivo de plátano y palma aceitera.
