in the entirety of the text - Complete Text of Norm 30894 Exempts from the application of the suspension of receiving applications for mining procedures contained in the decree that Creates the Commission for Evaluation and Diagnosis of Geological and Mining Activities, at the request of the Ministry of Public Security Complete Text of record: 5E8E8 No. 30894-MINAE No. 30894-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Based on the powers conferred by articles 140 subsections 3) and 18) and 50 of the Political Constitution; article 11 of the Biodiversity Law, No. 7788 of May 27, 1998; the Organic Law of the Environment, No. 7554 of October 4, 1995, the Mining Code, Law No. 6797 of October 4, 1982, Executive Decree No. 30477-MINAE of June 12, 2002, and the General Law of Public Administration, No. 6227 of May 2, 1978.
1.—That article 50 of the Political Constitution establishes the obligation for the State to ensure that citizens enjoy a healthy and ecologically balanced environment.
2.—That the Mining Code establishes the absolute, inalienable, and imprescriptible domain of the State over all mineral resources found in the national territory and in its patrimonial sea, whatever their origin, physical state, or the nature of the substances they contain. It also establishes that the State will endeavor to exploit mineral wealth by itself or through organisms that depend on it, with the Directorate of Geology and Mines (Dirección de Geología y Minas) being responsible for ensuring the correct application of mining legislation in the phases of processing permits or concessions, in their exercise or extinction, in addition to providing a geological service of study and research.
3.—That the Ministry of Environment and Energy (Ministerio del Ambiente y Energía), through Executive Decree No. 30646-MINAE published in the Official Gazette La Gaceta No. 166 of August 30, 2002, with the interest of implementing a Modernization Plan for the Directorate of Geology and Mines, to provide agility to the public service and raise the quality of the services, created the Commission for Evaluation and Diagnosis of Geological and Mining Activities of the Directorate of Geology and Mines of the Ministry of Environment and Energy, composed of technical, administrative, and legal personnel from the Institution and other governmental and non-governmental organizations to carry out the task of analysis, diagnosis, and evaluation of the different stages developed in that Directorate. Likewise, all receipt of applications for mining permits and concessions before the Directorate of Geology and Mines was suspended for a period of 4 months from the promulgation of that Decree. Exempted from the application of the cited Executive Decree were the authorization requests submitted by the National Emergency Commission (Comisión Nacional de Emergencias), the Municipalities, and the Ministry of Public Works and Transport (Ministerio de Obras Públicas y Transportes), as they are matters of public interest.
4.—That on September 25, 2002, the Ministry of Public Security (Ministerio de Seguridad Pública) submitted to the Directorate of Geology and Mines an application for mining extraction in the channel of the Sapoá River and other quarry sites, in the Canton of La Cruz, Province of Guanacaste, in order to supply materials for the construction of the project "Peñas Blancas Drug Control Inspection Station" (Estación de Inspección para el control de drogas Peñas Blancas), which is a public work, paid for by the Government of the United States of America for that Ministry and approved by the Ministry of Foreign Affairs, whose works are of utmost importance and urgency to combat and control the illicit activities derived from the trafficking, consumption, and possession of drugs on the Northern Border. As this activity being promoted is of public interest for having immediate repercussions on Costa Rican society and internationally, the Costa Rican State must address giving priority and agility to this type of request due to the social, economic, and public health implications they entail. 1Que el artículo 50 de la Constitución Política establece la obligación para el Estado de velar porque los ciudadanos disfruten de un ambiente sano y ecológicamente equilibrado.
2Que el Código Minero dispone el dominio absoluto, inalienable e imprescriptible por parte del Estado, de todos los recursos minerales que se encuentren en el territorio nacional y en su mar patrimonial, cualquiera que sea su origen, estado físico o naturaleza de las sustancias que contengan. Asimismo dispone que el Estado procurará explotar las riquezas mineras por sí mismo o por medio de organismos que dependan de él, correspondiendo a la Dirección de Geología y Minas velar por la correcta aplicación de la legislación minera en las fases de tramitación de permisos o concesiones, en su ejercicio o extinción, además de brindar un servicio geológico de estudio e investigación.
3Que el Ministerio del Ambiente y Energía, por medio del Decreto Ejecutivo Nº 30646-MINAE publicado en el Diario Oficial La Gaceta Nº 166 del 30 de agosto del 2002, con el interés de poner en ejecución un Plan de Modernización de la Dirección de Geología y Minas, dar agilidad al servicio público y elevar la calidad de los servicios, creó la Comisión de Evaluación y Diagnóstico de las Actividades Geológicas y Mineras de la Dirección de Geología y Minas del Ministerio del Ambiente y Energía, compuesta por personal técnico, administrativo y legal de la Institución y de otras organizaciones gubernamentales y no gubernamentales para que realicen la tarea de análisis, diagnóstico y evaluación de las diferentes etapas que se desarrollan en esa Dirección. Asimismo, se suspendió por un plazo de 4 meses a partir de la promulgación de ese Decreto, toda recepción de solicitudes de permisos y concesiones mineras ante la Dirección de Geología y Minas. Se exceptuó de la aplicación del citado Decreto Ejecutivo, las solicitudes de autorización que presenten la Comisión Nacional de Emergencias, las Municipalidades y el Ministerio de Obras Públicas y Transportes, por tratarse de interés público.
4Que el día 25 de setiembre del 2002, el Ministerio de Seguridad Pública presenta ante la Dirección de Geología y Minas, una solicitud de extracción minera en el cauce del Río Sapoá y otros sitios de cantera, en el Cantón de La Cruz, Provincia de Guanacaste, con el fin de abastecer de materiales la construcción del proyecto "Estación de Inspección para el control de drogas Peñas Blancas", que es una obra pública, pagada por el Gobierno de los Estados Unidos de América para ese Ministerio y aprobada por el Ministerio de Relaciones Exteriores, cuyas obras son de suma importancia y urgencia para combatir y controlar las actividades ilícitas que se derivan por el trasiego, consumo y tenencia de drogas en la Frontera Norte.
