in the entirety of the text - Complete Text of Regulation 30888 Modifies the budget limit and effective spending limit established for the National Parks Fund Complete Text of act: 5D6F4 N° 30888-H N° 30888-H THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred by articles 140, subsections 3) and 18), and 146 of the Political Constitution, articles 26 and 27 of the General Public Administration Law, Laws N° 7554 of October 4, 1995, N° 6084 of August 17, 1977, Executive Decree N° 24652 MIRENEM of September 20, 1995, and articles 23 and 24 of Law N° 8131 of September 18, 2001.

1. 1That by constitutional mandate, the Costa Rican State is responsible for guaranteeing citizens the enjoyment of a healthy and ecologically balanced environment.
2. 2That the Organic Environmental Law N° 7554 establishes that the Ministry of Environment and Energy (MINAE) is the governing body in environmental matters, and must therefore ensure the protection, conservation, and use of natural resources as an indispensable condition for sustainable economic development.
3. 3That the National Parks Fund is part of the National System of Conservation Areas, through which the protection, conservation, control, and promotion of these areas is carried out, and it requires the incorporation of additional resources to implement actions aimed at fulfilling its institutional mission.
4. 4That the aforementioned regulations empower MINAE to acquire and include under a management category those lands considered indispensable for the protection and conservation of environmental heritage, making it necessary to incorporate additional resources into the budget of the National Parks Fund for the payment of lands destined for Piedras Blancas National Park.
5. 5That through Executive Decree N° 29511-H, published in La Gaceta N° 98 of May 23, 2001, the Budget Authority formulated the General Budgetary Policy Directives for 2002, which were made known to the Governing Council and approved by the President of the Republic, establishing the budget spending limit and effective spending limit for the current year for the entities covered by the scope of the aforementioned Collegiate Body.
6. 6That Executive Decree Nº 30643-H, published in La Gaceta N° 166 of August 30, 2002, modifies Decree Nº 29511-H and its amendments, which establishes the budget and effective spending limit of the National Parks Fund for 2002.
7. 7That due to the foregoing, it is necessary to modify the spending limits set for said entity in the cited Decree. Therefore,

en la totalidad del texto - Texto Completo Norma 30888 Modifica el límite presupuestario y de gasto efectivo establecido al Fondo de Parques Nacionales Texto Completo acta: 5D6F4 N° 30888-H N° 30888-H EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE HACIENDA Con fundamento en las atribuciones que le confieren los artículos 140, incisos 3) y 18) y 146 de la Constitución Política, los artículos 26 y 27 de la Ley General de la Administración Pública, las Leyes N° 7554 del 4 de octubre de 1995, N° 6084 del 17 de agosto de 1977, el Decreto Ejecutivo N° 24652 MIRENEM del veinte de setiembre de 1995 y los artículos 23 y 24 de la Ley N° 8131 del 18 de setiembre del 2001.

1. 1Que por imperativo constitucional al Estado costarricense le corresponde garantizar a los ciudadanos el disfrute de un ambiente sano y ecológicamente equilibrado.
2. 2Que la Ley Orgánica del Ambiente N° 7554, establece que el Ministerio del Ambiente y Energía (MINAE) es el ente rector en materia ambiental, por lo que debe velar por la protección, conservación y aprovechamiento de los recursos naturales como condición indispensable para el desarrollo económico sostenible.
3. 3Que el Fondo de Parques Nacionales forma parte del Sistema Nacional de Áreas de Conservación, mediante el cual se lleva a cabo la protección, conservación, control y fomento de las mismas y requiere incorporar recursos adicionales para implementar acciones con miras al cumplimiento de su misión institucional.
4. 4Que la citada normativa faculta al MINAE para adquirir e incluir bajo una categoría de manejo, aquellas tierras consideradas indispensables para la protección y conservación del patrimonio ambiental, por lo que resulta necesario incorporar recursos adicionales en el presupuesto del Fondo de Parques Nacionales para el pago de las tierras destinadas al Parque Nacional Piedras Blancas.
5. 5Que mediante el Decreto Ejecutivo N° 29511-H, publicado en La Gaceta N° 98 del 23 de mayo del 2001, la Autoridad Presupuestaria formuló las Directrices Generales de Política Presupuestaria para el 2002, las cuales fueron conocidas por el Consejo de Gobierno y aprobadas por el Presidente de la República, estableciendo el límite de gasto presupuestario y de gasto efectivo del presente año, para las entidades cubiertas por el ámbito del mencionado Órgano Colegiado.
6. 6Que el Decreto Ejecutivo Nº 30643-H, publicado en La Gaceta N° 166 del 30 de agosto del 2002, modifica el Decreto Nº 29511-H y sus reformas que establece el limite de gasto presupuestario y efectivo del Fondo de Parques Nacionales para el 2002.
7. 7Que por lo anterior, resulta necesario modificar los límites de gasto fijados a dicho ente en el Decreto citado. Por tanto,
