APPROVAL OF THE CONSTITUTIVE AGREEMENT OF THE CENTRAL AMERICAN INTER-PARLIAMENTARY COMMISSION ON ENVIRONMENT AND DEVELOPMENT Sole Article.-The Constitutive Agreement of the Central American Inter-Parliamentary Commission on Environment and Development, adopted in Panama City on March 15 and 16, 1991, is hereby approved in each of its parts. The text is as follows:
"CONSTITUTIVE AGREEMENT OF THE CENTRAL AMERICAN INTER-PARLIAMENTARY COMMISSION ON ENVIRONMENT AND DEVELOPMENT The Presidents of the Commissions on Environment and Natural Resources of the Legislative Branches of the Republics of Costa Rica, El Salvador, Guatemala, Honduras, Nicaragua, Panama, and Belize, during the Extraordinary Meeting held in Panama City on March 15 and 16, 1991; Convinced of the need to establish regional cooperation mechanisms for the rational use of natural resources, pollution control, and the preservation and restoration of ecological balance; Aware that the Legislative Branches of the countries of the area must assume the great responsibility incumbent upon them in the task of combating the alarming deterioration of the environment in the region, especially in the area of improving environmental legislation, based on a Central American vision of matters concerning the environment and development; Considering the importance of permanently examining the state of domestic and international legislation in the countries of the area, as well as the problems presented by its application, within the framework of a coordinated legislative policy for the improvement of the legal systems that currently protect the environment in the countries of the area; Empowered by their respective Legislative Branches to sign ad referendum an Agreement for the Constitution of a Central American Inter-Parliamentary Commission on Environment and Development; We have decided to sign this agreement, which shall be called:
CONSTITUTIVE AGREEMENT OF THE CENTRAL AMERICAN INTER-PARLIAMENTARY COMMISSION ON ENVIRONMENT AND DEVELOPMENT

CHAPTER I
Institutional Provisions
CHAPTER II
Each Legislative Branch shall designate, from among those Presidents, a Titular Delegate to the Commission.
CHAPTER III
The Commission shall be responsible for:
The Commission shall meet ordinarily during the first quarter of each year in the country holding the Presidency, and extraordinarily when requested by two or more of the Contracting States.
CHAPTER IV
The President shall have the power to delegate, to the Executive Secretariat, the powers deemed pertinent. The presidency shall be held for one-year terms and shall rotate in accordance with the alphabetical order of the member countries.
They shall be obliged to submit periodic reports in order to determine the progress of the tasks assigned to them. The Secretariat shall be responsible for coordinating them.

For the other countries, it shall enter into force on the date of deposit of their respective instruments of ratification.
The denunciation shall take effect for the denouncing State six months after being deposited, and the Agreement shall continue in force among the other parties, provided that at least three of them remain adherent to it.

APROBACIÓN DEL CONVENIO CONSTITUTIVO DE LA COMISIÓN INTERPARLAMENTARIA CENTROAMERICANA DE AMBIENTE Y DESARROLLO Artículo único.-Apruébase, en cada una de las partes, el Convenio Constitutivo de la Comisión Interparlamentaria Centroamericana de Ambiente y Desarrollo, adoptado en la ciudad de Panamá, los días 15 y 16 de marzo de 1991. El texto es el siguiente:
"CONVENIO CONSTITUTIVO DE LA COMISIÓN INTERPARLAMENTARIA CENTROAMERICANA DE AMBIENTE Y DESARROLLO Los Presidentes de las Comisiones sobre Ambiente y Recursos Naturales de los Poderes Legislativos de las Repúblicas de Costa Rica, El Salvador, Guatemala, Honduras, Nicaragua, Panamá y Belice, durante la Reunión Extraordinaria celebrada en la Ciudad de Panamá, los días 15 y 16 de marzo de 1991; Convencidos de la necesidad de establecer los mecanismos regionales de cooperación para la utilización racional de los recursos naturales, el control de la contaminación y la preservación y restablecimiento del equilibrio ecológico; Conscientes que los Poderes Legislativos de los países del área deben asumir la gran responsabilidad que les cabe en la tarea de combatir el alarmante deterioro del medio ambiente en la región, especialmente en el campo del perfeccionamiento de la legislación ambiental, a partir de una visión centroamericana de los asuntos concernientes al ambiente y al desarrollo; Considerando la importancia de examinar permanentemente el estado de la legislación interna e internacional de los países del área, así como los problemas que presenta su aplicación, en el marco de una política legislativa coordinada para el perfeccionamiento de los sistemas jurídicos que en la actualidad protegen al medio ambiente en los países del área; Facultados por sus respectivos Poderes Legislativos para suscribir ad referéndum un Convenio para la Constitución de una Comisión Interparlamentaria Centroamericana de Ambiente y Desarrollo; Hemos decidido suscribir el presente convenio que se denominará:

DECRETA:
CAPÍTULO I
ch) Promover la cooperación para el tratamiento de los asuntos ambientales nacionales, subregionales, regionales y mundiales que conciernan al Istmo Centroamericano.
CAPÍTULO II
Disposiciones institucionales
Cada Poder Legislativo designará, de entre esos Presidentes, un Delegado Titular ante la Comisión.
CAPÍTULO III
Corresponde a la Comisión:
ch) Elaborar modelos de legislación, en especial de leyes marco, que sirvan de base para la generación de normas jurídicas apropiadas, que puedan adoptarse según el desarrollo de cada una de las naciones del Istmo Centroamericano.
La Comisión se reunirá ordinariamente el primer trimestre de cada año en el país que ocupe la Presidencia, y extraordinariamente cuando lo soliciten dos o más de los Estados Contratantes.
CAPÍTULO IV
El Presidente tendrá la facultad de delegar en la Secretaría Ejecutiva, las atribuciones que considere pertinentes. La presidencia será ejercida por períodos de un año y se alternará de conformidad con el orden alfabético de los países miembros.
Quedarán obligadas a entregar informes periódicos, a fin de determinar el avance de las tareas que les hayan sido asignadas. La Secretaría será la encargada de ejercer la coordinación de las mismas.
CAPÍTULO V
Disposiciones generales
CAPÍTULO VI
Para los demás países, entrará en vigor en la fecha de depósito de sus respectivos instrumentos de ratificación.
La denuncia surtirá efectos para el Estado denunciante, seis meses después de depositada, y el Convenio continuará en vigor entre las demás partes, en tanto permanezcan adheridas a él por lo menos tres de ellas.
