That this experience of more than five years has allowed this administrative body to specialize in the subject, for which reason it is considered viable that the aforementioned Fund be the principal entity to regulate and determine the technical-administrative process for the payment and collection of environmental services, including the procedures manual, selection of beneficiaries, evaluation of documents, and formalization of contracts.

Furthermore, FONAFIFO will be responsible for the legal recovery of this benefit in case of non-compliance, as well as the supervision, follow-up, and control of the payment for environmental services that are approved, so that the staff of the conservation areas (áreas de conservación) can more effectively devote themselves to the other tasks within their purview.

7414, the Regional Agreement on Climate Change, ratified by Law No. 7513, the Convention on Biological Diversity, ratified by Law No. 7416, and that by ratifying the aforementioned agreements, the Costa Rican State has committed to promoting the internalization of environmental costs and the use of economic instruments that can guarantee the protection of the environment.

8220, Law for the Protection of the Citizen from Excessive Requirements and Administrative Procedures, the Public Administration is obligated to be more efficient in its management, protecting the administered party from unnecessary procedures and requirements. Therefore, THEY DECREE:

25721-MINAE, Regulation of the Forest Law, and its amendments, published in the Official Gazette La Gaceta No. 16 of January 23, 1997, to read as follows:

With regard to the promotion of the forest sector and specifically regarding payment for Environmental Services in any of its modalities, both institutions may carry out joint actions in order to fulfill the objectives emanating from forest legislation.

The functions exercised by SINAC shall be carried out through programs and projects based on policies and priorities established by the Minister of Environment and Energy. They shall likewise be promoted and coordinated by the Technical Support Unit and executed integrally by the Conservation Areas.

SINAC shall have the following organization:

• a)A Senior Director (a) of Natural Resources b) An Executive Director(a) of SINAC c) A Technical Unit and a Support Unit d) Eleven Conservation Areas, which shall be divided geographically by previously established limits, and which shall be the following:

Amistad Caribe Conservation Area Amistad Pacífico Conservation Area Arenal - Huetar Norte Conservation Area Central Volcanic Mountain Range Conservation Area Guanacaste Conservation Area Central Pacific Conservation Area Osa Conservation Area Tempisque Conservation Area Tortuguero Conservation Area Coco Island Conservation Area Arenal - Tilarán Conservation Area Each of the Conservation Areas shall have its respective integration and shall perform its functions in accordance with the principles contained in the General Regulation of the Ministry of Environment and Energy, Executive Decree No. 30077-MINAE of January 16, 2002, being the Regional Offices where the services of the State Forest Administration shall be provided. The Conservation Areas are authorized to implement the establishment of Subregional offices as necessary, upon justification to the Directorate of SINAC.

The functions of the Director of SINAC are those designated by Executive Decree No. 30077-MINAE of January 16, 2002, and regarding those of the Senior Director of Natural Resources, those assigned by the Minister and the established legal provisions.

Once the proposal is approved by the Ministerial Head, the Executive Branch, through Executive Decree, shall establish annually the number of hectares available, the amount per hectare, and the payment mechanism. The regulations and procedures to execute the payment for environmental services shall be issued by FONAFIFO, under the duly established guidelines.

For this purpose, the application must be in writing, providing the required documentation, a statement of the area to be protected, reforested, or agroforestry systems (SAF), and a place to receive notifications; in the case of legal entities, the certification of legal status (personería jurídica) shall be included.

These documents shall be evaluated technically and legally by FONAFIFO within a maximum period of ten business days. If it is considered that they meet the legal and technical conditions, the offeror shall be notified that their pre-application has been approved and that they may proceed to prepare the technical study, according to the established procedures. The applications within each priority area shall be processed in strict adherence to the order of submission; for this purpose, they shall be numbered and dated. Once the maximum limit for each modality has been reached, the subsequent applicants shall be notified that their application will be held in abeyance pending resolution. If it is not awarded during the corresponding period, it shall have priority for the following period, remaining in a temporary file.

In the event that the established pre-selection or pre-application requirements are not met, the National Forest Financing Fund shall indicate the defects or omissions, granting up to thirty days for their fulfillment. If what was required is not submitted or is submitted incorrectly again, the pre-application shall be archived without further processing.

If the application is approved, with the respective technical study, FONAFIFO shall proceed to prepare the corresponding contract, which must be signed by the Ministerial Head or by whomever this person officially delegates their signature to, and by FONAFIFO, for which it shall have a period of up to thirty calendar days from the submission of the technical study.

SINAC may carry out the follow-up and control of the program according to the control strategy it establishes.

With regard to the application of forest incentives, SINAC shall be responsible for its resolution, all in accordance with existing regulations.

The payment for environmental services shall be granted upon presentation of individual projects to each organization, and the organization shall in turn deliver and distribute them among the participating associates.

FONAFIFO shall define the authorized organizations for each Conservation Area; for this, they must demonstrate through a written application that they meet the following requirements:

• a)Demonstrate they are legally constituted.
• b)Certification of legal status (personería jurídica).
• c)Demonstrate successful, verifiable field experience in the execution of forest or environmental projects. This requirement does not apply to new organizations, but does apply to their members or permanent staff.
• d)Have no outstanding obligations regarding forest projects, financing programs, incentives, or credit granted by MINAE or any of its attached bodies.
• e)Have an organizational structure that allows them sufficient administrative, accounting, and technical capacity for the direction and execution of these projects.
• f)Have a strategic framework where the projects to be developed annually form part of a Regional Forest Development Program.
• g)Commit not to charge more than 18% of the amount corresponding to each beneficiary for advisory and assistance services or any other administrative cost.

Once the above requirements are met, FONAFIFO shall issue a resolution stating that the organization meets the requirements that allow them direct access to the resources for the payment for environmental services.

Likewise, a procedure shall be defined with the requirements and conditions for the processing of the payment for environmental services under the modalities of reforestation or conservation, or forest agroforestry systems (SAF), as applicable.

• a)Resolve on the credit applications and payment for environmental services presented to it.
• b)Approve the Credit and Payment for Environmental Services Regulations and their modifications.
• c)Supervise and evaluate the actions of the Executing Office.
• d)Authorize the hiring of personnel and professional services for the execution and control of the operations it carries out.
• e)Authorize the issuance of bonds and other securities.

From this percentage, FONAFIFO must transfer 2% to SINAC to contribute to the financing of supervision activities, in accordance with the Control Strategy of SINAC.

FONAFIFO must submit the budget corresponding to the remaining 5% for the prior approval of SINAC.

Que esta experiencia de más de cinco años, a permitido especializar a este órgano de la Administración en el tema, por lo que se considera viable que sea principalmente el citado Fondo quien regule y determine el proceso técnico-administrativo para el pago y cobro de los servicios ambientales, incluyendo el manual de procedimientos, selección de beneficiarios, evaluación de documentos y formalización de contratos.

Además a FONAFIFO le corresponderá la recuperación legal de este beneficio en caso de incumplimiento, así como la supervisión, seguimiento y control del pago de servicios ambientales que se aprueben, para que con ello, el personal de las áreas de conservación pueda avocarse con mayor eficacia en la atención de las demás labores que le competen.

Por tanto,

En lo relativo al fomento del sector forestal y específicamente en cuanto al pago por Servicios Ambientales en cualquiera de sus modalidades ambas instituciones podrán realizar acciones conjuntas con el fin de cumplir los objetivos emanados de la legislación forestal.

Las funciones ejercidas por SINAC se realizarán mediante programas y proyectos basados en políticas y prioridades establecidas por el Ministro del Ambiente y Energía. Asimismo serán promovidas y coordinadas por la Unidad Técnica de Apoyo y ejecutadas en forma integral por las Áreas de Conservación.

El SINAC tendrá la siguiente organización:

• a)Un Director (a) Superior de Recursos Naturales b) Un Director(a) Ejecutivo del SINAC c) Una Unidad Técnica y una Unidad de Apoyo d) Once Áreas de Conservación, que estarán divididas geográficamente, mediante límites previamente fijados, y que serán las siguientes:

Área de Conservación Amistad Caribe Área de Conservación Amistad Pacífico Área de Conservación Arenal - Huetar Norte Área de Conservación Cordillera Volcánica Central Área de Conservación Guanacaste Área de Conservación Pacífico Central Área de Conservación Osa Área de Conservación Tempisque Área de Conservación Tortuguero Área de Conservación Isla del Coco Área de Conservación Arenal - Tilarán Cada una de las Áreas de Conservación contará con la integración respectiva y desempeñará las funciones de conformidad con los principios contenidos en el Reglamento General del Ministerio del Ambiente y Energía, Decreto Ejecutivo Nº 30077-MINAE del 16 de enero del 2002, siendo las Oficinas Regionales donde se prestarán los servicios de la Administración Forestal del Estado. Se autoriza a las Áreas de Conservación para implementar el establecimiento de oficinas Subregionales que sean necesarias, previa justificación ante la Dirección del SINAC.

Las funciones del Director del SINAC, son las designadas mediante el Decreto Ejecutivo Nº 30077-MINAE del 16 de enero del 2002, y en cuanto a las del Director Superior de Recursos Naturales las que le asigne el Ministro y las disposiciones jurídicas establecidas.

Una vez aprobada la propuesta por el Jerarca Ministerial, el Poder Ejecutivo mediante Decreto Ejecutivo establecerá cada año, la cantidad de hectáreas disponibles, el monto por hectárea y el mecanismo de pago. Los reglamentos y procedimientos para ejecutar el pago de servicios ambientales, serán emitidos por FONAFIFO, bajo los lineamientos debidamente establecidos.

Para ello la solicitud deberá ser escrita aportando la documentación requerida, manifestación del área a proteger, reforestar o SAF, y lugar para recibir notificaciones, en caso de personas jurídicas se incluirá la certificación de personería jurídica.

Estos documentos serán evaluados técnica y legalmente por FONAFIFO, en un plazo máximo de diez días hábiles. Si se considera que reúnen las condiciones legales y técnicas, se comunicará al oferente que su pre-solicitud fue aprobada y que puede proceder a elaborar el estudio técnico, según los procedimientos establecidos. Las solicitudes dentro de cada área prioritaria se tramitarán con estricto apego al orden de presentación, para ello las mismas serán numeradas y fechadas. Una vez llegado al tope máximo para cada modalidad, se comunicará a los solicitantes posteriores, siendo que su solicitud quedará en suspenso de resolución. Si durante el periodo correspondiente no se adjudicara la misma, tendrá prioridad para el periodo siguiente, permaneciendo en un archivo temporal.

En caso de que no se cumplan los requisitos de preselección o pre-solicitud establecidos, el Fondo Nacional de Financiamiento Forestal señalará los defectos u omisiones otorgando hasta treinta días para su cumplimiento. De no presentarse lo requerido o presentarse nuevamente incorrecto, se archivará la presolicitud sin más trámite.

En caso de aprobarse la solicitud, con el estudio técnico respectivo, FONAFIFO procederá a elaborar el contrato correspondiente, el cual deberá ser suscrito por el Jerarca Ministerial o a quién este delegue oficialmente su firma y por FONAFIFO para lo cual contará con un plazo de hasta treinta días naturales desde la presentación del estudio técnico.

El SINAC podrá efectuar el seguimiento y control del programa según la estrategia de control que establezca.

En lo que respecta a la aplicación de incentivos forestales le corresponderá al SINAC su resolución todo de conformidad con la normativa existente.

El pago de servicios ambientales será otorgado contra presentación de proyectos individuales, a cada organización y esta a su vez los entregará y distribuirá entre los asociados que participen.

FONAFIFO definirá por cada Área de Conservación las organizaciones autorizadas, para ello, éstas deberán demostrar mediante solicitud escrita que cumplen con los siguientes requisitos:

• a)Demostrar estar legalmente constituidas.
• b)Certificación de personería jurídica.
• c)Demostrar experiencia exitosa comprobable en el campo en la ejecución de proyectos forestales o ambientales. Este requisito no se aplica a organizaciones nuevas, pero sí a sus miembros o personal permanente.
• d)No tener obligaciones pendientes con proyectos forestales, programas de financiamiento, incentivos o crédito otorgados por MINAE o alguno de sus órganos adscritos.
• e)Contar con una estructura organizativa, que les permita tener suficiente capacidad administrativa, contable y técnica para la dirección y ejecución de estos proyectos.
• f)Disponer de un marco estratégico donde los proyectos a desarrollar anualmente, constituyan parte de un Programa Regional de Desarrollo Forestal.
• g)Comprometerse a no cobrar más del 18% del monto que corresponde a cada beneficiario o beneficiaria por los servicios de asesoría y asistencia o cualquier otro costo de administración.

Cumplido con los anteriores requisitos, EL FONAFIFO emitirá una resolución en donde disponga que la organización cumple con los requisitos que les permiten accesar directamente a los recursos por el pago de servicios ambientales.

Asimismo se definirá un procedimiento con los requisitos y condiciones para la tramitación del pago de los servicios ambientales, bajo las modalidades de reforestación o conservación, o SAF de bosque según corresponda.

• a)Resolver sobre las solicitudes de crédito y de pago de servicios ambientales que le sean presentadas.
• b)Aprobar los Reglamentos de Crédito y de pago de servicios ambientales y sus modificaciones.
• c)Supervisar y evaluar las actuaciones de la Oficina Ejecutora.
• d)Autorizar la contratación de personal y servicios profesionales para la ejecución y control de las operaciones que realice.
• e)Autorizar la emisión de bonos y otros títulos valores.

De este porcentaje el FONAFIFO deberá trasladar un 2% al SINAC, para coadyuvar en el financiamiento de las actividades de supervisión, de conformidad con la Estratégia de Control del SINAC.

El FONAFIFO deberá someter a aprobación previa del SINAC, el presupuesto correspondiente al 5% restante.
