Complete Text of act: 590E6 No. 30746-MAG-MEIC-COMEX No. 30746-MAG-MEIC-COMEX THE PRESIDENT OF THE REPUBLIC THE MINISTER OF AGRICULTURE AND LIVESTOCK, THE MINISTER OF ECONOMY, INDUSTRY AND TRADE AND THE MINISTER OF FOREIGN TRADE In accordance with the powers established in Articles 140, subsections 3) and 18), and 146 of the Political Constitution, Law No. 7064 of April 29, 1987, Law for the Promotion of Agricultural Production which incorporates the Organic Law of the Ministry of Agriculture and Livestock and Law No. 6227 of May 2, 1978, General Law of Public Administration.
1.—That the National Chamber of Agriculture and Agroindustry (Cámara Nacional de Agricultura y Agroindustria, CNAA) is a non-profit Association, declared of public interest, that brings together producers, entrepreneurs and organizations from the agricultural, agroindustrial, and forestry sectors of Costa Rica and that works actively to achieve the development, reactivation and promotion of these sectors.
2.—That EUREP GAP, a group formed by wholesalers and retailers in the European Union market has imposed a series of requirements on its suppliers, who, as of December 2003, must comply with a Code of Good Practices that covers all aspects of on-farm production, a situation that endangers the future and stability of exports from the agri-food sector.
3.—That in 2001 Costa Rica exported $303,480,441.00 to the European Union market, totaling 338 exporting companies and that at least 118 national companies have the potential to export to the European market.
4.—That the national agricultural sector, in its different stages of production, handling and processing of its products, requires basic knowledge, adequate training and the implementation of Quality and Food Safety Management Systems (Sistemas de Gestión de la Calidad e Inocuidad) that allow them to demonstrate compliance with the requirements and demands described above, seeking the satisfaction of the latter and thus maintaining the levels of competitiveness and productive efficiency required in the current market.
5.—That to maintain and increase our levels of competitiveness in international markets, it is necessary for Costa Rican agribusinesses to initiate a process of awareness-raising and training on continuous improvement in their processes and levels of competitiveness, strengthening and promoting a real platform that allows them to achieve growth in their field of action in the short and medium term, until reaching the Certification process that accredits them before the different markets regarding the quality of their product.
6.—That the NATIONAL CHAMBER OF AGRICULTURE AND AGROINDUSTRY and the NATIONAL PRODUCTION COUNCIL signed in the month of July nineteen hundred ninety- nine a Cooperative Agreement whose basic objective is that both organizations work jointly in the implementation of projects aimed at promoting the development of the national productive sector and through which the National Chamber of Agriculture and Agroindustry and the National Production Council will jointly implement a Comprehensive Food Quality and Safety Management Program, as part of the productive transformation process of the agricultural sector, with the purpose of promoting the competitive capacity of the agribusiness sector.
7.—That the National Chamber of Agriculture and Agroindustry (CNAA) and the National Production Council have been supporting and promoting the Food Quality and Safety Management processes as a real and formal necessity for all national agricultural companies, through their "Program for the Management of Competitive Agribusinesses".
8.—That the development of this program is considered by the Executive Branch as a matter of national interest by virtue of the fact that it aims to provide agribusinesses of agricultural products with a technology transfer tool that allows them to be more competitive in the market and to opt for a certification process in the short and medium term and compete adequately in the international market and that at the same time allows keeping our external markets open. Therefore, They Decree:
