in the entirety of the text - Complete Text of Norm 30719 Declares the Chora Island National Wildlife Refuge Complete Text record: 58F4F Nº 30719-MINAE Nº 30719-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY Based on articles 140, subsections 3 and 18 of the Political Constitution, and in accordance with article 1 of the Forest Law (Ley Forestal) Nº 7575, published in La Gaceta Nº 16 of January 23, 1997, as well as articles 82, 84 and 87 of the Wildlife Conservation Law (Ley de Conservación de la Vida Silvestre) N° 7317 of December 7, 1992 and articles 80 and 81 of the Regulation to the Law (Reglamento a la Ley) N° 26435-MINAE, of December 3, 1997, as well as article 32 of the Organic Environmental Law (Ley Orgánica del Ambiente) Nº 7554 of November 13, 1997.

1. 1That it is in the government's interest to strengthen administrative structures in the field of natural resources, in order to have defined policies that guarantee the rational use of said resources, for which reason it is important to strengthen and rescue the existing natural resources on Chora Island, an islet existing in the province of Guanacaste.
2. 2That Chora Island is an islet located at the southeastern end of Sámara Bay, opposite Punta Indio, province of Guanacaste, with an area of 4 hectares 9,593 square meters, it represents an important zone for the reproduction and development of marine species, especially birds and mollusks, and also for the neighboring communities, who have utilized it in different ways, including for diving, fishing, extraction of mollusks, tourism, among others, for which reason they have a special interest in the communities being able to participate in processes of recovery, protection and sustainable management of the existing resources on Chora Island.
3. 3That the area described above constitutes a very important nucleus for the conservation of wildlife within the management category of national wildlife refuge (refugio nacional de vida silvestre), a nucleus that, if it continues to disappear from our environment and therefore from the planet, this management category allows them to be conserved and managed within sustainable development, serving at the same time as an environmental regulator, through the implementation of a Management Plan (Plan de Manejo).
4. 4That the Management Plan (Plan de Manejo) developed for the zone demonstrates that the zone is an important wildlife area for the protection of biodiversity and that it serves to provide opportunities for scientific research, recreation, ecotourism and environmental education, to conserve and protect ecosystems, the primary objectives of this refuge being to perpetuate and protect the species of flora and fauna of the place, among which the following are found:

1. 5That the Administration of Chora Island is the responsibility of the Municipality of Nicoya, an institution that through Agreement number 10, approved in ordinary session Nº 197, held on December 19, 2001, authorized the declaration of Chora Island as a protected wildlife area (área silvestre protegida), for which reason, this Ministry proceeds with the declaration of the protected wildlife area. Therefore,

1. 1Que es interés del gobierno fortalecer las estructuras administrativas en el campo de los recursos naturales, a fin de contar con políticas definidas que garanticen el uso racional de dichos recursos, en razón de lo cual es importante fortalecer y rescatar los recursos naturales existentes en Isla Chora, islote existente en la provincia de Guanacaste.
2. 2Que Isla Chora es un islote ubicada en el extremo sur- este de la Bahía Sámara, frente a Punta Indio, provincia de Guanacaste, con una extensión de 4 hectáreas 9 593 metros cuadrados, representa una zona importante para la reproducción y desarrollo de especies marinas en especial aves y moluscos y también para las comunidades vecinas, quienes lo han aprovechado de diferentes maneras, entre ellas para el buceo, pesca, extracción de moluscos, turismo, entre otras, por lo que tienen especial interés de que las comunidades puedan participar en procesos de recuperación, protección y manejo sostenible de los recursos existentes en Isla Chora.
3. 3Que el área antes descrita constituye un núcleo muy importante para la conservación de la vida silvestre dentro de la categoría de manejo de refugio nacional de vida silvestre, núcleo que de continuar desapareciendo de nuestro medio y por ende del planeta, bajo ésta categoría de manejo permite conservarlas y manejarlas dentro de un desarrollo sostenible sirviendo a la vez como regulador ambiental, mediante la implementación de un Plan de Manejo.
4. 4Que el Plan de Manejo desarrollado para la zona, demuestra que la zona es un área silvestre importante para la protección de la biodiversidad y que sirve para brindar oportunidades a la investigación científica, la recreación, ecoturismo y la educación ambiental, conservar y proteger los ecosistemas, siendo objetivos primordiales de este refugio, el perpetuar y proteger las especies de flora y fauna del lugar, entre las cuales se encuentran las siguientes:

1. 5Que la Administración de Isla Chora es competencia de la Municipalidad de Nicoya, institución que mediante el Acuerdo número 10, aprobado en sesión ordinaria Nº 197, celebrada el día 19 de diciembre del 2001, autorizó la declaratoria de Isla Chora, como área silvestre protegida, en razón de lo cual, este Ministerio procede a la declaratoria del área silvestre protegida. Por tanto,
