in the entirety of the text - Complete Text of Regulation 16 Regulations of the Environmental Commission Complete Text of record: 57F7E REGULATIONS OF THE ENVIRONMENTAL COMMISSION The Municipal Council, in ordinary session sixteen of the nineteenth of August, two thousand two, agrees to approve the Regulations of the Environmental Commission:

In accordance with articles 1, 21, 46, 50, 89, 169, 170 of the Constitution. 2, 4, subsection f), 13, subsections e) m); 34 subsection g), 49 and following and concordant of the Municipal Code, General Health Law. Construction Law and its Regulations, Regulations for the Control of Developments and Subdivisions (Urbanizaciones y Fraccionamientos), articles 123, 4, and following and concordant of the Organic Environmental Law, articles 1, 3, 4 and following and concordant of the Wildlife Conservation Law, articles 1, 2, 3, and following and concordant of the Biodiversity Law, articles 1, 23, 4, and following and concordant of the Water Law, articles 1, 23, 4, and following and concordant of the Law on the Use, Management and Conservation of Soils, articles 1, 23, 4, and following and concordant of the Forest Law (Ley Forestal), articles 1, 23, 4, and following and concordant of the Regulations to the Forest Law (Ley Forestal), articles 1, 23, 4, and following and concordant of the Regulations to the Regulatory Plan of the Canton of Moravia and other related Laws and Regulations, considering: That the protection of the environment in our time constitutes an aspiration of a universal nature, according to which a good quality of life cannot be conceived without the setting of a healthy and ecologically balanced environment.

The Municipality will establish sustainable mechanisms to provide the necessary financial resources for the Operation of the Commission and a Competitive Fund to finance projects in accordance with its budgetary possibilities. That for the creation of this setting, the municipal entity enjoys its own and autonomous powers in matters of administration and legal regulation and therefore agrees: The creation of the Municipal Environmental Commission which shall be governed by the following regulations:

Of the commission and its purposes 1º—It must ensure that the social, infrastructural, economic, and forestry development processes of the Canton of Moravia comply with all the provisions and agreements of the Municipal Council of Moravia.

2º-In protecting the right to a healthy environment, it must promote and carry out all types of educational activities on the topics of Natural Resources and the Environment, including the legal sphere in which they are immersed.

3º-Promote active and organized citizen participation in decision-making and actions aimed at protecting and improving the environment.

4º-Promote municipal institutional participation, both nationally and internationally, regarding the environment as the common heritage of all the inhabitants of the canton.

5º-Implement programs of environmental and ecological projects, duly planned for the purpose of substantially improving the quality of life of the community in general.

6º-Establish mechanisms for national and international cooperation exchange, with Public or Private Institutions, building alliances that allow generating new strategies for sustainable development, which imply the proper management of our cultural, ecological, and geographical environments and thereby try to minimize as much as possible the vulnerability to which the human being and the natural order that surrounds him are subject, thus being the improvement of the quality of life of our residents (munícipes).

7º-Seek and channel financial resources at the national and international level, with Public and Private Institutions interested in the topic of the environment and quality of life, directing them specifically towards the creation and implementation of environmental and cultural education and scientific research programs, which allow improving knowledge of natural resource management.

8º-Recommend to the Municipal Council and Institutions of the Costa Rican State the creation of new wilderness areas of regional or national importance.

9º-Maintain a sustainable diagnosis of the environmental situation for the canton of Moravia.

10.-Promote the creation of Associations and Organized Groups for analysis, discussion, proposals on the environment. Execution of training programs related to the management of natural resources, within a framework of sustained progress in quality of life.

11.-Increase the commitment and consent of citizens to operationalize measures for the protection of the environment, through organs of prevention, protection, and administration of natural resources, which can resort to administrative and judicial repressive instances.

12.-Seek the best means of administration of parks and protected areas, through organized groups or other types of organizations, under the control and supervision of our highest cantonal Institution, which will not be limited in the search for common interests with other institutions or larger entities.

13.-Ensure the control of pollution by liquid, solid, or gaseous waste, as well as sonic, visual, radioactive, and agrochemical pollution.

14.-Recommend to MINAE the appointment of ad honorem inspectors for the purpose of dedicating themselves to the projection and conservation of a healthy environment, within the canton of Moravia, as a form of citizen participation.

15.-Ensure the protection of aquifers, as well as the management, development, and conservation of hydrographic basins. Likewise, exercise vigilance regarding cutting, extraction, and transportation permits for timber.

16.-Follow up on the environmental impact assessments (estudios de Impacto Ambiental) that are requested for works intended to be built in the canton of Moravia.

17.-Attend to complaints in coordination with the Comptroller of Municipal Services that are made by citizens in environmental matters. They must channel them and make them known to the competent public entities and administrative and judicial bodies.

18.-Provide collaboration in the monitoring carried out regarding the geographical distribution of different species and their populations.

19.-Keep the environmental statistics of the canton up to date.

20.-Propose to MINAE policies and strategies for the adequate development of activities carried out in the environmental field.

21.-Participate in national and international forums where environmental topics and policies concerning the canton or the country are discussed.

22.-Pronounce before the competent entities on deforestation problems from tree felling in the canton of Moravia, in accordance with the Laws in force on the matter and their respective regulations.

23.-Inform the Municipal Council at least once a month or whenever it requires about the activities carried out by the Commission.

24.-Prepare an annual report on the state and environmental situation of the canton, as well as on the work carried out and projections within the framework of the commission.

25.-Ensure that National Legislation is complied with in ecological and environmental matters.

26.-Promote proposals to the Municipal Council for its approval of ecological and environmental policies, plans, programs, and projects, as well as sustainable development that allows the citizens of the canton of Moravia to develop in a healthy and balanced environment.

Of the integration and organization 27.-The Commission shall be integrated in accordance with the provisions of article 34 of Law No. 7794 and shall be constituted of at least five members, who from among themselves shall elect: President, Vice President, Secretary, Treasurer, and Vocal. Members of Civil Society, Organized Groups, and Associations may join with voice but without vote. Similarly, delegates from different institutions that the Commission deems pertinent may join with voice but without vote.

28.-Repeal the previous Regulations published in gazette No. 116 of Wednesday, June 17, 1998, and any other provision that opposes it.

29.-It shall take effect upon its publication.

De conformidad con los artículos 1º, 21, 46, 50, 89, 169, 1.70 Constitucionales. 2º, 4º, inciso f), 13, incisos e) m); 34 inciso g), 49 siguientes y concordantes del Código Municipal, Ley General de salud. Ley de Construcciones y su Reglamento, Reglamento de Control de Urbanizaciones y Fraccionamientos, artículos 123, 4º, siguientes y concordantes de la Ley Orgánica del Ambiente, artículos 1º, 3º, 4º siguientes y concordantes de la Ley de Conservación de la Vida Silvestre, artículos 1º, 2º, 3º, siguientes y concordantes de la Ley de Biodiversidad, artículos 1º, 23, 4º, siguientes y concordantes de la Ley de Aguas, artículos 1º, 23, 4º, siguientes y concordantes de la Ley de Uso, Manejo y Conservación de Suelos, artículos 1º, 23, 4º, siguientes y concordantes de la Ley Forestal, artículos 1º, 23, 4º, siguientes y concordantes del Reglamento a la Ley Forestal, artículos 1º, 23, 4º, siguientes y concordante del Reglamento al Plan Regulador del Cantón de Moravia y demás Leyes y Reglamentos Conexos, considerando: Que la tutela del medio ambiente en nuestro tiempo constituye una aspiración de carácter universal, según el cual no puede concebirse una buena calidad de vida, sin el entorno de un ambiente sano y ecológicamente equilibrado.

La Municipalidad establecerá mecanismos sostenibles para dotar de los recursos Financieros necesarios para el Funcionamiento de la Comisión y un Fondo Concursable para financiar proyectos en concordancia con sus posibilidades presupuestarias. Que para la creación de este entorno, el ente municipal goza de facultades propias y autónomas en materia de administración y regulación jurídica y por ende acuerda: La creación de la Comisión Ambiental Municipal que se regirá por el siguiente reglamento:

De la comisión y sus fines 1º—Debe velar, para que los procesos de desarrollo social, infraestructural, económico y silvícola del Cantón de Moravia, cumplan con todas la disposiciones y acuerdos del Concejo Municipal de Moravia.

2º-En la protección del derecho a un ambiente sano, deberá promover y ejecutar todo tipo de actividades educativas en los temas de Recursos Naturales y el Ambiente, incluyendo la esfera jurídica en que se encuentran inmersos 3º-Promover la participación ciudadana, activa y organizada en la toma de decisiones y acciones tendientes a proteger y mejorar el ambiente.

4º-Promover la participación institucional municipal, tanto a nivel nacional como internacional en lo relativo al ambiente corno patrimonio común de todos los habitantes del cantón.

5º-Implementar programas de proyectos ambientales y ecológicos, debidamente planificados a efectos de mejorar sustancialmente la calidad de vida de la comunidad en general.

6º-Establecer mecanismos de intercambio de cooperación nacional e internacional, con Instituciones Públicas o Privadas, construyendo alianzas que permitan generar nuevas estrategias de desarrollo sostenible, que impliquen el adecuado manejo de nuestros entornos culturales, ecológicos y geográficos y con ello tratar de minimizar al máximo la vulnerabilidad de que es objeto el ser humano y el orden natural que lo rodea, siendo con ello el mejoramiento de calidad de vida de nuestros munícipes.

7º-Buscar y canalizar recursos financieros a nivel nacional e internacional, con Instituciones Públicas y Privadas interesada sen el tema del ambiente y calidad de vida, dirigiéndolos en forma específica a la creación e implementación de programas de educación ambiental y cultural y de investigación científica, que permitan mejorar el conocimiento del manejo de los recursos naturales.

8º-Recomendar al Concejo Municipal e Instituciones del Estado Costarricense la creación de nuevas áreas silvestres de importancia regional o nacional.

9º-Mantener un diagnóstico sostenible de la problemática ambiental para el cantón de Moravia.

10.-Fomentar la creación de Asociaciones y Grupos Organizados para el análisis, la discusión, propuestas sobre el ambiente. Ejecución de programas de capacitación con relación al manejo de los recursos naturales, dentro de un marco de progreso sostenido de calidad de vida.

11.-Incrementar el compromiso y el consentimiento de los ciudadanos, para operativizar las medidas de protección del medio ambiente, mediante órganos de prevención, tutela y administración de los recursos naturales, que puedan recurrir a las instancias de represión administrativa y judicial.

12.-Buscar los mejores medios de administración de parques y zonas protegidas, mediante grupos organizados u otros tipo de organizaciones ,bajo control y supervisen de nuestra Institución máxima cantonal, quien no estará limitada a la búsqueda de interesas comunes con otras instituciones u entes mayores.

13.-Velar por el control de la contaminación por desechos líquidos, sólidos o gaseosos, así como la contaminación sónica, visual, radioactiva y por agroquímicos.

14.-Recomendar al MINAE, el nombramiento de inspectores ad honorem a efecto de que se dediquen a la proyección y conservación de mi ambiente sano., dentro del cantón de Moravia, como forma de participación ciudadana.

15.-Velar por la protección de los mantos acuíferos, así como el manejo, desarrollo y conservación de las cuencas hidrográficas. Igualmente ejercer vigilancia con lo relacionadlo a permisos de corta, extracción y transporte de madera 16.-Dar seguimiento a los estudios de Impacto Ambiental que se soliciten en las obras que se pretenden construir en el cantón de Moravia.

17.-Atender denuncias en coordinación con la Contraloría de Servicios Municipales que en materia ambiental realicen los administrados. Debelan canalizarlas y hacerlas del conocimiento de los entes públicos y órganos administrativos y judiciales competentes.

18.-Brindar la colaboración en el monitoreo que se realice, con relación a la distribución geográfica de las diferentes especies y sus poblaciones.

19.-Mantener al día las estadísticas ambientales del cantón.

20.-Proponer al MINAE, políticas y estrategias para el desarrollo adecuado de las actividades que 93 realicen en el campo ambiental.

21.-Participar foros nacionales e internacionales, donde se discutan temas y políticas ambientales que conciernan al cantón o al país.

22.-Pronunciarse ante los entes competentes sobre problemas de deforestación de la tala de árboles en el cantón de Moravia, de acuerdo con las Leyes vigentes en la materia y sus respectivos reglamentos.

23.-Informar al Concejo Municipal al menos una vez al mes o bien cuando este lo requiera sobre las actividades llevadas a cabo por la Comisión.

24.-Elaborar informe anual, sobre el estado y situación ambiental del cantón, asa como de las labores desarrolladas y proyecciones en el marco de la comisión.

25.-Velar, para que la Legislación Nacional se cumpla en materia ecológica y ambiental.

26.-Impulsar propuestas al Concejo Municipal para su aprobación de políticas. Planese programas y proyectos ecológicos y ambientales, así como de desarrollo sostenible que permita a los administrados del cantón de Moravia desarrollarse en un ambiente sano y equilibrado.

De la integración y organización 27.-La Comisión se integrará en concordancia con lo que establece el artículo 34 de la Ley Nº 7794 y estará constituida al menos por cinco miembros, que dentro de su seño elegirá: Presidente, Vicepresidente, Secretario, Tesorero y Vocal. Podrán integrarse miembros de la Sociedad Civil, Grupos Organizados y Asociaciones con voz pero sin voto. Igualmente podrán integrase con voz pero sin voto, delegados de las diferentes instituciones, que la Comisión considere pertinentes.

28.-Derogues el anterior Reglamento publicado en la gaceta No 116 del miércoles 17 de junio de 1998 y cualesquiera otra disposición que se le oponga.

29.-Rige a partir de su publicación.
