I.—That Articles 3(k) and 22 of the Forestry Act, Law 7575, establish that persons or companies engaged in forestry activities must develop, execute, and implement a management plan (plan de manejo) to be approved by the State Forestry Administration (Administración Forestal del Estado), with the purpose of regulating such activities in order to achieve the conservation, protection, and improvement of the forest resource.
II.—That the users of the forest resource, prior to the approval of the management plan (plan de manejo), must submit a deposit or guarantee as security for compliance with the obligations set forth in the authorization, including any corrective and compensatory environmental measures imposed.
III.—That the State Forestry Administration (Administración Forestal del Estado) requires a technical and legal instrument that clearly establishes the procedure for the calculation, recovery, and distribution of the deposit or guarantee required by law for forestry management plans (planes de manejo), and for their subsequent disposition.

PROCEDURE FOR THE DEPOSIT OR GUARANTEE REQUIRED FOR THE APPROVAL OF FORESTRY MANAGEMENT PLANS

This procedure shall apply to the calculation, recovery, and disposition of the deposit or guarantee that approved management plans (planes de manejo) must provide as security for compliance with the obligations set forth in the respective authorization.

All natural or legal persons that, pursuant to the Forestry Act, Law 7575, must submit and obtain approval for a management plan (plan de manejo) are required to provide the deposit or guarantee established in Article 22 of said law.

To determine the amount of the deposit or guarantee, the State Forestry Administration (Administración Forestal del Estado), through the respective Conservation Area (Área de Conservación), shall calculate it taking into account the following parameters:
a)The surface area in hectares of the property covered by the management plan (plan de manejo), according to the cadastral plan (plano catastrado) registered in the Public Registry.
b)The type of forest cover (cobertura boscosa) and land-use capacity present on the property.
c)The number of trees authorized for harvesting.
d)The volume in cubic meters authorized for harvesting.
e)Any other parameter that the State Forestry Administration (Administración Forestal del Estado) deems pertinent, based on the impact of the forestry activity on the natural resources located on the property.

The deposit or guarantee may be provided in any of the following forms:
a)Surety bond (fianza) issued by an entity authorized by the General Superintendence of Financial Institutions (SUGEF).
b)Certificate of guarantee deposit (certificado de depósito a plazo) issued in colones and in the name of the Costa Rican Institute of Electricity (Instituto Costarricense de Electricidad) for the benefit of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC).
c)Irrevocable, unconditional, and renewable letter of credit (carta de crédito stand-by) issued by a national bank.
d)Any other guarantee accepted by the State Forestry Administration (Administración Forestal del Estado).

The guarantee shall be maintained in full force and effect for the entire duration of the management plan (plan de manejo), including any extensions, plus an additional period of two years, counted from the date of completion of the activities authorized in the plan.

The State Forestry Administration (Administración Forestal del Estado), through the respective Conservation Area (Área de Conservación), may order the partial or total recovery of the guarantee when the obligor fails to comply with the obligations set forth in the management plan (plan de manejo) or the applicable regulations. The amounts recovered shall be allocated to the Environmental Bank (Banco Ambiental) of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC) to finance projects for the conservation, protection, and recovery of forest resources.

Once the obligations set forth in the management plan (plan de manejo) have been fully complied with, and upon expiration of the term established in Article 5 of this procedure, the holder of the approved plan may request the release and cancellation of the guarantee from the State Forestry Administration (Administración Forestal del Estado), which shall be processed within a maximum of thirty business days.

In all matters not provided for in this procedure, the provisions of the Forestry Act, Law 7575, its amendments, and the Regulations to the Forestry Act, Executive Decree 25721-MINAE, as well as any other related legal provisions, shall apply.
