in the entirety of the text - Complete Text of Regulation 30643 Modifies the budgetary limit and effective expenditure limit for 2002, of the National Parks Fund Complete Text of record: 56DE3 Nº 30643-H Nº 30643-H THE FIRST VICE PRESIDENT IN EXERCISE OF THE PRESIDENCY OF THE REPUBLIC AND THE MINISTER OF FINANCE Based on the powers conferred by subsections 3) and 18) of articles 140 and 146 of the Political Constitution, articles 26 and 27 of the General Law of Public Administration, Laws Nº 7554 of October 4, 1995, Nº 6084 of August 17, 1977, and Executive Decree Nº 24652-MIRENEM of September 20, 1995.

1. 1That by constitutional mandate, the Costa Rican State is responsible for guaranteeing citizens the enjoyment of a healthy and ecologically balanced environment.
2. 2That the Organic Law of the Environment Nº 7554 establishes that the Ministry of Environment and Energy (MINAE) is the governing body in environmental matters, and therefore must ensure the protection, conservation, and use of natural resources as an indispensable condition for sustainable economic development.
3. 3That the National Parks Fund forms part of the National System of Conservation Areas, through which the protection, conservation, control, and promotion of the same are carried out, and it requires the incorporation of additional resources to implement actions aimed at fulfilling its institutional mission.
4. 4That the aforementioned regulation empowers MINAE to acquire and include under a management category those lands considered indispensable for the protection and conservation of the environmental patrimony, and therefore it is necessary to incorporate additional resources into the budget of the National Parks Fund for the payment of lands.
5. 5That unavoidable obligations of an operational nature must be met in the Conservation Areas, and therefore it is necessary to incorporate additional resources into the budget of the National Parks Fund for the payment of said expenditures.
6. 6That through Executive Decree Nº 29511-H, published in La Gaceta Nº 98 of May 23, 2001, the Budgetary Authority formulated the General Budgetary Policy Guidelines for 2002, which were made known to the Government Council and approved by the President of the Republic, establishing the budgetary expenditure limit and effective expenditure limit for the current year, for the entities covered by the scope of the aforementioned Collegiate Body.
7. 7That Executive Decree Nº 30182-H, published in La Gaceta Nº 46 of March 6, 2002, modifies Decree Nº 29511-H and establishes the budgetary and effective expenditure limit of the National Parks Fund for 2002.
8. 8That due to the foregoing, it is necessary to modify the expenditure limit set for said entity in the cited Decree. Therefore,

en la totalidad del texto - Texto Completo Norma 30643 Modifica el límite presupuestario y de gasto efectivo para el 2002, del Fondo de Parques Nacionales Texto Completo acta: 56DE3 Nº 30643-H Nº 30643-H LA PRIMERA VICEPRESIDENTA EN EJERCICIO DE LA PRESIDENCIA DE LA REPÚBLICA Y EL MINISTRO DE HACIENDA Con fundamento en las atribuciones que les confieren los incisos 3) y 18) de los numerales 140 y 146 de la Constitución Política, los artículos 26 y 27 de la Ley General de la Administración Pública, las Leyes Nº 7554 del 4 de octubre de 1995, Nº 6084 del 17 de agosto de 1977 y el Decreto Ejecutivo Nº 24652-MIRENEM del veinte de setiembre de 1995.

1. 1Que por imperativo constitucional al Estado costarricense le corresponde garantizar a los ciudadanos el disfrute de un ambiente sano y ecológicamente equilibrado.
2. 2Que la Ley Orgánica del Ambiente Nº 7554, establece que el Ministerio del Ambiente y Energía (MINAE) es el ente rector en materia ambiental, por lo que debe velar por la protección, conservación y aprovechamiento de los recursos naturales como condición indispensable para el desarrollo económico sostenible.
3. 3Que el Fondo de Parques Nacionales forma parte del Sistema Nacional de Áreas de Conservación, mediante el cual se lleva a cabo la protección, conservación, control y fomento de las mismas y requiere incorporar recursos adicionales para implementar acciones con miras al cumplimiento de su misión institucional.
4. 4Que la citada normativa faculta al MINAE para adquirir e incluir bajo una categoría de manejo, aquellas tierras consideradas indispensables para la protección y conservación del patrimonio ambiental, por lo que resulta necesario incorporar recursos adicionales en el presupuesto del Fondo de Parques Nacionales para el pago de tierras.
5. 5Que se deben atender obligaciones ineludibles de naturaleza operativa en las Áreas de Conservación, por lo que resulta necesario incorporar recursos adicionales en el presupuesto del Fondo de Parques Nacionales para el pago de dichas erogaciones.
6. 6Que mediante el Decreto Ejecutivo Nº 29511-H, publicado en La Gaceta Nº 98 del 23 de mayo del 2001, la Autoridad Presupuestaria formuló las Directrices Generales de Política Presupuestaria para el 2002, las cuales fueron conocidas por el Consejo de Gobierno y aprobadas por el Presidente de la República, estableciendo el límite de gasto presupuestario y de gasto efectivo del presente año, para las entidades cubiertas por el ámbito del mencionado Órgano Colegiado.
7. 7Que el Decreto Ejecutivo Nº 30182-H, publicado en La Gaceta Nº 46 del 6 de marzo del 2002, modifica el Decreto Nº 29511-H y establece el límite de gasto presupuestario y efectivo del Fondo de Parques Nacionales para el 2002.
8. 8Que por lo anterior, resulta necesario modificar el límite de gasto fijado a dicho ente en el Decreto citado. Por tanto,
