FULL TEXT OF REGULATION 30387 Regulation for the Drilling and Exploration of Groundwater Full Text of Act: CF91F No. 30387-MINAE-MAG No. 30387-MINAE-MAG (This decree was repealed by Article 1 of Executive Decree No. 35894 of April 7, 2010) THE PRESIDENT OF THE REPUBLIC THE MINISTER OF ENVIRONMENT AND ENERGY AND THE MINISTER OF AGRICULTURE AND LIVESTOCK Exercising the powers contained in Article 140, subsections 3) and 18) of the Political Constitution, the Water Law No. 276 of August 26, 1942, the Organic Environmental Law No. 7554 of October 4, 1996, Law 5516, Executive Decree No. 26635-MINAE of February 2, 1998, and the agreement of the Board of Directors of the National Electricity Service, published in the Official Gazette La Gaceta Number 101 of May 26, 1988.
I—That in accordance with Law No. 276, in its Articles 17, 21, 27, 46, 56, 176, and 178, the Ministry of Environment and Energy is the governing body of water resources and is responsible for providing for and resolving matters concerning its ownership, use, utilization, governance, and oversight.
II—That Law No. 5516, which reforms and adds to the Water Law, published in La Gaceta 99 of May 28, 1974, in its Article 2, provides that the Ministry of Environment and Energy must keep a registry for the enrollment of persons or companies engaged in the activity of well drilling and shall not issue a drilling license to those not enrolled in the aforementioned registry.
III—That the legal opinions C-019-98 of February 6, 1998, and C-042-99 of February 19, 1999, of the Attorney General's Office respectively state: “(…) the conservation of water resources and their treatment as part of State assets, the governing authority is held by the Ministry of Environment and Energy (…).” “(…) the Ministry of Environment and Energy is the governing body (…) in the conservation of the natural resource water (…).” IV—That the National Groundwater, Irrigation, and Drainage Service (SENARA), in accordance with its Law 6877 of July 4, 1983, provides in Article 3, subsections ch) and e), that it is responsible for investigating, protecting, and promoting the use of the nation's water resources, both surface and groundwater, as well as carrying out, coordinating, promoting, and keeping updated the hydrological, hydrogeological, agrological, and other investigations it deems necessary in hydrographic basins, for which purpose it has the National Well Archive, which constitutes valuable technical information necessary to promote the rational exploitation of this resource.
V—That SENARA, in accordance with Article 3, subsections h) and i) of its constitutive law, is charged with monitoring compliance with legal provisions on the matter. Decisions made by the Service for this reason, concerning the drilling of wells and the exploitation, maintenance, and protection of waters carried out by public institutions and private parties, shall be final and mandatory, and it is also responsible for providing technical advice and services to public institutions and private parties.
VI—That in accordance with the Organic Environmental Law, the State must provide the necessary instruments to have a healthy and ecologically balanced environment. Likewise, the Ministry of Environment and Energy, to develop and apply the general principles of the cited law, shall have the powers that other laws assign to other State institutions.
VII—That an Integrated Management of Water Resources must be sought, a process that promotes the coordinated management and development of water, land, and natural resources, in order to maximize the resulting social and economic well-being equitably without compromising the sustainability of vital ecosystems, for which inter-institutional coordination is essential. Therefore, They Decree:
The following:
Regulation for the Drilling and Exploration of Groundwater Regarding the Drilling Company
Considering:
- Name of the company. - Legal identification number (cédula jurídica). - Legal representative and their qualifications. - Professional responsible for the company and their qualifications (Professional in Geology or Hydrogeology). - Certification that the responsible professional accredited by the company is up to date with the obligations of the respective Professional Association (Colegio Profesional). - Company address. - Office telephone and fax. - Postal address. - Address or Fax for receiving notifications within the judicial perimeter. - Type and characteristics of the equipment used by the company for drilling work. - Provide the company identification logo to be used on the machinery and equipment. - E-mail.
Plus any information the Ministry deems appropriate to request.
Regarding Drilling Permits
An original and two complete copies must be delivered, the original destined for the Department of Water and the copies for the National Groundwater, Irrigation, and Drainage Service and the Costa Rican Electricity Institute (ICE).
The drilling permit must be denied in those areas that do not allow for rational exploitation of the water resource because they are in situations such as: a) Zones declared by the State or competent institutions in the field as areas of aquifer protection and reserve. b) Zones with over-exploitation, under conditions of vulnerability of the maximum aquifer exploitation capacity. c) Zones susceptible to saline intrusion, contamination, or other reasons that, in the judgment of MINAE and SENARA, affect the aquifer and prevent its exploitation. d) Zones of interference with other wells or springs (nacientes).
The company must inform the Department of Water of the date drilling starts and the date drilling is completed; failure to comply with these provisions empowers the administration to exercise the pertinent legal mechanisms.
The cited permit may be extended for a maximum of two additional months.
Failure to comply with this provision will result in the cancellation of the drilling permit and the application of sanctions under current legislation.
Likewise, it must provide a system of piping that allows flow rate measurement from the ground surface.
This report must be submitted in accordance with the form available at the Department of Water and must contain at least the following data: a) Name of the company responsible for the drilling. b) Drilling permit number. c) Assigned well number. d) Professional responsible for the drilling accredited by the company. e) Intended use of the water by the well owner. f) Location of the well in Lambert coordinates. g) Drilling method used. h) Depth of the water table (nivel friático) and the dynamic level, with reference to the date on which they were measured, as well as including water level variations during drilling. i) Characteristics and location of the casing (ademe) and of the screens or admission intervals, including: inside and outside diameter, interval length, types of joints, characteristics of the material used, size of openings or slots; material thickness; protective coatings or paints, or any other pertinent data. j) Characteristics of the gravel filter (density, types of material, and sieving). k) Well development; whether mechanical, hydraulic, pneumatic, or other, and hours of development. l) Lithology: including a description of the lithological characteristics of the materials extracted during the subsoil drilling development, indicating the apparent physical conditions of the rocks, such as hardness, degree of fracturing, color, permeability, porosity, apparent content of silts, clay, sands, as well as sampling depth. In alluvial aquifers or unconsolidated deposits, a granulometric analysis of the materials from the producing zone must be provided. m) Indicate whether drilling muds, dispersing ingredients, or other types of additives were used. n) Sanitary seal (sello sanitario): Indicate characteristics, depth, thickness, and material. o) Interpretation of the pumping test, indicating flow rates, drawdowns, and times (graphical analysis of the tests). The water level before starting the test must also be indicated. p) Physical-chemical and bacteriological analysis of the water. q) Type, brand, and characteristics of the installed pump when applicable, in addition to the manufacturer's pump curve. In the event that the well's yield is not as expected and, for this reason, it will not be exploited, the report shall not include the information indicated in points e, i, j, k, n, and q above, and a final comment regarding the possible causes of this result must be attached. This document must be signed by the responsible professional and the legal representative of the company.
The foregoing is without prejudice to the Department of Water, at its justified discretion, considering the need to carry out a specific pumping test period.
This office shall process them after consultation with SENARA and AyA, in accordance with Articles 6, 7, 8, 9, and 10 of this Regulation. A period of six months shall be opened for them to come into compliance; after this period, any groundwater use carried out by means of a drilled well that does not have the respective exploitation concession shall be penalized in accordance with our current legislation, and immediate closure or sealing shall proceed.
For other uses of these wells, the respective concession must be requested.
Regarding Sanctions
276 and its reform Law No. 5516, the Organic Environmental Law No. 7554, the General Law of Public Administration No. 6227, the Forestry Law No. 7575, and the Law creating the National Groundwater, Irrigation, and Drainage Service No. 6877, the following precautionary measures shall be applied.

Reglamento de Perforación y Exploración de Aguas Subterráneas De la empresa perforadora
Considerando:
Decretan:
- Nombre de la empresa.
- Cédula jurídica.
- Representante legal y sus calidades - Profesional responsable de la empresa y sus calidades (Profesional en Geología o Hidrogeología).
- Certificación de que el profesional responsable acreditado por la empresa, se encuentre al día con las obligaciones del Colegio Profesional respectivo.
- Domicilio de la empresa.
- Teléfono y fax de oficina.
- Apartado postal.
- Dirección o Fax para oír notificaciones dentro del perímetro judicial.
- Tipo y características de los equipos utilizados por la empresa para las labores propias de perforación.
- Aportar el logotipo de identificación de la empresa y que usará la maquinaria y equipo.
- Correo electrónico.
Más la información que el Ministerio considere conveniente solicitar.
De los permisos de perforación
Deberá entregar un original y dos copias de juego completos, dispuestos el original para el Departamento de Aguas y las copias para el Servicio Nacional de Aguas Subterráneas y, Riego y Avenamiento y el Instituto Costarricense de Electricidad.
Se deberá denegar el permiso de perforación en aquellas áreas que no permitan una explotación racional del recurso hídrico por encontrarse en situaciones como:
Debe la empresa informar al Departamento de Aguas de la fecha de inicio de la perforación, como la fecha de terminación de la perforación, el incumplimiento de estas disposiciones faculta a la administración a ejercer los mecanismos legales pertinentes.
El citado permiso podrá ser prorrogado como máximo por dos meses más.
De no acatar esta disposición, se le cancelará el permiso de perforación y se aplicará las sanciones de la legislación vigente.
Este informe deberá presentarse conforme el formulario a disposición en el Departamento de Aguas, debiendo contener los siguientes datos como mínimo:
En caso que la producción del pozo no sea la esperada y por tal condición no se vaya a explotar, el informe no incluirá los señalado en los puntos e, i, j, k, n y q antes indicados, debiendo adjuntarse un comentario final sobre las posibles causas de este resultado.
Este documento deberá ser firmado por el profesional responsable y el representante legal de la empresa.
Lo anterior sin perjuicio de que a criterio justificado el Departamento de Aguas considere la necesidad de realizar un período de prueba de bombeo particular.
El cual procederá a tramitar previa audiencia al SENARA y al A y A de conformidad con los artículos 6, 7, 8, 9 y 10 de este Reglamento. Se abrirá un período de seis meses para que se pongan a derecho, después de este período todo aprovechamiento de aguas subterráneas que se realice por medio de un pozo perforado y no cuente con la concesión de explotación respectiva se penará conforme a nuestra legislación vigente, procediéndose a su inmediato cierre o sellado.
Otros usos de estos pozos deberá solicitar la respectiva concesión.
De las sanciones
La aplicación del presente artículo corresponderá al MINAE de oficio o a solicitud del SENARA y/o tercero, y deberá estar fundamentado y siguiendo el debido proceso.
