a. Access: Road onto which a lot or property fronts.
b. Maximum height: Established from the ground to the ridge point of the building.
c. Street furniture: Set of urban elements, such as benches, trash cans, tables, posts, signs, and labels that support services for user comfort.
d. Green area: Grassed or wooded free areas, for public or communal use, intended for recreation and ornamentation, or sections of land where forest cover (cobertura vegetal) must be conserved and recovered.
e. Cabin: Establishment that provides lodging service for a daily or monthly rate, with independent units, with one or more bedrooms, private bathroom, kitchen, independent entrance from the outside, and with parking for guests' vehicles.
f. Use Certification: Document establishing the possibility of allocating a portion of land for the construction of the works covered in these Regulations. Said certificate shall be issued by the Municipality of Aguirre at the request of the interested party.
g. Commercial: Space used for the establishment of commercial services for users of the Maritime Terrestrial Zone, which may be supermarkets, stores, or similar.
h. Concession: Public contract between the Municipality of Aguirre and the concessionaire (concesionario), which grants the latter the right to use the land on a lot within the Maritime Terrestrial Zone, specifically in the restricted zone (150 meters), not including the Public Zone (50 meters in front of the littoral sector).
i. Concessionaire (Concesionario): Legal entity, natural person, or moral entity that possesses a concession right in the Maritime Terrestrial Zone.
j. Conservation: In urban planning, it is the action aimed at maintaining ecological balance, the good state of material works (buildings, monuments, plazas, and parks), and in general, everything that constitutes the historical, cultural, and social heritage of population centers.
k. Construction: Any structure that is fixed or incorporated into the land: includes any work of building, reconstruction, remodeling, or expansion that implies permanence.
l. Density: Consists of the number of temporary or permanent residents per unit area (in this case, the estimated unit area is the hectare).
m. Net Density: Understood as the ratio of inhabitants divided by the total surface area of occupied land, excluding road surfaces.
n. Right-of-way: It is the measurement of the public use zone, taken between the demarcation lines established by the MOPT, the corresponding Municipality, or a Regulatory Plan.
o. Buildings: All those works intended for habitation, work, recreation, tourism, etc.
p. Hotel: It is a type of establishment with a minimum of twenty rooms, according to the category that corresponds, which provides lodging service for a daily rate, as well as food, at the client's choice. It must occupy the entirety of a building or an absolutely independent part of it, with facilities that constitute a homogeneous whole, with entrances, hallways, stairs, and elevators for the exclusive use of the establishment.
q. Offender: Natural person, legal entity, or any Government agency that fails to comply with these Zoning Regulations.
r. Infrastructure: Urban services and facilities, such as: roads, drainage, aqueducts, sewers, electricity, telephony, and other similar ones.
s. Lot: A parcel of land of any size, whether granted in concession or under private property.
t. Number of floors: Must be understood as total floors or total or partial coverage of the floor area (mezzanine counts as one floor or story).
u. Occupancy: Consists of the percentage of land that can be covered by constructed areas, habitable or not, such as accesses, parking lots, pools, and other non-natural covers; internal green areas are considered residual areas not included in the occupancy percentage, must be destined for gardens, lakes, fruit trees, ornamentals, etc.
v. Owner: Is the person(s), company(ies), or agency(ies) that holds title to property on lands adjacent to the Maritime Terrestrial Zone.
w. Protection: That area in which urban works are subject to restrictions.
x. Tourist residence: Construction for vacationing or permanent residence, which is integrated with the surrounding environment and where the necessary precautions are taken to minimize the impact on the land.
y. Setbacks: Unbuilt open spaces between a structure and the boundaries of the respective property.
z. Tourist Urbanization: Provision of a land plot with the infrastructure works required for the construction of buildings intended for tourist residential use (rental houses or apartments).
aa. Conditional use: That which, while not being the most recommendable for the terrain conditions, does not generate conflict with permitted uses. This use may be allowed on land, subject to prior special authorization from the Municipality and the Costa Rican Tourism Institute (Instituto Costarricense de Turismo), by means of a certificate.
ab. Conflictive use: That which does not conform to the zoning indicated in the Regulatory Plan. Conflictive uses are not permitted under any condition.
ac. Permitted use: That use of the property or lot, over which the concessionaire (concesionario) has the possibility of allocating their land without further restrictions than those indicated herein, and prior processing of the construction permits required by the Municipality of Aguirre.
ad. Use: Private enjoyment of areas or properties.
ae. Public road: Spaces intended for the circulation of vehicles or pedestrians.
af. Zoning: It is the division of a territory into use zones, for purposes of its rational development.
