Cada miembro podrá ser suplido por su respectivo viceministro o representante designado. El Presidente de la CNE presidirá la Junta y será suplido por el Vicepresidente de esta. La Junta ejercerá las competencias señaladas en la Ley Nacional de Emergencia N° 7914 y su reglamento. El decreto rige a partir del 8 de mayo de 2002 y ha sido reformado por decretos posteriores para ajustar la representación del área de Asistencia Social.
