Complete Text of acta: 4D292 N° 30402-H N° 30402-H THE SECOND VICE PRESIDENT IN EXERCISE OF THE PRESIDENCY OF THE REPUBLIC AND THE MINISTER OF FINANCE In use of the powers conferred in subsections 3) and 18) of Article 140 of the Political Constitution; 26 and 27 of the General Law of Public Administration and Articles 21, 23, 24 and 25 of Law N° 8131 and its Regulation and in Law N° 7384 of March 16, 1994.

1. 1That through Law N° 7384 of March 16, 1994, the Costa Rican Institute of Fisheries and Aquaculture (INCOPESCA) was created with the objective of proposing the national program for the development of fisheries and aquaculture, controlling fishing and hunting of marine species in jurisdictional waters, issuing measures aimed at the conservation, promotion, cultivation, and development of marine flora and fauna and aquaculture, and regulating the supply of the fishing activity.
2. 2That to implement the policies, plans, programs, and projects destined for the fisheries and aquaculture sector, an inter-institutional cooperation agreement was signed between INCOPESCA and MIDEPLAN, for the financing of the Project for the Expansion and Construction of the Fisheries Multiservice Terminal in Puntarenas, as well as a Letter of Agreement with the Food and Agriculture Organization of the United Nations (FAO) for the Promotion of the Utilization of Shrimp Bycatch Fauna.
3. 3That in order to conclude the works of the Fisheries Terminal and comply with the aforementioned agreement, the entity requires incorporating into its current budget the corresponding resources contributed by MIDEPLAN and FAO.
4. 4That through Executive Decree N° 29511-H and its amendments, published in La Gaceta N° 98, of May 23, 2001, the Budgetary Authority formulated the General Budgetary Policy Guidelines for 2002, which were known by the Government Council and approved by the President of the Republic, establishing the limits of total expenditure, both budget expenditure and effective, for the cited year, for the entities covered by the scope of the mentioned Collegiate Body.
5. 5That it is necessary to expand for INCOPESCA, the limits of budget expenditure and effective expenditure for the year 2002, so that it may fulfill the stated objectives.

Texto Completo acta: 4D292 N° 30402-H N° 30402-H LA SEGUNDA VICEPRESIDENTA EN EJERCICIO DE LA PRESIDENCIA DE LA REPÚBLICA Y EL MINISTRO DE HACIENDA En uso de las facultades conferidas en los incisos 3) y 18) del artículo 140, de la Constitución Política; 26 y 27 de la Ley General de Administración Pública y los artículos 21, 23, 24 y 25 de la Ley N° 8131 y su Reglamento y en la Ley N° 7384 del 16 de marzo de 1994.

1. 1Que mediante Ley N° 7384 del 16 de marzo de 1994, se creó el Instituto Costarricense de Pesca y Acuacultura (INCOPESCA) con el objetivo de proponer el programa nacional para el desarrollo de la pesca y la acuacultura, controlar la pesca y la caza de especies marinas en las aguas jurisdiccionales, dictar las medidas tendientes a la conservación, el fomento, el cultivo y el desarrollo de la flora y la fauna marinas y de la acuacultura y regular el abastecimiento de la actividad pesquera.
2. 2Que para implementar las políticas, planes, programas y proyectos destinados al sector pesca y acuacultura, se firmó un convenio de cooperación interinstitucional entre el INCOPESCA y MIDEPLAN, para el financiamiento del Proyecto de Ampliación y Construcción de la Terminal de Multiservicios Pesqueros en Puntarenas, así como una Carta de Acuerdo con la Organización de las Naciones Unidas para la Agricultura y la Alimentación (FAO) para la Promoción de la Utilización de la Fauna de Acompañamiento del Camarón.
3. 3Que con el fin de concluir las obras de la Terminal Pesquera y cumplir con el acuerdo supracitado, la entidad requiere incorporar a su presupuesto vigente los recursos correspondientes aportados por MIDEPLAN y la FAO.
4. 4Que mediante Decreto Ejecutivo N° 29511-H y sus reformas, publicado en La Gaceta N° 98, del 23 de mayo del 2001, la Autoridad Presupuestaria formuló las Directrices Generales de Política Presupuestaria para el 2002, que fueron conocidas por el Consejo de Gobierno y aprobadas por el Presidente de la República, estableciendo los límites de gasto total, tanto presupuestario como efectivo para el año citado, para las entidades cubiertas por el ámbito del mencionado Órgano Colegiado.
5. 5Que es necesario ampliar al INCOPESCA, los límites de gasto presupuestario y efectivo para el año 2002, a fin de que cumpla con los objetivos indicados. Por tanto,
