throughout the entire text - Full Text of Standard 2 Procedures Manual for Payment for Environmental Services Full Text of record: 4BB23 NATIONAL SYSTEM OF CONSERVATION AREAS NATIONAL SYSTEM OF CONSERVATION AREAS NATIONAL FOREST FINANCING FUND No. 2.—San José, at nine o'clock in the morning on the twelfth day of February, two thousand two.
1°—The Forestry Law (Ley Forestal) establishes as an essential function of the State to ensure the conservation, utilization, protection, administration, and promotion of the country's forest resources, in accordance with the principle of rational use of renewable natural resources.
2°—In accordance with said principle, with the regulations established by Forestry Law No. 7575, published in La Gaceta No. 72 of April 16, 1996, and in accordance with Article 3, subsection k), the protection and improvement of the environment in the territory of the Republic is promoted through payment for environmental services (pago de servicios ambientales).
3°—The National Forest Financing Fund, called FONAFIFO, according to the provisions of Article 46 of the Forestry Law and Articles 47 and 61 of its regulation, is the entity responsible for the payment of environmental services.
4°—It is the responsibility of the National System of Conservation Areas (SINAC) to approve management plans (planes de manejo), supervise their execution, and process disbursement requests.
5°—By virtue of the foregoing, it is necessary to have a technical-administrative document that facilitates the application of the provisions contained in the Forestry Law and its regulation, regarding the application of payment for environmental services. Therefore, THE GENERAL DIRECTOR OF THE NATIONAL SYSTEM OF CONSERVATION AREAS AND THE PRESIDENT OF THE NATIONAL FOREST FINANCING FUND RESOLVE:
1°—In accordance with Forestry Law 7575 of April 16, 1996, and its regulation, Executive Decree No. 25721-MINAE, to issue the following:
PROCEDURES MANUAL FOR PAYMENT FOR ENVIRONMENTAL SERVICES 2. OBJECTIVE To establish the procedures to be applied in the payment for environmental services generated by the country's forests and forest plantations, by promoting reforestation, forest management (manejo), and forest cover (cobertura boscosa) protection activities.
3. PRIORITY AREAS By Executive Decree No. 30090 - MINAE, published in La Gaceta No. 32 of February 14, 2002, the prioritization criteria by conservation area for the Payment for Environmental Services (PSA) were defined, under the modalities of Protection, Forest Management, and Reforestation, which will be applied for the selection of projects to be considered in the PSA program.
The conservation areas must define, make known to the General Directorate of SINAC, and make available to interested parties, the procedures for the distribution of resources allocated by subregion and beneficiaries, in accordance with the provisions of Executive Decree No. 30090 - MINAE, within fifteen days after the allocation of areas carried out by the General Directorate of SINAC. Project approval must be subject to said criteria.
4. MINIMUM AND MAXIMUM AREAS The minimum and maximum areas to be considered for payment for environmental services through the different modalities shall be as detailed below:
4.1. The minimum area for payment for environmental services for established forest plantations that have not benefited from resources from income tax deductions or the forest bond certificate (certificado de abono forestal), or were covered under Article 87 of Forestry Law No. 7174, during the period it was in effect, and Articles 29 and 30 of Forestry Law No. 7575, and reforestation management plans to be executed, is one hectare and a maximum of three hundred hectares per year, per beneficiary per year.
4.2. Payment for environmental services for the Management of Natural Forests, the minimum area is two hectares and the maximum is three hundred hectares per year, per farm or group of farms adjacent to each other or nearby within a five-kilometer radius, owned by the same titleholder.
4.3. Payment for environmental services for Forest Protection, the minimum area is two hectares and the maximum is three hundred hectares per year, per farm or group of farms adjacent to each other or nearby within a five-kilometer radius, owned by the same titleholder.
4.4. For global reforestation projects, the maximum area per producer per year shall be up to fifty hectares. In the case of global protection projects, the maximum area per producer shall be up to 300 ha maximum.
4.5. The maximum area for indigenous reserves for each modality of payment for environmental services is 600 ha.
5. BENEFICIARIES All natural or legal persons, owners and possessors of forests and forest plantations who wish to benefit from the payment for environmental services provided, shall be considered beneficiaries, in mutual agreement with Article 3, subsection k), of the current Forestry Law, in exchange for the respective right in favor of the State, so that the State can commercialize, through any local or international market mechanisms, the certificates corresponding to said investment. Interested beneficiaries may submit applications in the following manner:
5.1. Individually: For the protection and management of natural forests and forest plantations already established and to be established.
5.2. Globally: Through an organization of small and medium-sized landholders, for the protection of natural forests and forest plantations to be established.
6. OBLIGATIONS 6.1. Of the beneficiaries.
Beneficiaries who enjoy payment for environmental services, individually or globally, shall be subject, with respect to the area subject to compensation, to the following obligations:
6.1.1. Comply at all times with the obligations of the contract agreed upon with the State.
6.1.2. Prevent and control forest fires.
6.1.3. Prevent and support illegal hunting control efforts.
6.1.4. Not carry out actions of cutting and extraction of forest products in areas declared for protection according to Article 33 of the Forestry Law; nor in areas that benefit from payment for environmental services under the protection modalities, except for the situations considered in Article 19 of the Forestry Law, but in this case, they must submit their application to the regulations of said provision.
6.1.5. Contribute with the State Forest Administration (Administración Forestal del Estado, A.F.E.) to carry out research and environmental education efforts in the area subject to payment for environmental services.
6.1.6. Comply with the obligations established in the Forestry Law, its regulation, and other applicable provisions.
6.1.7. Heed the technical recommendations issued by the A.F.E., FONAFIFO, and the forest manager (regente), which must be duly justified and documented within the respective file (expediente).
6.1.8. Assign to FONAFIFO the rights derived from the compensated environmental services, for the period of validity of the contract.
6.1.9. Comply with the provisions established in the management plan and the contract that regulates the provision of environmental services, which must be formalized for this purpose by the beneficiaries and the organizations with MINAE and FONAFIFO, as applicable.
6.1.10. Not have pending obligations with forest projects, financing programs, incentives, payment for environmental services, or credit granted by MINAE or any of its affiliated bodies.
6.2. Of the organizations.
Organizations benefiting from the payment for environmental services for the protection of natural forests and forest plantations must comply with the following:
6.2.1. Be organizations governed by the Associations Law No. 218 of August 8, 1939, Law No. 7932 of November 19, 1999, corresponding to the Reform of Law No. 4521 for the Establishment of Cantonal Agricultural Centers attached to the Ministry of Agriculture and Livestock, Cooperative Associations Law No. 6756 of May 5, 1982, Community Development Law No. 3859 of April 7, 1966, and be legally constituted, with current legal status.
6.2.2. Not have pending obligations with forest projects, financing programs, incentives, or credit granted by MINAE or any of its affiliated bodies.
6.2.3. Have an organizational structure that allows them sufficient administrative, accounting, and technical capacity for the direction and execution of projects. For this, they must have at least one full-time administrator, one accountant, and one forestry professional, the latter two working at least part-time, transportation equipment (at least one motorcycle), basic computer equipment, and minimum administrative and accounting procedure manuals. Their processes and the accounting results of their management must also be externally audited at least once a year. It is the responsibility of the Conservation Areas to verify and certify compliance with these requirements prior to the accreditation of the organization to manage resources under the global projects modality. This information must be requested prior to the submission of the payment for environmental services application by the organization to the conservation areas and by FONAFIFO.
6.2.4. For payment for environmental services in global reforestation and protection projects, commit to charging a maximum of 18% of the annual amount corresponding to each owner, for promotion services, technical study, approval processing, follow-up (forest management), and training. The costs incurred to obtain legal documents and negotiations on the Stock Exchange for Forest Bond Certificates must be borne by the owners.
6.2.5. The organization must demonstrate, by written report, verifiable successful experience in the field regarding the execution of forest projects (reforestation and protection). This requirement does not apply to new organizations, but it does apply to their members or permanent staff.
6.2.6. Have an exclusive account in any bank of the National Banking System to receive and distribute through it the resources from the payment for environmental services to the beneficiaries.
6.2.7. The organization must send each year to the corresponding Conservation Area and to FONAFIFO, a report prepared by the Organization's accountant, according to the format indicated in Annex 19 (Anexo 19), specifying the income and expenses for payment for environmental services, the disbursement reports made to the beneficiaries, and in general, the use of the funds, before processing new applications.
Said report must be prepared for the period from October 1 to September 30 of each year, and must be submitted to the Conservation Areas and to FONAFIFO no later than October 30 of each year. Attached to this report, the Organization must submit the Bank Reconciliation, the monthly statements of the checking account exclusively for payment for environmental services, and the financial statements as of September 30.
6.2.8. Ensure compliance with the provisions stipulated in the contract with the State.
6.2.9. The Organizations must keep a file (expediente) for each of the beneficiaries, which must be organized, following a logical order, containing an index and foliated documents; in addition, a copy of the voucher check for environmental services or the certificate in the case of forest bond certificates (certificados de abono forestal), and of the visit reports made by the forest manager." 6.3. Of the forestry professional accredited as forest manager.
The forestry professional accredited as Forest Manager must comply with the provisions of the Forestry Law, its Regulation, and the Forest Management Regulation (Reglamento de Regencias Forestales) issued by the College of Agronomists of Costa Rica (Colegio de Ingenieros Agrónomos de Costa Rica).
When the execution of the management plan so requires, the forestry professional accredited as forest manager must indicate, through a management report, the conditions and qualities of the area subject to payment for environmental services, regarding the project status and compliance with the management plan, etc.
7. PROCEDURES FOR PROCESSING APPLICATIONS FOR BENEFITING FROM THE PAYMENT FOR ENVIRONMENTAL SERVICES The maximum period for submitting applications is thirty calendar days, comprised between February 14 and March 14, 2002, according to Article 11 of Executive Decree No. 30090, published in La Gaceta No. 32, on February 14, 2002.
7.1. Requirements.
7.1.1. Written application from the beneficiary for individual projects and from the legal representative of the organization for global projects, to the corresponding subregional office of the Conservation Areas to opt for the payment for environmental services, containing the following information:
a. Name of the owner, company, or Organization and their details (name, marital status, occupation, domicile, identity card number) b. Name and details of the legal representative, and copy of the identity card.
c. The purpose of the application, including the total area and the modality to which it is desired to submit for payment for Environmental Services for each property to be incorporated into the management plan.
d. Place for receiving notifications within the administrative perimeter of the respective subregional office. If fax is used as a means of notification, the corresponding number must be indicated and the provisions of Annex 20 (Anexo 20) must be followed.
e. Indicate the exact location of the property by coordinates.
f. Date and signature (of the producer for individual projects and of the legal representative of the organization for global projects).
7.1.2 Updated certification of legal status and copy of the legal identification card.
7.1.3 Updated and current certification of property tax payment, issued by the Municipality where the property is located. For each beneficiary in individual projects and for the organization in global projects.
7.1.4 To demonstrate title to the property(ies), the following must be submitted:
a. Certification issued by the Public Property Registry or by a Notary Public. In both cases, the literal certification of the property registration and its possible modifications and encumbrances, liens, seizure decrees, conditions, validation periods, and real burdens existing on each farm; the certification must have been issued no more than three calendar months prior. The certification must contain the following information:
· Registration citations.
· Owner(s), details, marital status, identity card number, and place of residence; in the case of multiple owners, reference to the right corresponding to each of them.
· Total area of the property.
· Administrative location.
· Boundaries.
· Nature.
· Express indication of the liens, annotations, limitations, modifications, encumbrances, seizure decrees, conditions, validation periods, and real burdens existing on each farm. When documents are annotated on a farm, a copy of the respective microfilm must be attached.
Only in cases where the liens, annotations, and limitations encumbering the property cast doubt on the title of possession or the ownership right of the applicant(s), may the process be suspended upon consultation with the legal advisor of the Conservation Area.
b. For leased farms, a certified copy of the lease contract duly registered in the Public Property Registry must be submitted, which must have a validity period equal to or greater than the contract to be signed with the State.
When the lease is for less than the total area of the farm(s), the contract must specify the characteristics of the leased area, including area, boundaries, nature, and exact quality of the area not subject to the lease contract. In addition, the exact location on the cadastral plan, prepared by the surveyor and duly signed and sealed. Likewise, when the lease contract includes several farms, the number of hectares leased on each one must be expressly indicated.
c. In the event that the farm has co-ownership, a Special Power of Attorney protocolized before a notary public must be submitted, in which all co-owners agree to participate in the payment for environmental services program. This Power of Attorney may contain the delegation of representation of the members to one of them, so that the latter may carry out the corresponding procedures before the respective conservation area.
d. To demonstrate title by possession, a judicial certification of the existence of a final judgment in the corresponding possessory information proceeding must be submitted.
7.1.5 Copy of the cadastral plan of the farm certified by the National Cadastre (Catastro Nacional) or by a Notary Public.
7.1.6. Survey of the effective area on which the payment for environmental services will be made (protection, forest management, and forest plantations to be established and those established with own resources), prepared by a surveying professional. The guide for preparing surveys of the effective area to be compensated is shown in Annex 11 (Anexo 11).
Exempted from this provision are reforestation projects that receive advance payment; these must meet this requirement before receiving the second disbursement. In these cases, when the amount disbursed in the first payment is greater than the amount corresponding to the area actually planted, the beneficiary is obligated to return the amount paid in excess before the next disbursement. This refund must be made to the Single State Fund (Caja Única del Estado) through a government deposit, in which case the corresponding forest contract number and the reason for the refund must be indicated, sending a copy of this deposit to FONAFIFO and the respective conservation area. If these obligations are not met, the Conservation Area is empowered to order the precautionary measures aimed at preventing undue payment for the benefit of the beneficiary debtor of the AFE.
7.1.7 Management plan prepared and signed by a professional in Forest Sciences, incorporated into the respective professional association. The professional must appear as enabled by the College of Agronomists for professional practice, on the lists that the College must send quarterly to SINAC for this purpose. In the event that the forestry professional is affiliated with another professional association, they must present updated proof of their membership. The management plan shall be prepared according to what is indicated in Annexes 1, 2, 3, 4, and 5 (Anexo 1, Anexo 2, Anexo 3, Anexo 4, Anexo 5). In the management plans, the nature, boundaries, and area must be described in detail, both for the surface subject to payment for environmental services and for the rest of the farm.
The management plan must be submitted to the corresponding subregional office in original and two copies. The original will be kept in the archives of the subregional offices; one copy will be given to the interested party with the acknowledgment of receipt; another copy will remain in the archives of the regional office of the Conservation Area. If corrections are required, they must be signed by the forestry professional or the forest manager, as applicable, and the original and two copies must be submitted.
Management plans may be integrated into a single document that contemplates the different modalities; adjacent farms of the same owner or farms nearby within a radius no greater than five kilometers may be considered, involving a payment for environmental service to develop forest management, protection, or reforestation activities. However, the payment application shall be made separately by modality (forest management, protection, reforestation).
For global projects, organizations must submit one management plan per subregion, attaching the following requirements:
a. List of applicant members of the organization who will participate in the project, with last names and first names, identity card numbers, place of domicile, place where the area to be compensated is located, and documents proving the possession or ownership of each of these beneficiaries. Lease contracts must be registered with the Public Registry.
b. Special powers of attorney protocolized before a Notary Public, in which each beneficiary authorizes the organization to process the legal and regulatory requirements, as well as the commitment by the beneficiary to comply with the obligations established in the contract with the STATE.
c. Also, present the requirements established in points 6.2.2., 6.2.3., and 6.2.6. of this manual.
For reforestation projects that do not receive advance payment, the establishment of the plantation must be carried out in a single period, for which a maximum period of twelve months from the signing of the forest contract will be available.
7.1.8 Cartographic sheet at a scale of 1:50,000, locating the property(ies) or a photocopy of the segment where the farm is located, specifying the geographic coordinates, name, and number of the cartographic sheet, and the name and signature of the forestry professional who performs the location of the property. This applies to both global and individual projects.
7.1.9 Authorization authenticated by a lawyer or Special Power of Attorney protocolized before a notary public in the event that a third party carries out the procedure.
7.1.10. In the case of farms whose title was granted by the IDA, when the limitations are in effect, authorization issued by the Board of Directors of said institution must be submitted, so that FONAFIFO may proceed with the encumbrance of the property that has pending limitations. Under no circumstances may the presentation of this requirement be waived.
7.1.11. For the establishment of plantations within protected wild areas affected by the Environmental Management Plan (Plan de Ordenamiento Ambiental), they must adjust to the regulations stipulated in said plan. In the case of reforestation projects with fast-growing species, the technical suitability of the proposal must be expressly endorsed in the evaluation report made by the Conservation Areas.
7.1.12. Certification of being an up-to-date employer or a non-employer, issued by the Administrative Collections Section of the Costa Rican Social Security Fund (Caja Costarricense de Seguro Social, CCSS).
7.1.13. For those projects under the protection modality that have an expired forest contract, they may opt for the PSA as long as they meet the prioritization criteria established in the corresponding Executive Decree and the following requirements:
a. Written application indicating the desire to re-submit to the PSA program. In addition, they must comply with the provisions of points 7.1.1, 7.1.2, 7.1.3, 7.1.4, 7.1.10, and 7.1.12 of this manual. In the event that there are changes to the farm and change of owner that cause some type of variation in the cadastral plan, they must also comply with point 7.1.5.
b. Submit a work closure report prepared by the forest manager, which describes the current state of the area that enjoyed the PSA.
c. Submit an addendum to the management plan prepared by the forest manager, detailing the protection activities in accordance with the provisions of points 3 through 8 of Annex 1 (Anexo 1).
It must be clear that entry into the PSA program will depend on the consecutive order maintained for these purposes by each conservation area.
7.2. Allocation of resources.
Based on available resources, the subregional office shall analyze the information submitted by the applicants and select the areas that meet the prioritization criteria established in this manual and the respective decree, and shall communicate this by an official letter, which will be notified to the interested party.
7.3. Processing of applications for management plan approval.
7.3.1. For beneficiaries (organizations and individual producers) who have received resources in previous periods, new management plans will not be processed if the previously received resources have not been duly executed. Applications in which this circumstance is verified will be rejected through a reasoned decision. To comply with this provision, the beneficiary must demonstrate having planted, managed the forest, or placed under protection the entire approved area, or, failing that, having returned the unused resources, in accordance with the provisions of point 6.1.9. and 6.2.2. of this document.
The verification of pending obligations of beneficiaries individually or globally, and of organizations, will be carried out as follows:
a. FONAFIFO will verify, according to the records it has, and will report quarterly to the subregional offices of the conservation areas and to the Promotion Component (Componente de Fomento) of SINAC, the obligations of the beneficiaries or organizations with respect to credits, forest bond certificates per modality, and reports established in point 6.2.7 for organizations.
b. The subregional offices of the conservation areas will verify outstanding obligations regarding environmental services and must record in the file the result of this consultation.
c. The Department of Peasant Forestry Development (Departamento de Desarrollo Campesino Forestal) shall be responsible for reporting quarterly to the subregional offices of the conservation areas, to FONAFIFO, and to the Promotion Component of SINAC, on the organizations in default with respect to the Advance Forest Bond Certificate (Certificado de Abono Forestal por Adelantado, CAFA) and the Forest Development Fund (Fondo de Desarrollo Forestal, FDF).
If the existence of pending obligations is determined, the heads of the subregional offices must manage, in coordination with the Regional Directorate of the Conservation Area and with FONAFIFO, the execution of the collection process.
7.3.2. For the purposes of a preliminary review, those interested in opting for PSA resources for the year 2002 must submit to the subregional office of the corresponding conservation area the application with the information stipulated in point 7.1.1. of this manual, the registry study of the property or properties where the project is located with the respective stamps, and a photocopy of the respective cartographic sheet. At the subregional offices, the person receiving it must record the time, day, their name and signature, and will assign a file number according to the coding established in Annex 18 (Anexo 18).
7.3.3. Within a period of eight working days, the subregional offices will determine and select the projects that qualify for the PSA, and will notify the interested party in writing to submit the requirements established in point 7.1. of this manual, in original, updated, and current form; within a maximum period of thirty working days from the date of notification.
Once the documentation is received from the beneficiaries, the responsible officials of the subregional offices will notify the interested party within a period of eight calendar days from the date of receipt of the application, if any of the established requirements are missing or if the information submitted needs to be expanded or clarified, granting a single period of 10 ten working days for these purposes.
Once this period has elapsed, the subregional offices will not accept the submission of missing requirements and will not process the application, notifying the interested party in writing of this situation.
7.3.4. In the case of those applications that were not selected because they are not included within the prioritization criteria, the interested parties will be notified in writing within the following eight working days after the process indicated in point 7.3.3. is carried out. This provision shall apply to both new applications and the renewal of concluded protection projects.
7.3.5. For the renewal of projects under the protection modality, the preliminary selection process indicated in point 7.3.2. will be applied.
Within a period of eight working days, the subregional offices will determine and select the projects that qualify for the PSA, and will notify the interested party in writing to submit the requirements established in point 7.1.13. of this manual. Subsequently, they must notify the interested party within a period of eight calendar days from the date of receipt of the application, if any of the established requirements are missing or if the information submitted needs to be expanded or clarified, providing a maximum period of 10 ten working days for these purposes.
To facilitate the handling of documentation referring to the file of the expired contract, it must become part of the new file, and consequently, an additional volume of the already existing file must be opened, which will continue with the consecutive foliation from the number of the last folio contained in the previous volume.
Regarding the approval, registration, and formalization procedures for the forest contract, the stipulations in the following points 7.3.6. through 7.3.12. shall apply. The new contract must include a clause detailing the concluded relationship and the new approval for the PSA program under the protection modality.
7.3.6. For properties that have mortgages, it shall be the responsibility of the officials of the Conservation Areas (Áreas de Conservación), in coordination with their legal counsel, to evaluate the conditions of the mortgage and the feasibility of approving the management plan for the enjoyment of the payment for environmental services.
7.3.7. If the requirements are satisfactorily met, the subregional office of the Conservation Area (Área de Conservación) shall, within a period of thirty calendar days, register the area subject to payment for environmental services in the Project Registry Book (Libro de Registro de Proyectos) and notify the interested party by resolution (Anexo 6).
7.3.8. For individual projects, the respective Conservation Area issues the contract with the approval of the legal advisor, the beneficiary signs it, and then it is sent to FONAFIFO for the respective signatures of the Minister of Environment and Energy and the president of the Board of Directors of FONAFIFO. The Conservation Area must send, attached to the contract, the request for the first disbursement of payment for environmental services prepared by the subregion and the survey of the area to be compensated; this provision is excepted for reforestation management plans that do not receive advance payment.
7.3.9. FONAFIFO, from the receipt of the disbursement request, shall have a period of twenty calendar days to issue the payment for environmental services, provided that all requirements have been satisfactorily met. In the case of the payment corresponding to the first disbursement, the period of fifteen calendar days shall govern from the date the duly signed forest contracts arrive at FONAFIFO.
7.3.10. For global projects, FONAFIFO is responsible for issuing and signing the contract between the State and the Organization, once the Conservation Area has sent the file with the approval resolution and the originals of the special powers of attorney of the project beneficiaries.
7.3.11. In the event that the interested party has not submitted the documentation required for the approval of the management plan, they shall be notified of the missing requirements, with the file being kept in a temporary archive for the six months following the non-compliance without the need to issue any act, and the file may be reactivated during this period. In which case, the Subregion shall assign a new file number, according to the current consecutive numbering.
7.3.12. Once this last period has expired, the expiration (caducidad) of the application shall be decreed by resolution, and the file shall be definitively archived. Any subsequent procedure on the same matter must be processed as a new application.
8. ISSUANCE AND DELIVERY OF THE PAYMENT FOR ENVIRONMENTAL SERVICE 8.1. For the payment for environmental services, the funds shall be disbursed as established by the corresponding executive decree. For the first installment, the Beneficiary shall submit the application to the subregional office, with an original and one copy; the original shall remain in the subregional office and the copy shall be sent to the Directorate of the Conservation Area. The subregional office shall have a period of fifteen business days to process the same and send the disbursement request to FONAFIFO if applicable.
8.1.1. For forest management (manejo de bosques).
In the forest management modality, the beneficiary may request in writing the 50% corresponding to the first installment of the payment for environmental services, once they demonstrate to the State Forest Administration (Administración Forestal del Estado) that the harvesting (aprovechamiento) was carried out in accordance with the principles, criteria, and indicators of management, by means of a management report (informe regencial) issued by the forest manager (regente forestal) responsible for the execution of the management plan. They must also submit the survey of the effective area, the management contract (contrato de regencia), and certification of current employer status or non-employer status issued by the Costa Rican Social Security Fund (Caja Costarricense de Seguro Social).
For subsequent disbursements, the beneficiary must submit the management contract (contrato de regencia) and management report (informe regencial), and certification of current employer status or non-employer status issued by the Costa Rican Social Security Fund. These disbursements may be requested according to the following detail:

8.1.2. For forest protection (protección de bosques).
For protection management plans, the first disbursement (20%) shall be made once the contract with the State is formalized, for which the beneficiary must submit to the respective subregional office a written application, the management contract (contrato de regencia), the survey of the effective area to be compensated, and certification of current employer status or non-employer status issued by the Costa Rican Social Security Fund. The second, third, fourth, and fifth disbursements, each for 20%, may be requested by the beneficiary, beneficiary, or organization at twelve, twenty-four, thirty-six, and forty-eight months from the date of formalization of the forest contract. To process the aforementioned disbursements, the beneficiary must submit the following requirements to the corresponding subregional office: written application, management contract (contrato de regencia), management report (informe de regencia), and certification of current employer status or non-employer status issued by the Costa Rican Social Security Fund.
8.1.3. For individual and global reforestation.
For reforestation projects that do not receive advance payment, the first disbursement shall be made once the plantation is established, having previously submitted to the Subregional Office a written application, the management contract (contrato de regencia), management report (informe de regencia), survey of the effective area to be compensated, certification issued by the forest manager (regente forestal) in charge of the nursery attesting to the quality of the vegetative material, and certification of current employer status or non-employer status issued by the Costa Rican Social Security Fund. In the case of species that have certification from the National Seed Office (Oficina Nacional de Semillas) and where the seed supply meets national demand, the manager must attach a copy of the invoice indicating that the seed has the respective certification. The second, third, fourth, and fifth disbursements shall be made at twelve, twenty-four, thirty-six, and forty-eight months, respectively, from the average planting date. To process these disbursements, the beneficiary must submit to the Subregional Office a written application, certification of current employer status or non-employer status issued by the Costa Rican Social Security Fund, a valid management contract (contrato de regencia), and the management report (informe regencial), detailing the progress of the management plan and recommending the payment for environmental services.
In the case of reforestation projects that receive advance payment, the first disbursement shall be made once the contract with the State is formalized, having previously submitted the management contract (contrato de regencia) to the subregional office. The application for the second disbursement must attach the survey of the effective area to be compensated, management report (informe regencial), certification issued by the forest manager (regente forestal) in charge of the nursery attesting to the quality of the vegetative material, a valid management contract (contrato de regencia), and certification of current employer status or non-employer status issued by the Costa Rican Social Security Fund (beneficiaries and organizations). Likewise, this applies to reforestation projects established with own resources. The second, third, fourth, and fifth disbursements shall be made at twelve, twenty-four, thirty-six, and forty-eight months, respectively, from the date of formalization of the forest contract. From the third disbursement onward, beneficiaries must submit to the subregional office a written application, certification of current employer status or non-employer status issued by the Costa Rican Social Security Fund (beneficiaries and organizations), a valid management contract (contrato de regencia), and the management report (informe regencial), detailing the progress of the management plan and recommending the payment for environmental services.
Reforestation projects, executed individually or globally with areas up to 50 ha, shall receive advance payment once they have formalized the contract with the State. To this end, the organization must have previously provided a mortgage guarantee, a pledge guarantee, or a combination of both, endorsed by the members of the Board of Directors, for the amount of the first disbursement. Independent producers must back the first disbursement with a mortgage guarantee, a pledge guarantee, or a combination of both. In these cases, FONAFIFO shall appraise the assets offered as guarantee; the cost of this appraisal and the registration of the guarantee must be covered by the beneficiary.
Reforestation projects with areas exceeding 50 ha shall receive the first disbursement once the plantation is established, which must be demonstrated by certification from the forest manager (regente forestal).
8.1.4. For reforestation with own resources.
For management plans for reforestation with own resources, the first disbursement shall be made once the contract with the State is formalized, for which the management contract (contrato de regencia) must be submitted. To process this first disbursement, the beneficiary must provide the survey of the effective area to be compensated. Subsequent disbursements shall be made in accordance with the provisions of the executive decree, for which the following requirements must be submitted: management contract (contrato de regencia) and management report (informe de regencia).
For subsequent disbursements, the management report (informe regencial) detailing the progress of the management plan and recommending the payment for environmental services, and the valid management contract (contrato de regencia) must be attached to the applications.
8.2. For any of the modalities, the conservation areas may supervise the management plans before issuing the disbursement requests, provided that this action is carried out before the deadlines established in this manual.
8.3. The beneficiary may request the processing of the corresponding disbursement at the subregional office, which shall have a period of fifteen calendar days to send the beneficiary's application (Anexo 18) to FONAFIFO. From the second installment onward, if the beneficiary wishes to personally process the disbursement before FONAFIFO, they must first deliver the original application as established in Anexo 18 and the requirements established in point 8.1., as applicable, to the corresponding subregional office. The subregional office shall have a consecutive series of official communications exclusive to this procedure, which shall be assigned at the time, also indicating the name and signature of the official authorized by the conservation area and registered with FONAFIFO who receives it, and shall stamp the original that will be presented to FONAFIFO; the rest of the documentation shall remain in the subregion for verification of the application and the control and supervision of the management plan. A copy of the information indicated above must be filed in the file of the subregional office. The submission of documents may be carried out by the beneficiary or by whomever they authorize.
8.4. In the case of applications processed by the beneficiary or the organization directly before FONAFIFO, the subregional office, once it receives the issuance request from the Beneficiary or the Organization, shall have a period of fifteen calendar days to communicate in writing to FONAFIFO if there is any objection that makes the issuance of the requested installment impossible. If it does not pronounce within the established period, FONAFIFO shall proceed with the payment.
8.5. Once the issuance request is submitted by the beneficiary or the organization, with the stamp of the subregional office, FONAFIFO shall have twenty business days to issue the corresponding installment, provided that the requirements established in this manual have been satisfactorily completed.
8.6. The procedure established in points 8.3., 8.4., and 8.5. may be applied to management plans approved in previous years, if the owner expressly requests it before the corresponding conservation area.
8.7. In accordance with articles 49 and 68 of the Forestry Law No. 7575, FONAFIFO shall deduct 0.75% from the total amount to be paid for environmental services, in order to cover the costs of formalizing (protocolización) the corresponding forest contract, for purposes of encumbering (afectación) the properties before the Public Property Registry (Registro Público de la Propiedad).
To operationalize the payment of the formalization costs, the beneficiary shall authorize FONAFIFO, through the signing of the PSA contract, to withhold the amount corresponding to these costs from the first disbursement.
When the beneficiary or organization needs to temporarily suspend the encumbrance (afectación) before the Public Property Registry, they must request it in writing to FONAFIFO, with a copy to the respective conservation area. The request must contain the following:
a. A written request stating the purpose of the withdrawal. b. In the case of global projects, a written authorization from the organization in charge of the project. c. In the case of individual projects, an approval from the respective conservation area. d. In the case of organizations, the manager (regente) must certify that the action to be performed includes the areas covered by the payment for environmental services management plan. e. In the case of mortgages, the mortgage creditor must expressly accept in the deed that they accept the forest project and its consequences (provide a certified copy or original of the deed). f. A cash guarantee, deposited in account No. 125119-8 of the National Bank of Costa Rica (Banco Nacional de Costa Rica) or a matured security made out to the order of FONAFIFO, for the amount of the environmental service payment received. g. A registry study or certification describing the liens, annotations, assignments, or any other movement. h. Address for notifications. i. Once the requirements are completed, FONAFIFO shall determine the responsible notary, who shall analyze the attestations, recommending or not to FONAFIFO the signing of the withdrawal deed without registration. j. Once all requirements are met, FONAFIFO has a period of ten days to execute the deed.
8.8. The payment for environmental services shall be delivered by FONAFIFO to the individual beneficiaries and to the legal representative in the case of organizations and other legal entities. Individual beneficiaries must present a current and undamaged identity card.
In the case of legal entities, the attorney-in-fact or representative of the legal entity must appear, who, in addition to the identity card, must have a current certification of legal status (personería jurídica), stipulating that they are the representative and indicating other data such as legal ID number, volume, folio, and entry where it is registered, that it was issued no more than three months prior, and that it bears the payment of stamps established by law.
In the event that the beneficiary, whether an individual or a legal entity, cannot personally appear to collect the payments, they may authorize a third party to do so through a special power of attorney. Apart from the requirements indicated in the previous paragraph, they must provide a special power of attorney or authorization, in which the entitled party empowers the other to withdraw the payment. The essential requirements for this power of attorney are:
a. The identification of the persons with full first and last names. b. Identity card numbers. c. An express statement of what is being authorized. d. It need not be executed on security paper, but must obligatorily be authenticated. e. Include the following stamps: ¢125 fiscal and ¢50 of the Bar Association (Colegio de Abogados). g. In the case of legal entities, they must also present the certification of legal status (personería), stating the powers of the person granting the power of attorney.
8.9. Beneficiaries who are interested in having the resources from the payment for environmental services deposited into a checking or savings account at the National Bank of Costa Rica (Banco Nacional de Costa Rica) must provide written authorization to the Trust Section of this bank and provide a photocopy of the current individual or legal entity ID card, as applicable. This procedure applies only to organizations or individual projects with a single beneficiary, whether an individual or a legal entity.
8.10. Organizations shall have the obligation to deliver the corresponding disbursements to the beneficiaries, for both forest bond certificates (certificados de abono forestal) and payment for environmental services, within a maximum period of 30 calendar days.
In the event that there is any impediment to the delivery of funds by the organizations to the beneficiaries of forest bond certificates or payment for environmental services, the organizations shall have a maximum period of eight business days to reimburse the corresponding amount to the Single State Fund (Caja Única del Estado) through a government deposit, in which case the forest contract number, modality, and the reason for the return must be indicated, sending a copy of this deposit to FONAFIFO and the respective Conservation Area.
9. FOLLOW-UP AND MONITORING PROVISIONS 9.1. The Beneficiary must carry out the silvicultural tasks, according to the proposed management system (reforestation, protection, and forest management).
9.2. The Beneficiary must implement measures for the prevention and control of pests and/or diseases and forest fires.
9.3. For the follow-up and evaluation of the management plans for payment for environmental services, FONAFIFO shall contract the services of an external entity to audit and evaluate the status and compliance with obligations by the beneficiaries, the organizations, the conservation areas, and their Subregional Offices. This evaluation must be carried out at least every two years. FONAFIFO shall define the technical guidelines for it. Those involved must contribute to this process and must implement the recommendations derived from the audit.
9.4. For the monitoring (monitoreo) of the projects, FONAFIFO shall contract the services of a specialized external entity to determine the growth and development of the environmental services provided, as well as to keep the national inventory of environmental services and other forest products updated. Those involved must contribute to this process and implement the recommendations derived from it. The project owners and the associated organizations may request the results of the generated information from FONAFIFO. The information obtained must be widely disseminated by FONAFIFO. To cover the costs of the evaluations established in point 9.3. and the monitoring (monitoreo) established in this point, FONAFIFO may allocate part of the funds for the payment of environmental services assigned annually, in accordance with the provisions of article 64 of the Regulation of the Forestry Law 7575.
9.5. The technician from the Subregional Office and the official from the oversight body of the Professional Association (Colegio) may visit the compensated area at any time to verify its condition and the information recorded in the management reports (informes regenciales).
9.6. The conservation areas must keep the files duly paginated, ordered chronologically, and with a table of contents.
10. FINAL PROVISIONS 10.1. The A.F.E. and FONAFIFO may suspend the application of the payment for environmental services and initiate the corresponding administrative and legal actions for the recovery of the resources already applied, when it is proven that there was a breach of the management plan, the contract, the Forestry Law, and other current regulatory provisions. Likewise, it shall initiate the pertinent administrative procedure to determine whether or not to cancel the forest contract, establishing the corresponding responsibilities.
10.2. In the event of a sale of the area subject to payment for environmental services, whether partial or total, the BENEFICIARY must notify the Subregional Office of the transaction carried out within a maximum period of thirty days. The new BENEFICIARY must request the modification of the contract, providing the corresponding legal documentation that accredits them as the owner, within a maximum period of thirty days after the transaction is completed.
10.3. The protection areas established in article 33 of the Forestry Law No. 7575, which are located within the area subject to the payment for environmental services, shall be included within the total area that will receive the compensation. This provision does not apply to reforestation projects.
10.4. The treatment of lands in indigenous reserves must be the same as that given to the rest of the administered parties, with the exception that in their case, all procedures for the application of the payment for environmental services must be signed by the legal representative of the community, the president of the Indigenous Development Association (Asociación de Desarrollo Indígena), upon prior agreement of the board of directors. For purposes of forest harvesting (aprovechamiento forestal), action must be taken in accordance with the provisions of the regulation for the harvesting of forest resources in indigenous reserves, Executive Decree No. 26511-MINAE, and the provisions of the Indigenous Law No. 6172. Applications must be submitted with the endorsement of the Assemblies of the corresponding Development Associations.
10.5. The management reports (informes de regencia) required for the different procedures must have been issued on a recent date, not exceeding one month prior to the time of submission to the subregion.
It takes effect as of its publication in the official gazette.
MINIMUM REQUIREMENTS FOR THE PREPARATION OF MANAGEMENT PLANS FOR THE PAYMENT FOR ENVIRONMENTAL SERVICES FOR FOREST PROTECTION, INDIVIDUAL OR GLOBAL For global projects, a single technical document must be submitted per Subregion, containing the information and recommendations, individualized for each beneficiary, for points one through seven of this proposal. From point eight through thirteen, the technical recommendations shall be presented on a group basis for all beneficiaries.

FIRE PREVENTION In areas considered to have a high to medium fire risk, the establishment of firebreaks (rondas cortafuegos) shall be required, which shall be described, located, and justified within the management plan, and other prevention and control measures shall also be defined. In high-risk zones, firebreaks (rondas cortafuegos) must be established with a width of no less than 8 meters; in medium-risk zones, the width of the firebreaks must be a minimum of 4 meters; and in low-risk zones, their establishment is not necessary. The firebreaks must be kept completely free of vegetation or combustible material during the period of lower precipitation, which is the period of highest risk. These activities must be included as part of the activity schedule.
5. FOLLOW-UP OF THE PLAN The manager (regente) shall conduct at least one supervision visit annually and shall submit to the Subregional Office a management report (informe regencial), recommending or not the payment for environmental services.
6. SCHEDULE OF ACTIVITIES The scheduling of activities shall be planned for the term of the contract. It shall include at least the establishment of firebreaks (rondas cortafuegos) and fences, their maintenance, supervision visits, and presentation of the management report (informe regencial).
7. OTHER AREA PROTECTION MEASURES Describe the measures to be taken to prevent and control activities such as illegal hunting, cutting, and illicit extraction of forest products.
8. SURVEILLANCE Indicate the tasks to be carried out.
9. SIGNAGE Signage shall be erected, indicating that the farm is receiving the payment for environmental services, fire prevention, as well as the prohibition of hunting, cutting, and extraction of forest products. The minimum size for the signs is established as 40 cm by 60 cm.

Vegetative material: The use of certified seed will be required for those species for which seed is available to cover the total demand of the country. For this purpose, the National Seed Office (Oficina Nacional de Semillas) will keep the State Forestry Administration (Administración Forestal del Estado), forestry regents (regentes forestales), and the forestry sector informed of the availability of this material.
4.4. Selection of the species.

FOREST PEST AND DISEASE PREVENTION PLAN Programming of preventive and control activities for pests and diseases in the different development stages of the management plan (nursery, establishment, maintenance, and silvicultural work). For global projects, a general description of the measures to be adopted by all beneficiaries will be presented.
7. PLAN FOLLOW-UP (SEGUIMIENTO) For the supervision of the management plan, the regent (regente) will conduct periodic visits in accordance with the provisions established by the College of Agronomists of Costa Rica (Colegio de Ingenieros Agrónomos de Costa Rica), and will submit the regency report (informe regencial) to the Subregional Office (Oficina Subregional).

The first disbursement will be made once the Forest Regent (Regente Forestal) certifies to the respective Conservation Area (Área de Conservación) that the protection activities contemplated in the management plan are to begin. In subsequent years, the Regent (Regente) must report that the work contemplated in the management plan for that period has been carried out.
THIRD: As a voluntary encumbrance on the property, THE BENEFICIARY (EL BENEFICIARIO) agrees to maintain the execution of the forest management plan for a period of ________ (protection and established plantations, five years; forest management, ten years; and reforestation, a period up to the harvest time of the species, provided it does not exceed fifteen years, in which case this will be the validity period), for which purpose he/she authorizes FONAFIFO to notarize the relevant parts of this contract so that it is registered in the Public Registry (Registro Público) as a limitation on the property (limitación de la propiedad), as well as to deduct the costs that this entails.

- e)Not carry out logging or extraction of timber products.
- f)Not carry out activities that alter the natural behavior of the area to be protected.
- g)Notify MINAE of any alteration or contingency that causes changes in the protected area.
- h)Allow free access to MINAE personnel in charge of control to the location of the incentivized area, facilitating their work.
- i)Allow MINAE to carry out environmental research and education activities in the incentivized area.
- j)Comply with the obligations established in the Forest Law (Ley Forestal), its regulations, and other applicable provisions.
- k)Comply with any technical recommendation issued by MINAE.
FIFTH: Any total or partial sale of the property (inmueble) subject to this contract binds the new owner or acquirer under the same terms, unless the latter wishes to return the proportional amount paid by FONAFIFO. In which case, the corresponding settlement will proceed.

INSTRUCTIONS FOR CONDUCTING SURVEYS OF THE EFFECTIVE AREA TO BE COMPENSATED THROUGH THE PAYMENT FOR ENVIRONMENTAL SERVICES (PAGO DE SERVICIOS AMBIENTALES, PSA) The surveys must locate and/or indicate the following:
1. Total area planted per year and species or managed forest area or conserved forest area.
2. For reforestation projects, the areas occupied by other land uses (existing infrastructure, protection zones, etc.) must be located and quantified, provided these are within the planted blocks or areas.
3. For forest management and protection projects, protection areas shall not be detailed, because they form part of the area subject to payment for environmental services (pago de servicios ambientales, PSA). It will only be necessary to quantify and deduct from the effective area in the survey, the areas occupied by primary roads and log yards (patios de acopio). PROCESS FOR THE USE OF FAX AS A MEANS OF NOTIFICATION IN JUDICIAL OFFICES Taken and adapted from the Regulation for the use of fax as a means of notification in judicial offices, approved by the Full Court in session No. 27-96, held on November 11, 1996, article XII, published in the Judicial Bulletin No. 238 on Wednesday, December 11, 1996 1. The subregional and regional offices of the conservation areas (áreas de conservación) of the Ministry of Environment and Energy, that have a fax machine, may notify by this means interested parties who have so requested expressly and unequivocally. The receiving fax may be located anywhere in the national territory. Likewise, interested parties may use this means to notify or send the required information when applicable.
2. Resolutions shall be deemed notified on the business day following the day on which the transmission was made.
3. The official of the area who sends or receives the corresponding information must record this procedure in the case file (expediente).
4. To make the notification, the subregional offices shall transmit the original document and a cover page or title page designed for this purpose indicating, at least, the case file number, the nature and purpose of the proceeding, the full name of the interested party, prominently displaying the name of the office processing the case, with the name and signature of the notifier.
5. When the notification must be made by the regional office of the conservation area, the subregional offices must provide the necessary documents and data.
The subregional or regional office shall keep a record of transmissions made and those not executed, as well as the reasons that prevented them from being carried out.
6. Whoever must perform the notification shall make a minimum of five attempts, at intervals of at least 10 minutes, to send the fax to the indicated number, which shall be recorded in the case file, with specification of day and time.
7. The subregional or regional office must indicate on the cover page accompanying the notification an express request to the interested party for them to confirm or ratify by this same means that they received the notification.
