Agreement No. 2629: Authorization is granted to send for publication in the Official Gazette La Gaceta, the following Draft Water Services Regulation for Aquaculture, so that users and other interested parties may submit their observations or comments to this Board of Directors, within ten business days following its publication. Therefore, it is agreed to issue the following Water Services Regulation for Aquaculture in DISTRA.
General Provisions
CHAPTER 1
SENARA: National Groundwater, Irrigation and Drainage Service (Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento).
DISTRA: Arenal Irrigation District (Distrito de Riego Arenal).
CGR: Contraloría General de la República.
ARESEP: Autoridad Reguladora de los Servicios Públicos.
Irrigation District (Distrito de Riego): a physical, technical-administrative unit of an agricultural and livestock nature, in which the necessary works exist or are to be carried out, seeking maximum efficiency and effectiveness in the use of available water resources, seeking their comprehensive utility and guaranteeing their sustainability over time, in order to achieve the greatest agricultural, economic and social development of the agricultural production units involved.
User: any natural or legal person who owns a property that receives water within DISTRA, for use in the purposes stipulated by the SENARA Law.
Registry of Aquaculture Users (Registro de usuarios de piscicultura): the registry containing the information of users and properties that have water service for aquaculture.
Water Service for Aquaculture: the set of assets, activities and personnel that, subject to the authority of DISTRA, makes possible the delivery of water for use in aquaculture, in accordance with the policies approved for this purpose by the Board of Directors of SENARA.
Water Tariff for Aquaculture: the monetary compensation that the user must pay for the water service for aquaculture.
Irrigation Tariff: the monetary compensation approved by ARESEP that must be paid for the irrigation service.
SENARA will inform those interested in developing new aquaculture projects of the available resources, in statistical monthly averages, that have been recorded. Each year, SENARA will inform aquaculture users of the monthly projections of water availability. On these bases, projects shall be developed and operated at the sole account and risk of each interested party.
The construction, operation and maintenance of infrastructure within each farm shall be the responsibility of the user.
The delivery to each aquaculture project shall be in accordance with the water utilization plans required by irrigation users located downstream of the aquaculture operation, unless there are available surpluses in the system that can be supplied for aquaculture.
For any of these reasons, water delivery may also be limited at the discretion of SENARA, ensuring that said limitation occurs under conditions of equity, to the extent technically possible, which shall be notified to the users without delay.
The water distribution system in DISTRA is a system of open channels; for this reason, SENARA does not assume responsibility for acts of vandalism or accidental acts by third parties, that introduce physico-chemical or bacteriological contamination into the waters, and that may cause negative effects to the aquaculture activity.

Every application must be submitted prior to the establishment of the infrastructure for aquaculture production; therefore, SENARA shall not be responsible for providing the service before issuing a favorable resolution.
After the favorable resolution is issued, the user shall have a period of one year to build the project, which may be extended for an equal period by agreement of the Board of Directors of SENARA in justified cases.
Said service suspension shall be communicated to the users with 8 calendar days' notice, unless the urgency or nature of the repair does not permit it.
It may also, upon prior notice to the users, carry out the collection of the tariffs through a third party, with which it enters into a contract for this purpose.
Rights of Users
CHAPTER II
To request from SENARA the registration in the Registry of Water Users for Aquaculture of the District.
To request any necessary modifications to the data recorded in the Registry of Water Users for Aquaculture, providing the pertinent documentation. If the claim consists of a review of the area subject to the water service for aquaculture, the user must provide the updated topographic survey, prepared by a competent professional, for analysis and resolution by SENARA.
To be informed by SENARA about the flow rates, in monthly averages, that have been available in the hydraulic sector where the project is located over the last three years. Likewise, to be informed of the monthly projections of water availability expected for the following year in said sector.
To receive at the intake works of their project, the corresponding water allocation, under normal conditions of service provision, in accordance with the water utilization plans required by irrigation users located downstream of the aquaculture operation, or available surpluses in the system assigned to the aquaculture activity.
To present to the District authorities any suggestions or requests related to the water service for aquaculture.
To present complaints or claims about the service provided by SENARA using the forms that the District will make available for this purpose. SENARA shall be obliged to address the complaints or claims in a timely manner and within the terms established by the General Public Administration Law. Claims filed with SENARA shall be processed before the District authorities, the General Management and, in the last instance, before the Board of Directors of SENARA.
Any other rights established in other Laws and Regulations.
Duties of Users
CHAPTER III
To pay the water service tariffs for aquaculture within the established deadlines.
To define and establish the production system that best suits their interests, taking into account the flow rate of water that SENARA is able to provide.
To build the necessary works within their property to handle variations in the continuous supply of water, as well as the works that ensure the return of flow rates to the system for use in irrigation.
To build within their property continuous gauging structures at the water inlets to the project, as well as the necessary works for the distribution, efficient use and evacuation of water, following the technical recommendations issued in this regard by SENARA officials.
To confirm to the official designated by SENARA, directly or through a person authorized for this purpose, their water requirements. If said official detects any anomaly in the infrastructure, the user must correct it prior to receiving the service.
To use the water received only on the property of the requesting user.
To make adequate use of the water, from their respective intake, avoiding waste or contamination and any other activity that negatively affects the environment and the water quality for subsequent use in irrigation. It is the user's responsibility to comply with the requirements demanded by Law regarding environmental protection.
Not to alter, construct or destroy any work that affects the services provided by SENARA in the District and the interests of other users.
To notify of any transfer, segregation or division of the property registered in the Registry of Water Users for Aquaculture, by sending the pertinent documentation to the District authorities, within a period not exceeding three months after the transfer or segregation has been effected. Said documentation consists of the following:
To respect the easement rights of SENARA, of the infrastructure for the conveyance and distribution of water, and to refrain from actions that may endanger said infrastructure, or harm its normal operation and maintenance.
To comply with all provisions issued by the District aimed at achieving the best use of water and the most efficient operation and conservation of the works.
To provide collaboration to SENARA, by reporting those actions that harm the normal provision of the service.
Prohibitions
CHAPTER IV
Placing fences or obstacles in conveyance and distribution channels, and in SENARA's rights-of-way.
Using the channels and adjacent roads for machinery passage in sites different from those designated for this purpose by SENARA, without prior express authorization from the DISTRA Management.
Taking a flow rate greater than that authorized by SENARA or diverting flow rates at points not approved by SENARA.
Depositing garbage or materials of any nature in the channels, that in any way impede the free flow of the waters, or contaminate them.
Operating the gates of the channels and other structures that are under the control of the District.
Altering or damaging the infrastructure works built by SENARA.
Discharging waters at sites not previously approved by SENARA.
Tariff and Collection Procedure
CHAPTER V
The tariff for aquaculture shall have the following components:
A- The equivalent of the irrigation tariff according to the area under irrigation coverage.
B- Tariff for the concept of a supplementary quota for aquaculture that accounts for the loss of flexibility throughout DISTRA, due to the specificity of the service in terms of water availability and continuity.
Invoices shall be made available for payment during the first two weeks of the month immediately following the end of each month and shall have as their due date the last business day of that month.
Likewise, SENARA shall notify the user who is in a condition of delinquency, granting a period of 10 business days to bring the debt up to date, under warning that once the period has expired and if the delinquency persists, SENARA shall suspend the service for non-payment.
Sanctions
CHAPTER VI
Even when the service is suspended, for causes attributable to the user, this does not exempt them from the payment of the tariff and corresponding surcharges.
Final Provisions
CHAPTER VII
TRANSITORY: The provisions of this Regulation shall not affect the flow rate allocation commitments in existing aquaculture projects, and regulated by Agreements entered into prior to the enactment of this regulation.

Por lo tanto, se acuerda emitir el siguiente Reglamento de Servicios de Agua para Piscicultura en el DISTRA.
CAPÍTULO 1
Disposiciones generales
1.1. SENARA: Servicio Nacional de Aguas Subterráneas, Riego y Avenamiento.
1.2. DISTRA: Distrito de Riego Arenal.
1.3. CGR: Contraloría General de la República.
1.4. ARESEP: Autoridad Reguladora de los Servicios Públicos.
1.5. Distrito de Riego: unidad física, técnica - administrativa de carácter agropecuario, en la que existen o se vayan a realizar las obras necesarias, procurando la máxima eficiencia y eficacia en el uso de los recursos hídricos disponibles, buscando su utilidad comprensiva y garantizando su sostenibilidad en el tiempo, a efecto de lograr el mayor desarrollo agropecuario, económico y social de las unidades agro productivas involucradas.
1.6. Usuario: es toda aquella persona física o jurídica propietaria de un inmueble que recibe agua dentro del DISTRA, para emplearla en los fines estipulados por la Ley del SENARA.
1.7. Registro de usuarios de piscicultura: es el registro que contiene la información de los usuarios e inmuebles que disponen del servicio de agua para piscicultura.
1.8. Servicio de agua para piscicultura: conjunto de bienes, actividades y personal que, sometido a la autoridad del DISTRA, hace posible la entrega de agua para su uso en piscicultura, de conformidad con las políticas que al efecto aprobó la Junta Directiva de SENARA.
1.9. Tarifa de agua para piscicultura: es la retribución monetaria que debe pagar el usuario por el servicio de agua para piscicultura.
1.10. Tarifa de riego: es la retribución monetaria aprobada por ARESEP que se debe pagar por el servicio de riego.
El SENARA informará a los interesados en desarrollar nuevos proyectos de piscicultura, cuáles son las disponibilidades, en promedios mensuales estadísticos de recurso hídrico que se ha tenido. Cada año, el SENARA informará a los usuarios de piscicultura, las proyecciones mensuales de disponibilidad de agua. Sobre esas bases, los proyectos se desarrollarán y operarán por cuenta y riesgo de cada interesado.
La construcción, operación y mantenimiento de infraestructura dentro de cada finca corresponderá al usuario.
La entrega a cada proyecto de piscicultura será acorde con los planes de utilización de las aguas requerida por usuarios de riego ubicados aguas abajo de la suministrados para piscicultura.
Por cualquiera de estas razones la entrega de agua también podrá ser limitada a juicio de SENARA, procurando que dicha limitación se dé bajo condiciones de equidad, hasta donde técnicamente sea posible, de lo cual se informará sin demora a los usuarios.
El sistema de distribución de agua en el DISTRA es un sistema de canales abiertos; motivo por el cual el SENARA no asume responsabilidad por actos vandálicos o accidentales de terceros, que introduzcan contaminación físico - química o bacteriológica a las aguas, y que puedan causar efectos negativos a la actividad de piscicultura.
Toda solicitud deberá presentarse previamente al establecimiento de la infraestructura para la producción piscícola, por lo que el SENARA no será responsable de brindar el servicio antes de emitir una resolución positiva.
Luego de emitida la resolución favorable, el usuario tendrá un plazo de un año para construir el proyecto, el cual podrá ser ampliado por un período igual por acuerdo de la Junta Directiva de SENARA en casos justificados.
Dicha suspensión del servicio será comunicada a los usuarios con 8 días naturales de antelación, salvo que la urgencia o naturaleza de la reparación no lo permita.
También podrá, previa comunicación a los usuarios, realizar la recaudación de las tarifas por medio de un tercero, con el cual suscriba un contrato para este fin.
De los derechos de los usuarios
CAPÍTULO II
12.1. Solicitar ante el SENARA la inscripción en el Registro de Usuarios de Agua para Piscicultura del Distrito.
12.2. Solicitar las modificaciones que sean necesarias a los datos consignados en el Registro de Usuarios de Agua para Piscicultura, aportando la documentación pertinente. Si el reclamo consiste en una revisión del área sujeta al servicio de agua para piscicultura, el usuario deberá aportar el levantamiento topográfico actualizado, elaborado por un profesional competente, para análisis y resolución por parte del SENARA.
12.3. Ser informado por el SENARA sobre los caudales, en promedios mensuales, que se han tenido disponibles en el sector hidráulico donde se ubica el proyecto en los últimos tres años. Asimismo,ser informados de las proyecciones mensuales de disponibilidad de agua que se esperan para el año siguiente en dicho sector.
12.4. Recibir en la obra de toma de su proyecto, la dotación de agua correspondiente, bajo condiciones normales de prestación del servicio, conforme con los planes de utilización de uso del agua requerida por usuarios de riego ubicados aguas abajo de la explotación piscícola, o excedentes disponibles en el sistema asignados a la actividad de piscicultura.
12.5. Gestionar ante las autoridades del Distrito aquellas sugerencias o peticiones relacionadas con el servicio de agua para piscicultura.
12.6. Presentar quejas o reclamos del servicio que le brinda el SENARA mediante las boletas que para ese efecto tendrá disponible el Distrito. El SENARA tendrá la obligación de atender las quejas o reclamos oportunamente y dentro de los términos que establece la Ley General de la Administración Pública. Los reclamos planteados al SENARA se tramitarán ante las autoridades del Distrito, la Gerencia y en última instancia, ante la Junta Directiva del SENARA.
12.7. Los demás derechos establecidos en otras Leyes y Reglamentos.
De los deberes de los usuarios
CAPÍTULO III
13.1. Pagar las tarifas por servicio de agua para piscicultura en los plazos establecidos.
13.2. Definir y establecer el sistema de producción que mejor convenga a sus intereses, teniendo en cuenta el caudal de agua que SENARA está en posibilidades de brindar.
13.3. Construir las obras necesarias dentro de su propiedad para atender las variaciones en el suministro continuo de agua, así como las obras que aseguren el retorno de los caudales al sistema para utilizarlos en riego.
13.4. Construir dentro de su propiedad estructuras de aforo continuo en las entradas de agua al proyecto, así como las obras necesarias para la distribución, aprovechamiento eficiente y evacuación del agua, atendiendo las recomendaciones de orden técnico que al respecto emitan los funcionarios del SENARA.
13.5. Confirmar al funcionario que el SENARA designe, directamente o por medio de una persona autorizada al efecto, sus requerimientos de agua. Si dicho funcionario detecta alguna anomalía en la infraestructura, el usuario deberá corregirla previo a recibir el servicio.
13.6. Utilizar el agua recibida sólo en la propiedad del usuario solicitante.
13.7. Hacer un manejo adecuado del agua, a partir de su respectiva toma, evitando desperdicios o contaminación y cualquier otra actividad que afecte negativamente el ambiente y la calidad de agua para uso posterior en riego. Es responsabilidad del usuario cumplir con los requisitos que exige la Ley en materia de protección ambiental.
13.8. No alterar, construir o destruir ninguna obra que afecte los servicios prestados por SENARA en el Distrito y los intereses de otros usuarios.
13.9. Comunicar cualquier traspaso, segregación o división de la propiedad inscrita en el Registro de Usuarios de Agua para Piscicultura, remitiendo la documentación pertinente a las autoridades del Distrito, en un plazo no mayor de tres meses después de efectuado el traspaso o segregación. Dicha documentación consiste en lo siguiente:
13.10. Respetar los derechos de servidumbre de SENARA, de la infraestructura para la conducción y distribución del agua, y abstenerse de acciones que puedan poner en peligro dicha infraestructura, o perjudiquen su normal operación y mantenimiento.
13.11. Acatar todas las disposiciones que dicte el Distrito tendientes a lograr el mejor aprovechamiento del agua y la más eficiente operación y conservación de las obras.
13.12. Brindar colaboración a SENARA, denunciando aquellas acciones que perjudiquen la normal prestación del servicio.
Prohibiciones
CAPÍTULO IV
14.1. Colocar cercas u obstáculos en canales de conducción y distribución, y derechos de vía de SENARA.
14.2. Usar los canales y caminos adyacentes como paso de maquinaria en sitios diferentes a los dispuestos para tal efecto por el SENARA, sin previa autorización expresa de la Jefatura del DISTRA.
14.3. Apropiarse de un caudal superior al autorizado por SENARA o derivar caudales en puntos no aprobados por SENARA.
14.4. Depositar en los canales basura o materiales de cualquier naturaleza, que de algún modo, impida el libre curso de las aguas, o las contaminen.
14.5. Operar las compuertas de los canales y otras estructuras que estén bajo el control del Distrito.
14.6. Alterar o dañar las obras de infraestructura construidas por el SENARA.
14.7. Descargar aguas en sitios no aprobados de previo por el SENARA.
De la tarifa y del procedimiento de cobro
CAPÍTULO V
La tarifa para piscicultura tendrá los siguientes componentes:
A- El equivalente a la tarifa de riego de acuerdo con la superficie bajo dominio de riego.
B- Tarifa por concepto de cuota complementaria por piscicultura que contempla la pérdida de flexibilidad en todo el DISTRA, debido a la especificidad del servicio en términos de disponibilidad y continuidad de agua.
Las facturas se pondrán al cobro durante la primera quincena del mes inmediato siguiente a la finalización de cada mes y tendrán como fecha de vencimiento el último día hábil de ese mes.
Asimismo, el SENARA notificará al usuario que se encuentre en condición de morosidad, otorgando un plazo de 10 días hábiles para que ponga al día la deuda, bajo apercibimiento de que una vez vencido el plazo y de persistir la morosidad, el SENARA suspenderá el servicio por falta de pago.
Sanciones
CAPÍTULO VI
22.1 Apercibimiento: Podrá ser aplicada por las autoridades del Distrito cuando el usuario se encuentre en situación de incumplimiento de los deberes y obligaciones establecidas en este Reglamento.
22.2 Suspensión del servicio de agua para piscicultura: El SENARA suspenderá el servicio de agua para piscicultura, sin responsabilidad alguna de su parte, en los siguientes casos:
Aun cuando el servicio esté suspendido, por causas imputables al usuario, ello no lo exime del pago de la tarifa y los recargos correspondientes.
CAPÍTULO VII
Disposiciones finales
TRANSITORIO: Las disposiciones de este Reglamento no afectarán los compromisos de asignación de caudal en proyectos de piscicultura ya existentes, y regulados mediante Convenios suscritos con anterioridad a la promulgación de esta normativa.
