in the entirety of the text - Complete Text of Norm 30101 The project for the construction of the new highway connecting Florencia de San Carlos with Naranjo is declared to be of national interest and public interest Complete Text of record: 4760F N°30101-MOPT N°30101-MOPT THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF PUBLIC WORKS AND TRANSPORT In exercise of the powers conferred by subsections 3) and 18) of numeral 140 of the Political Constitution; the Law for the Creation of the Ministry of Public Works and Transport, N° 4786 of July 5, 1971 and its amendments; and the Law of Public Administration, N° 6227 of May 2, 1978.

1That the Government of the Republic of Costa Rica considers the project for the construction of the new highway connecting Florencia de San Carlos with Naranjo, both cantons of the province of Alajuela, to be of national interest and public interest. For purposes of financing the project, it shall be divided into two sections that are considered part of the same project.
2That by means of a loan with the Export-Import Bank of the Republic of China, approved by Law N° 7624, published in La Gaceta No. 186 dated September 30, 1996, the Government of the Republic of Costa Rica shall finance the construction of "Section I" of the project.
3That by means of a donation agreement formalized between the Government of the Republic of China and the Government of the Republic of Costa Rica on December 9, 2001, the donation of "Section II" of the public works project called "Construction of the Highway to San Carlos (Naranjo - Florencia)" was established, which includes the construction of the mentioned highway segment, its bridges, and its interconnections with the national and cantonal network.
4That prior to this donation agreement, the Government of the Republic of China proceeded with a donation in the amount of US$2,000,000.00 for the contracting of the Chinese company MOH and Associates Inc. for the complete design of the highway.
5That the National Roadways Council (Consejo Nacional de Vialidad) proceeded to contract the Costa Rican Consortium Mas & Imbsen, S. A., bridge engineering consultants, for the final design of the eleven bridges involved in the construction project for the new Florencia Naranjo highway.
6That the National Roadways Council, an agency attached to the Ministry of Public Works and Transport created by Law No. 7798, is responsible for planning, programming, administering, and controlling the conservation and construction of the national road network, and for supervising the correct execution of assigned works, including quality control of the public works.
7That Article 4 of the Donation Agreement referred to in the Third Whereas Clause establishes: For better coordination regarding the execution of this agreement, as well as the complete execution of the project, a Supervisory Unit shall be established, constituted by representatives of both Governments, which shall be in charge of aspects concerning the selection of the contractor company executing the work, contracting, commencement, supervision, and control of the execution. The aforementioned aspects shall be stipulated subsequently by the contracting parties, which shall be ratified in an Executive Decree issued by the Government of the Republic of Costa Rica.
8That it is necessary to define mechanisms for the participation and support of various public sector institutions and private sector entities, as well as to establish the administrative and technical organization that will contribute to the development of the Project.

1Que el Gobierno de la República de Costa Rica considera de interés nacional e interés público el proyecto de construcción de la nueva carretera que comunica Florencia de San Carlos con Naranjo, ambos cantones de la provincia de Alajuela. Para efectos del fínanciamiento del proyecto el mismo será dividido en dos secciones que se consideran parte de un mismo proyecto.
2Que mediante empréstito con el Export-Import Bank de la República de la República de China, aprobado mediante Ley N° 7624, publicada en La Gaceta No 186 de fecha 30 de septiembre de 1996, el Gobierno de la República de Costa Rica financiará la construcción de la "Sección I" del proyecto.
3Que mediante acuerdo de donación formalizado entre el Gobierno de la República de China y el Gobierno de la República de Costa Rica el 9 de diciembre de 2001, se estableció la donación de la "Sección II" del proyecto de obra pública denominado "Construcción de la Carretera . a San Carlos (Naranjo - Florencia)" que incluye la construcción del mencionado tramo de carretera, sus puentes y sus interconexiones con la red nacional y cantonal.
4Que previo a este acuerdo de donación, el Gobierno de la República de China procedió con una donación por un monto de US$2.000.000,00 para la contratación de la empresa china MOH and Associates Inc. para el diseño completo de la carretera.
5Que el Consejo Nacional de Vialidad procedió a la contratación del Consorcio Costarricense Mas & Imbsen, S. A., consultores en ingeniería de puentes para el diseño final de los once puentes que conlleva el proyecto de construcción de la nueva carretera Florencia Naranjo.
6Que el Consejo Nacional de Vialidad, órgano adscrito al Ministerio de Obras Públicas y Transportes creado mediante Ley No 7798, es el encargado de planear, programar, administrar y controlar la conservación y la construcción de la red vial nacional y de fiscalizar la ejecución correcta de los trabajos asignados e incluye el control de la calidad de la obra pública.
7Que en el artículo 4° del Acuerdo de Donación a que se refiere el Considerado Tercero, establece: Para una mejor coordinación sobre la ejecución del presente acuerdo, así como la ejecución total del proyecto se establecerá una Unidad Supervisora constituida por representantes de ambos Gobiernos, la cual tendrá a su cargo los aspectos concernientes a la selección de la empresa contratista que ejecuta la obra, contratación, inicio, supervisión y control de la ejecución. Los aspectos antes mencionados, serán estipulados posteriormente por las partes contratantes, lo cual quedará ratificado en un Decreto Ejecutivo emitido por el Gobierno de la República de Costa Rica.
8Que es necesario definir mecanismos para la participación y apoyo de diversas instituciones del sector público y entidades del sector privado, así como establecer la organización administrativa y técnica que coadyuvará en el desarrollo del Proyecto.
