30095-MP-S THE PRESIDENT OF THE REPUBLIC AND THE MINISTERS OF THE PRESIDENCY AND OF HEALTH In exercise of the powers conferred in articles 21, 50 and 140, subsections 6) and 8) and 20), 180 of the Political Constitution; and based on the General Health Law (Ley General de Salud), Law No. 5395 of October 30, 1973; the Organic Law of the Board of Port Administration and Economic Development of the Atlantic Slope (Ley Orgánica de la Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica), Law No. 3091 of February 18, 1963; the Law of Organization of the Institute for Municipal Development and Advisory Services (Ley de Organización del Instituto de Fomento y Asesoría Municipal), Law No. 4716 of February 9, 1971; and the General Law of Public Administration (Ley General de la Administración Pública), Law No. 6227 of May 2, 1978.

Considering:
The above, given that the waste is hazardous and produces acute and chronic threats not only to the environment but mainly to human life.
5395 of October 30, 1973, prescribes that health is a public-interest good protected by the State, with it being a special function of the State to ensure the health of the population. Therefore, and in view that the improper handling of solid waste can affect not only the environment but also, directly, the health of the community, the State must, by all means at its disposal, avoid a serious public health problem or impact on the environment,
3091 of February 18, 1963, grants JAPDEVA the powers to promote the integral, rapid, and efficient socio-economic development of the Atlantic Slope of Costa Rica. Specifically, subsection g) of article 6 of Law No. 3091 states that JAPDEVA is responsible for providing health authorities with the necessary cooperation for the performance of their respective functions.
4716 of February 9, 1971, indicates that the primary objective of IFAM is to strengthen the municipal regime, stimulating the efficient functioning of local government and promoting the constant improvement of municipal public administration.
Thus, through Vote No. 5758-98, it is stated: "... Due to the incapacity demonstrated until now by the respondent Municipality, the State may, through the instruments granted to it by law, substitute municipal competence, to prevent greater harm, in defense of the fundamental rights of the inhabitants of that canton."
37, held on January 14, 2002, under article III, subsection c) unanimously and definitively agreed to the following: "a-Request from the Executive Branch, in the persons of the President of the Republic and the Minister of Health, in order to protect the health of the inhabitants of the Central Canton of Limón, their collaboration and participation in the tasks of collection and treatment of the solid waste of our canton; b- The Municipality of Limón offers the facilities of technical, human, and financial resources whenever required and circumstances allow, at the request of the Executive Branch; c- We request the Executive Branch to form a Legal Commission and another high-level commission, for each to provide an opinion on the alternatives that allow a definitive solution to the garbage problem, within a maximum period of two months. This Commission shall be responsible for developing a plan to definitively address the solid waste collection and disposal service in the Central Canton of the Province of Limón, to be submitted for the knowledge and approval of the Municipal Council of the Central Canton of Limón. Said plan must be completed within a period of 60 days. This Commission shall extend an invitation to the Municipal Council of the Central Canton of Limón, for it to designate a representative who shall fully integrate into the work of the Commission. For the better fulfillment of its functions, it may appoint any subcommissions deemed necessary.

Texto Completo acta: 47411 DECRETOS DECRETOS 30095-MP-S EL PRESIDENTE DE LA REPÚBLICA Y LOS MINISTROS DE LA PRESIDENCIA Y DE SALUD En ejercicio de las facultades conferidas en los artículos 21, 50 y 140, incisos 6) y 8) y 20), 180 de la Constitución Política; y con fundamento en la Ley General de Salud, Ley No 5395 del 30 de octubre de 1973; la Ley Orgánica de la Junta de Administración Portuaria y de Desarrollo Económico de la Vertiente Atlántica, Ley No 3091 del 18 de febrero de 1963; la Ley de Organización del Instituto de Fomento y Asesoría Municipal, Ley No 4716 del 9 de febrero de 1971; y la Ley General de la Administración Pública, Ley No 6227 del 02 de mayo de 1978.
Considerando:
Lo anterior, en vista que los desechos son peligrosos y producen amenazas agudas y crónicas no sólo para el ambiente sino principalmente para la vida humana.
Por lo tanto, y en vista de que el indebido manejo de los desechos sólidos puede afectar no sólo el ambiente sino también, en forma directa, la salud de la comunidad, el Estado debe, por todos los medios a su alcance, evitar un serio problema de salud pública o de afectación del ambiente,
Específicamente, el inciso g) del artículo 6° de la Ley No 3091, señala que le corresponde a JAPDEVA otorgar a las autoridades de sanidad, la cooperación necesaria para el desempeño de sus respectivas funciones.
Así por medio del Voto No 5758-98 se señala: "... En razón de la incapacidad hasta ahora demostrada por la Municipalidad recurrida, bien puede el Estado, por medio de los instrumentos que la ley le confiere, sustituir la competencia municipal, para evitar males mayores, en defensa de los derechos fundamentales de los habitantes de ese cantón ".
37, celebrada el día 14 de enero del 2002, bajo artículo III, inciso c) acordó unánimemente y en firme lo siguiente: "a-Solicitarle al Poder Ejecutivo, en las personas del Señor Presidente de la República y el Señor Ministro de Salud, con el fin de proteger la salud de los habitantes del Cantón Central de Limón, su colaboración y participación en las tareas de recolección y tratamiento de los desechos sólidos de nuestro cantón; b- La Municipalidad de Limón ofrece las facilidades de equipo técnico, humano y financiero cuando así sea requerido y las circunstancias así lo permitan a solicitud del Poder Ejecutivo; c- Solicitamos al Poder Ejecutivo que se conforme una Comisión Legal y otra de alto nivel, para que cada una brinde un dictamen sobre las alternativas que permitan dar una solución definitiva al problema de la basura, en un plazo máximo de dos meses. En ambas comisiones solicitamos se incluya un representante de la Municipalidad de Limón que será nombrado por el Concejo Municipal". Por tanto,
decretan:
Esta Comisión será responsable de elaborar un plan para atender definitivamente el servicio de recolección y disposición de los desechos sólidos en el Cantón Central de la Provincia de Limón, para ser presentado a conocimiento y aprobación del Concejo Municipal del Cantón Central de Limón. Dicho plan, deberá estar concluido en un plazo de 60 días. Esta Comisión, cursará invitación al Concejo Municipal del Cantón Central de Limón, para que designe un representante quien se integrará plenamente a las labores de la Comisión. Para el mejor cumplimiento de sus funciones, podrá nombrar las subcomisiones que se consideren necesarias.
